Code and application forms could range from $20,000 to $50,000, depending on the extent of the changes to the Code and application forms and the level of public outreach.

CONCLUSION:

Staff recommends that the City Council direct staff to perform the following work, with the goal of returning to the City Council with proposed Zoning Code and other revisions in mid-2026:
a. Revise the City’s Special Event Permit application to make it more user-friendly and easier to complete and submit; and update the Zoning Code to (1) create a new class of “Small Special Events” with fewer requirements and streamlined review, (2) add a category of special events exempt from permit requirements, and (3) align the Code with standards currently used by the Recreation and Community Services Department;
b. Create a new Small Special Event Permit application; c. Establish a clear process for official City-sponsored events; and d. Establish a process for reviewing and permitting special events held or sponsored by individual Councilmembers but not specifically held as City-sponsored events, including “giveaway” events and events which are held during the holiday season (NovemberDecember).

Preparing proposed revisions to the Zoning Code would involve coordination with the Planning & Preservation Commission (which would be requested to make a recommendation to the City Council on all proposed Zoning Code changes) and with City departments and outside agencies involved in the Special Event review process as well as with the public (including applicants who regularly hold special events in San Fernando). The City Council would ultimately make the final decision on any proposed Zoning Code changes.

The City Council also has the following options:
• Accept some, but not all of staff’s recommendations;
• Reject all of staff’s recommendations;
• Provide different direction to staff; or
• Postpone action and seek additional information or analysis.

As noted above, staff would return to the Council with an estimated cost to perform all of the revisions requested by City Council before proceeding with any work.

SPECIAL EVENT APPLICATION
The City of San Fernando celebrates many special events throughout the year. These events are an important part of our community and can add significantly to the quality of life for residents and visitors. Depending on the nature of the events, they can enhance our neighborhoods, highlight products and services, provide marketing opportunities, and add to cultural enrichment of the community.

Special Event Permit Applications must be received by the City of San Fernando Recreation and Community Services no later than •‹š–› (͸Ͳ) days prior to your event date and no more than one (1) year in advance of your date. In general, any organized activity involving the use of, or having impact upon, public property, public facilities, parks, sidewalks, street areas or the temporary use of private property in a manner that varies from its current land use, requires a permit. The Special Event Permit Application will be reviewed to set requirements and fees.

This Special Event Permit Application consists of a three (3) step process:

1. Complete the application. ȋIncomplete applications will not be accepted and will delay processing which could affect the availability of your preferred event date or location.Ȍ

2. Submit a copy of a photo ID and the complete application no later than •‹š–› (͸Ͳ) days before your scheduled event with the processing fee of $50.00 to the Department of Recreation and Community Services located at Recreation Park, 208 Park Avenue in San Fernando. If your application is submitted between fifteen (15) to thirty (30) days before your scheduled event the processing fee is $90.00, or $130.00 if submitted ten (10) days or less prior to the event. Cancellation fees may apply.

3. A City Representative will respond within 10 days regarding your Special Event Application to confirm receipt.

SUBMITTING YOUR SPECIAL EVENT
APPLICATION
Special Events will be classified as one of two (2) event classifications. Any user group or individual found to be intentionally misclassifying their event could be subject to financial penalty or restricted from future event permits.

Classification 1: Public
x Public Property and/or Property Parcel
A Special Event Permit application is required for the use of all or any portion of a public street, sidewalk, median, or alley by an organized assembly of more than 50 people. x Park Facility
If you plan to hold your event at a city park, it is your responsibility to contact the appropriate division or facility manager within the Recreation and Community Services Department in order to coordinate the scheduling of your event. Special rules, regulations and restrictions unique to each site or facility may apply. ‡‡ ††‡†—ˆ‘”ˆ—”–Ї”‹ˆ‘”ƒ–‹‘‘”‡‰—Žƒ–‹‘•”‡‰ƒ”†‹‰–Ї—•‡‘ˆ‹–›’ƒ”•Ǥ Classification 2: Private

THINGS TO CONSIDER WHEN PLANNING A SPECIAL EVENT
As you begin planning for your event, think carefully about the impacts and benefits the event brings to the community. The following are some common problems that preliminary planning can help reduce:
x If your event requires a traffic control plan, remember that a street closure, even for two or three blocks, can affect traffic for miles around the venue due to event related traffic, and the rerouting of traffic around the closure.
x Does your street closure block or impede access to police stations, fire stations, hospital emergency access routes churches, schools, businesses or residents?
x How does your event affect public transportation systems, such as the San Fernando Trolley, Metro Bus Line and freeway access? Are alternate routes available to accommodate daily use of these systems? x Are you planning to serve alcohol at the event? How will the use of alcohol affect the mood, participant safety, and enjoyment of the event, as well as security needs and insurance costs? x What type of music will be featured at the event? How will the noise level impact the surrounding neighborhood?
x Have you made plans to ensure that your event is accessible to the disabled? Disabilities include, but are not limited to, vision, hearing and physical limitations. Does your event plan block any access ramps? Is disabled parking readily available? Are TDD phones on site? Will portable toilets accommodate wheelchairs?
SPECIAL EVENT
APPLICATION PROCESS
The Application process begins when you submit to the Recreation and Community Services Department a completed Special Event ‡”‹–Application. Keep in mind that acceptance of your application should in no way be construed as final approval or confirmation of your request. Throughout the review process you will be notified if your event requires any additional information, permits, licenses or certificates. During our initial application screening process you will be allowed time to provide us with all pending documents (e.g. certificate of insurance, permits, etc.). Delays in providing these items often delay our ability to finish our review process and approve your application in a timely manner. We must receive all required items before issuing a Special Event Permit. Due to the many changing components of an event, in most cases, Special Event Permits are issued only a few days in advance of the event date. x Ї‡˜‡–‡‡†•’‘Ž‹

STREET CLOSURE INFORMATION
There are three (3) types of street closures: 1) hard street closures, 2) rolling street closures and 3) lane closures.

If your event includes a street closure, you will need to submit a Traffic Control Plan (TCP). The Public Works Department will determine whether a professional TCP is required based on the location and type of street closure; or if the event will generate additional traffic or if existing traffic will be severely interrupted. The Public Works Department must approve the TCP before the Special Event Permit can be issued. Street closures can be subcontracted with approval from the City based on a case-to-case basis.

Street closure points must be manned at all times. In most cases, San Fernando Police Department officers may be required to facilitate the closure. The number of officers will depend on the location, type and nature of the closure. Applicant is responsible for hiring the officers and a separate contract will be issued for their service. In some cases, adult volunteers may be stationed at each closure point during the duration of the street closure (including set-up and tear down times). Use of volunteers will be determined by City staff.

Event will occupy: One lane Two lanes Half of s–”‡‡t Full street Closure type: Rolling Street closure (streets opens to normal traffic after participants pass) Hard Street closure (street closed for an extended period of time and/or even– ‡“—‹’‡–™‹ŽŽ„‡’Žƒ

REGIONAL TRANSIT
Any proposed route along or crossing light rail tracks cannot impede train movements. Trains must be allowed to proceed without interruption. The San Fernando Public Works and Regional Transit will provide input whether or not any proposed route affecting their right of way can be accommodated.

Keeping bus detours to a minimum is appreciated. When detours are necessary, lead time for notifying Public Works is required.

PARKING PLAN
When planning your event, it is important to consider the impact on public parking in the area. In some cases, a parking management plan will be required if the venue cannot accommodate the number of anticipated attendees.

If a parking management plan is required, you will need to identify City owned or private parking lots that will be utilized, a shuttle plan, the use of carpools, public transportation, ADA accessible parking provisions and/or special parking requests.

The City of San Fernando has a number of parking facilities that may be available for your event. You may reserve metered and unmetered parking spaces on a City street for your event. Or, if your street closure denies access to metered or unmetered parking spaces for an extended period of time, you will be required to reserve those parking spaces. When parking spaces are reserved, City staff will post “No Parking/Tow Away” signs 72 hours in advance of the event for a fee. Additionally, if the spaces you reserve are metered spaces, and the meters will be in service during the time of your reservation, you will be charged a lost revenue fee per meter.

ACCESSIBILITY
As an event organizer, you are required to comply with all City, County, State and Federal Disability Access Requirements applicable to your event. All temporary venues, related structures, and outdoor sites for special events shall be accessible to persons with disabilities. If a portion of the area cannot be made accessible, an alternate area shall be provided with the same activities that are in the inaccessible areas. It cannot, however, be offered only to patrons with disabilities.

You need to consider the following accessible as you plan your event: first aid, information center, parking, clear paths of travel (to and from, and inside the event), restrooms (see “Restrooms” for requirements), seating, signage, drinking fountains, phones, transportation and access to vendors. If all areas are not accessible, directional signage or a map/ program must be provided to attendees indicating the location of accessible rest-rooms, parking, drinking fountains, phones, etc.

Compliance with the Americans with Disabilities Act and any and all amendments to the act shall be the sole responsibility of the applicant. The applicant agrees to defend and hold the City harmless from any expense or liability arising from the applicant’s non-compliance. For more information about the Americans with Disabilities Act and compliance at events, please visit www.ada.gov.

This checklist is intended to serve as a planning guideline and may not be inclusive of all City, County, State and Federal access requirements. You may be required to attach more detailed information.

SITE PLAN & ROUTE MAP
To ensure appropriate review of your event, it is preferred that you submit blueprints or computer assisted drawings (CAD) of your event site plan. This is applicable for moving routes and fixed venues. If blueprint or CAD plans are not submitted, your site plan should be produced in a clear and legible manner.

Site plans should be submitted on an 8 1/2" x 11" or 8 1/2" x 14" standard format. If blueprints are necessary, a minimum of four (4) copies should be included with your permit application.

Based on your event site plan and components, the Building Official and/or the Los Angeles Fire Department may require an inspection of your venue at your cost before and/or during the event.

Should the scope of work proposed for the event include portable structures, prefabricated structures or site built structures such as bleachers, elevated platforms/stages, tents and membrane structures as well as other similar
City of San Fernando Special Event Application //17 9 February 17, 2026 Special & Regular CC Mtg Page 364 of 448 structures, the Building Official may require the issuance of Building Permits. Please provide all necessary specifications and details to facilitate the structural review, permit issuance as well as any related site inspections required by the Building Official. This process may require more than ȋͶͷȌ calendar days based on the size, number and scope of the proposed temporary construction.

Your event site plan/route map must include but not be limited to:
x An outline of the event venue, including the names of all streets and moving routes of any kind. Indicate the direction of travel and all street or lane closures. x The location of fencing, barriers and/or barricades. Indicate any removable fencing for emergency access. x The provisions for a minimum of twenty-foot (20’) emergency access lanes throughout the event venue. The location of all first aid facilities.
x The location of all stages, bleachers, grandstands, canopies, tents, portable toilets, booths, cooking areas, trash containers, and dumpsters, and other temporary structures. x Location of generator(s) with source of grounding and/ or source of electricity. x Identification of all ADA accessible areas that meet standards, pedestrian access, and requested street closures.
x Other related event components not listed above.

SAFETY EQUIPMENT
If your event involves public right-of-way closures or encroachments, you will be required to obtain traffic safety equipment for the safe closure of your venue and ensure proper detour and parking information is posted. Depending upon the type of event, barricades, traffic cones, directional signage, etc. may be required.

The Public Works Department will review your submitted site plan for cost estimates and requirements. The Public Works Department has final authority to determine safety equipment requirements.

FENCING
Fenced area refers to any event or area within the event that is closed off by temporary fencing. The Los Angeles Fire Department will review your site map and set an occupancy load for the fenced area.

When developing your fenced plan include accurate dimensions, main entrance, and exits. In some cases, a Fire Department inspection may be required (for a fee) to set the occupancy load and check access and exits. (‡‡ ††‡†—)

VENDORS
The City of San Fernando defines “vendor” as an organization or business that sells or advertises products and/or services to event attendees. Generally there are three (3) categories of vendors: 1) food/beverage, 2) merchandise and 3) information. A City of San Fernando Business License is required for vendors who wish to sell, expose for sale, or offer for sale any food/beverage or merchandise in the City of San Fernando. Please contact the City of San Fernando, Finance Department for Business License information. You should require each vendor to provide you, the event organizer, with a copy of their Business License (if applicable) and general liability insurance.

CERTIFIED FARMERS MARKETS
A certified farmers’ market is a location where agricultural products are sold by producers directly to consumers or to individuals, organizations or entities that subsequently sell or distribute the products directly to end users. A certified farmers’ market may be operated on public property with a Special Event Permit.

Additional Permit Required: Additional documentation may be required. Please contact the City of San Fernando or visit sfcity.org for more information. For information on applicable permits, contact the Los Angeles County Health Department, Mid-Valley District at (818)671-2222 a minimum of 30 days prior to the event.

WASTE MANAGEMENT/RECYCLING
You are responsible for properly disposing of all waste and garbage throughout the term of your event, and immediately upon conclusion of the event, the area must be returned to a clean condition. If you, as the event organizer, set a standard of leaving the venue better than you found it, you can have a highly beneficial impact on the San Fernando community and establish a good reputation for your event in the future. In addition, such failure may result in denial of future approval for a Special Event Permit or the requirement of a cash deposit or bond. The City may charge a damage deposit of up to $5,000 for events with a past history of damage or waste problems or for those events with the potential for damage or significant waste.

In an effort to make our City more sustainable, you as the event organizer are responsible for providing a sufficient number of garbage and recycling receptacles at your event. The City of San Fernando no longer directly provides commercial services but the City can provide street sweeping services, at a cost. (See ††‡†—
for City Codes)

WASTE MANAGEMENT
The city does not provide street sweeping services for special events, so please plan accordingly. California State law requires each City to divert 50% of solid waste from landfill. Republic Services manages the City of San Fernando’s solid waste programs. You can help by planning recycling strategies for the waste generated at your event by calling the Public Works Department at (818) 898-1222. Exclusive franchise agreements require applicants to use Republic Services for garbage removal. Please contact them at least 30 days in advance to arrange for service at the event. Page 1 of 5 ends

DIVISION 5. TEMPORARY USE PERMIT AND SPECIAL EVENT PERMIT Sec. 106-847. Purpose.

The intent and purpose of this division is to establish a process for reviewing proposed temporary uses and special events to ensure that basic health, safety, and community welfare standards are met, while approving suitable temporary uses and special events, with the minimum necessary conditions or limitations consistent with the temporary nature of the activity. A temporary use permit and special event permit allows for short-term activities that might not meet the normal development or use standards of the applicable zoning district but are considered acceptable due to their temporary nature.
(Ord. No. 1732, § 3(Exh. A), 5-5-2025)
Sec. 106-848. Applicability.
(a) Permit requirement. A temporary use permit or special event permit approved by the applicable review authority shall be required for all uses identified in this division and shall be issued before the commencement of the activity.
(b) Exempt activities. The following temporary uses are exempt from requiring a temporary use permit or special event permit and other city approval. Uses other than the following shall comply with this division. (1) On-site contractor's construction yards, in conjunction with an approved construction project. The activity shall cease upon completion of the construction project, or the expiration of the companion building permit authorizing the construction project.
(2) Promotional activities related to the primary product lines of a retail business, and similar activities (e.g., book readings and signings at bookstores, opening receptions at art galleries). (3) Emergency public health and safety activities.
(Ord. No. 1732, § 3(Exh. A), 5-5-2025)

b. Provide staff direction, as appropriate.

BACKGROUND:

1. On June 6, 2022, the City Council adopted the City’s 6th Cycle 2021-2029 Housing Element, Safety Element Update, and Mitigated Negative Declaration.

2. On October 21, 2024, the City Council accepted the Regional Early Action Planning (REAP) 2.0 funding and entered into a Memorandum of Understanding (MOU) with Southern California Association of Governments (SCAG) (Contract No. 2306) to implement the REAP 2.0 Grant Program and help carry out key programs from the City’s 6th Cycle Housing Element. The programs include the evaluation of adaptive re-use opportunities to support housing, streamlining the review process for new housing, and compliance with state housing laws.

3. On March 3, 2025, the City Council approved Contract No. 2343 with Rincon Consultants to implement the REAP 2.0 Grant Program, which includes updating the zoning code to comply with state laws, conduct a historic resource survey, and create clear objective design standards to maintain neighborhood character while streamlining development.

4. On May 5, 2025, the City Council approved a Community Outreach and Engagement Plan for the REAP 2.0 Grant Program to ensure that the diverse voices and priorities of San Fernando shape the development of critical planning documents that will guide housing production, preserve neighborhood character, and streamline city processes.

5. On August 12, 2025, the Planning and Preservation Commission received a presentation on the Housing Element Implementation Program and provided feedback.

6. On September 15, 2025, the City Council received a presentation on the Housing Element Implementation Program and provided feedback.

7. On February 9, 2026, the Planning and Preservation Commission received a presentation on the Public Review Draft of the Zoning Code Update, Specific Plan-5 Update and Objective Design Standards.

ANALYSIS:

The Housing Element Implementation Program advances key commitments outlined in the City’s 2021–2029 (6th Cycle) Housing Element to support housing production, preservation, and equity.

The program includes development of a Community Stabilization Manual to prevent displacement, maintain affordable housing, and affirmatively further fair housing; an update to the City’s 2002 Historic Survey to identify eligible historic resources and promote adaptive reuse and neighborhood preservation; revisions to the Density Bonus Ordinance to ensure compliance with State housing law and incentivize affordable housing development; updates to the Zoning Code and San Fernando Corridors Specific Plan (SP-5) to expand housing opportunities, increase infill capacity, and streamline project review; and improvements to the City’s housing development review process to remove barriers and facilitate timely housing delivery.

In August and September 2025, the Housing Implementation Program and Objective Design Standards were presented to the Planning and Preservation Commission and the City Council for preliminary feedback. During these meetings, both bodies expressed a preference to adhere only to the minimum requirements mandated by state law, including not offering density bonuses beyond those required by statute. They also emphasized the importance of increasing open space without increasing residential density, improving transparency and simplicity within the planning process, and supporting a broader range of neighborhood‑serving commercial uses and family‑friendly entertainment opportunities. Revisions to the documents have been completed in accordance with state law. Below is a description of the Zoning Code Updates, Specific Plan Updates and the proposed Objective Design Standards document.

Objective Design Standards
The development of the Objective Design Standards (ODS) has been a nearly 6 month-long process working with internal departments, consultant, and with the guidance of the Planning Commission and City Council. Staff and the consultant team have done extensive research of the City’s existing documents that pertain to design standards for residential and mixed-use development such as the Specific Plan 5, Municipal Code, and state laws to elevate the quality of the document. Staff worked with the consultant to establish design standards for new city-wide Residential and Mixed-Use Objective Design Standards with the intent of achieving and maintaining high-quality site planning and building design.

February 17, 2026 Special & Regular CC Mtg Page 394 of 448 Receive and File a Presentation Regarding Public Review Draft of the Zoning Code Update, Specific Plan-5 Update and Objective Design Standards.

Page 3 of 6 ends

The city-wide Residential and Mixed-Use Objective Design Standards set design standards for each type of residential development to promote neighborhood character while streamlining the development process as required by state law. Objective standards are established for site design (set standards for building orientation, site access, and increase pedestrian comfort and safety), building design (mediate scale, massing and set standards for transitions to lower scale development), landscape (maintain established appearances, buffer residential units, create character and identity with landscape design, promote sustainability goals) and architectural styles. The architecture styles include Spanish Colonial Revival, Ranch, Craftsman, Contemporary, Tudor Revival, and Mission Revival.

Zoning Code Update
The Zoning Code is a Section of the Municipal Code that regulates and governs how land may be used and developed, establishing standards such as allowable land uses, building heights, setbacks, parking standards and site development requirements. The Density Bonus Ordinance is a section within the Zoning Code that implements state density bonus law by allowing qualifying housing projects to exceed certain standard zoning limits such as density, height, or parking in exchange for affordable units.

The proposed Zoning Code amendments modernize local standards, improve clarity, and ensure consistency with state housing and land‑use requirements:
• Residential: Regulations have been updated to align with state law. Examples of this includes updates to Accessory Dwelling Units (ADUs) to be consistent with Assembly Bill (AB) 130, SB 543, AB462, and AB 1154, as well as removing large Family Day Care facilities to be consistent with SB 234.
• Commercial: Uses have been simplified by consolidating the definitions for personal service and retail categories to better reflect current land‑use terminology. As required by state law, emergency shelters are now permitted in the C-2 zone and within Specific Plan – 5, as required by the housing element and State law. Multi-family is permitted by right in all commercial zones when developed under SB 6 or AB 2011. Fitness facilities under 2,500 square feet within the C-1, C-2, and SC zones are proposed as permitted by right. Commercial recreation facilities under 2,500 square feet within the C-1, and C-2 zones are proposed as permitted by right. Additionally, as required by State law secondhand stores are now permitted by right in all commercial zones including C-1, C-2, C-3, Downtown District, Mixed-Use Corridor District, and Auto Commercial District. • Open Space: Areas such as parks, picnic areas and playgrounds were added as conditionally permitted uses in all residential zones and in the Service Commercial zone. • Density Bonus: This Ordinance was revised and reorganized to be consistent with State Density Bonus Law. To comply with the Housing Element, a density bonus was added for housing developments that include a certain percentage of units with three or more bedrooms.

February 17, 2026 Special & Regular CC Mtg Page 395 of 448 Receive and File a Presentation Regarding Public Review Draft of the Zoning Code Update, Specific Plan-5 Update and Objective Design Standards.

Page 4 of 6 ends

• Parking: Standards have been expanded to include off-street parking standards for funeral homes, government offices, and social clubs. Dining parking requirements are now based on customer‑accessible floor area and smaller fitnessfacilities and restaurants under 2,500 square feet have the same required parking as retail (one space for each 300 square feet of gross floor area). Updates also address residential parking dimensions, compact and ADA stall specifications, and new loading requirements. • New Mixed‑use Zone: Regulations and standards remain the same but have been reorganized through the removal of the Mixed‑Use Overlay and the creation of two new zones, CMU‑1 and CMU‑2, consistent with previous C‑1 and C‑2 designations. This update was made to protect the city from litigation, “Builder’s Remedy,” and prevent invalidation of the Housing Element, as some cities in California have faced lawsuits by relying on Housing Overlays.
• Administrative: Procedures have been clarified and streamlined, including site plan review, SB 35 processing, discretionary review for projects opting out of the Objective Design Standards, and revisions to CUP‑approved plans. Regulations for nonconforming structures have been clarified. The process for reviewing projects within the Precise Development (PD) Overlay was updated to require a Site Plan Review Permit rather than a Certificate of Use, which is a permit that is no longer used by the City.

Specific Plan Update
A Specific Plan is a detailed planning document that implements the general plan for a defined geographic area, establishing tailored land use regulations, development standards, infrastructure requirements, and design guidelines to guide coordinated, area-specific development. The San Fernando Corridors Specific Plan- 5 plan area covers Maclay Avenue, the Downtown area, 1st Street, San Fernando Road, and Truman Street.

Parallel updates were made to SP-5 to ensure consistency with the Zoning Code, expand opportunities for residential development, and integrate Housing Element requirements.

Revisions include allowing apartments and condominiums in additional districts, adopting State‑required parking exemptions, and updating noise and design requirements. Additionally, as recommended by commission and council, personal service, entertainment, and retail land uses that are permitted by right in the Downtown District were updated to be permitted by right in the Maclay district. Updates also include revisions to subjective design standards to be objective or to instead refer to the Objective Design Standards document.

SB-79
Senate Bill 79, also known as the “Abundant and Affordable Homes Near Transit Act”, was signed into law on October 10, 2025, and will take effect on July 1, 2026. This legislation establishes new statewide development standards for properties located within one half mile or one quarter mile of specific transit stops on land zoned for residential, mixed use, and commercial uses, ensuring that multi-family housing is allowed at specified minimum heights, densities, and floor area ratios. SB 79 also requires Southern California Association of Governments (SCAG) to prepare Transit Oriented District (TOD) maps that classify transit areas into tiers based on transit type. At February 17, 2026 Special & Regular CC Mtg Page 396 of 448 Receive and File a Presentation Regarding Public Review Draft of the Zoning Code Update, Specific Plan-5 Update and Objective Design Standards.

Page 5 of 6 ends

this time, there are no transit facilities in or near the City that meet SB 79 thresholds. However, SB 79 also applies to planned LA Metro projects. Currently LA County Metro is planning for improvements to the nearby Sylmar station. Improvements to these stations may increase commuter rail frequency beyond the thresholds in SB 79, and the City would have to increase densities within a quarter mile of the station. The potential area is identified in the exhibit below.

City staff is awaiting further information and clarification from SCAG regarding the following:
• If the Sylmar Station would qualify as a Tier 2 Transit Stop within SB 79. • If Sylmar Station does qualify, where would the increased density radius be measured from since no station improvement plans are available.

Outreach
The team has hosted five pop-up events at various City facilities including Las Palmas Senior Citizen Club, Recreation Park and Lopez Adobe/Summer Concerts on June 1, June 14, July 18, August 23 and August 30, 2025 to share project updates with the community and gather input.

Three of these events featured an interactive activity where participants provided feedback on five key topics: zoning, historic preservation, design, neighborhood character, and community engagement. The other two pop-up events focused on promoting the community survey, which includes questions related to design, development, open space, and land use. In December the team held a Community Workshop in which residents participated in a game of Lotería where each card represented a planning topic and informed the residents about the topic and prompted questions for feedback. To date, 15-20 people participated in each of the five pop-up events and 102 people have completed the survey. Continued outreach is scheduled for February 11th, and 21st. The survey remains active and will provide results of the survey at a future meeting.

Planning and Preservation Commission Study Session
On February 9, 2026, the Planning and Preservation Commission reviewed the draft Zoning Code Update, Specific Plan-5 Update, and Objective Design Standards. Key feedback centered on the proposed zoning and policy updates. Additional Commissioner comments consisted of clarification on the concept of modernizing commercial spaces, proposed reduced parking requirements for gyms and small restaurants, as well as proposed density bonus provisions, and applicability of SB 79 to San Fernando.

Historic Resource Survey
Buildings throughout the City were evaluated to update the City 2002 Historic Survey to include eligible historic resources. The newly identified historical resources were documented in a survey report that will be provided at a future date.

BUDGET IMPACT:

There is no additional funding impacts associated with this update. The Comprehensive Housing Element Implementation Program is funded by a $1,125,000 SCAG REAP 2.0 Grant Program through June 30, 2026. The adoption of the final plan is tentatively scheduled for the City Council on June 15, 2026. However, failure to complete the project by this deadline will result in forfeiture of grant funds.

PUBLIC WORKS DEPARTMENT 117 MACNEIL STREET, SAN FERNANDO, CA 91340 (818) 898-1222 WWW.SANFERNANDO.GOV REVIEW: ☒ City Clerk ☒ Director of Admin. Services ☒ City Manager To: Mayor Joel Fajardo and Councilmembers
From: Kanika Kith, City Manager
By: William Evans, Interim Director of Public Works

Date: February 17, 2026
Subject: Discussion and Consideration to Approve a Revised Phased Scope of Work for the Las Palmas Park Revitalization Project to Match Available Funding and Proceed with Phase I Final Design and Construction
RECOMMENDATION:

It is recommended that the City Council:
a. Approve a revised scope of work for the Las Palmas Park Revitalization Project which divides the project into two (2) phases: Phase I at $3.7 million and Phase II at approximately $6.5 million (Attachment “A”); and
b. Authorize to proceed with final design and construction of Phase I of the revised project.

BACKGROUND:

1. On December 8, 2021, the California Department of Parks and Recreation awarded the City a $4.2 million grant for the Las Palmas Park Revitalization Project.

2. On June 6, 2022, the City Council authorized the release of a Notice Inviting Bids for design and community engagement services for the Las Palmas Park Revitalization Project.

3. On January 3, 2023, the City Council awarded a Professional Services Agreements to RJM Design Group, Inc. (Contract No. 2107) in a not-to-exceed amount of $490,121 for design of Las Palmas Park Revitalization Project; and Pacoima Beautiful (Contract No. 2129) in a not-toexceed amount of $50,000 for community engagement services.

4. On September 5, 2023, the City Council approved a conceptual design (page 1 of Attachment “A”) for the Las Palmas Park Revitalization Project, following the completion of the initial design and community outreach.

February 17, 2026 Special & Regular CC Mtg Page 401 of 448 Discussion and Consideration to Approve a Revised Scope of Work for Las Palmas Park Revitalization Project, Phase 1

Page 2 of 4 ends

5. In May 2024, RJM Design Group, Inc. submitted cost estimates of $10.2 million, which exceed the remaining grant balance of $3.7 million. With the total renovation budget identified, staff began work on a phased approach to match available funding. Based on the 2024 cost estimate, staff projects that the proposed Phase I can be completed within the remaining $3.7 million budget.

6. On September 11, 2025, staff shared with the Parks, Wellness, and Recreation (PWR) Commission a plan to complete the Las Palmas Park Revitalization Project in phases.

Following discussion, the PWR Commission expressed its support and recommended approval of the phased approach to the City Council.

7. On October 6, 2025, the City Council authorized the submittal of a Grant Application for up to $4 million to the Los Angeles County Regional Park and Open Space District for the 2025 Competitive Grant Cycle for a proposed Phase II for the Las Palmas Park Revitalization Project.

If approved, these additional funds would help construct a significant portion of the proposed Phase II portion of the project.

ANALYSIS:

Parks are essential community assets that provide spaces for recreation, social interaction, and environmental benefits while promoting physical and mental well-being. They enhance quality of life, support sustainability, and contribute to local economic vitality. Revitalizing parks ensures these benefits continue by modernizing facilities, improving safety, and incorporating inclusive and eco-friendly features. Through revitalization, communities preserve public spaces, foster engagement, and create vibrant, accessible environments for current and future generations.

The Las Palmas Park Revitalization Project is a Proposition 68 funded project through the California Department of Parks and Recreation’s Statewide Parks Development and Community Revitalization Grant Program. In December 2021, the City was awarded a $4.2 million grant to revitalize Las Palmas Park. The revitalization plan approved by the City Council in 2023 (page 1 of Attachment “A”) includes improvements to the ball fields, playground, shade/picnic shelters, fitness area, basketball courts, parking lots and restroom/concession stand as well as the construction of a new splash pad.

In addition to approving the conceptual design for the Las Palmas Park Revitalization Project, the City Council in September 2023 authorized the designer RJM Design Group, Inc. to proceed with the project design. During the design phase, staff identified challenges affecting the project’s constructability, including high construction costs and increasing costs of building supplies. Due to all of these factors, cost estimates for the total renovation project totaled approximately $10.2 million, which was significantly higher than the awarded $4.2 million grant award.

February 17, 2026 Special & Regular CC Mtg Page 402 of 448 Discussion and Consideration to Approve a Revised Scope of Work for Las Palmas Park Revitalization Project, Phase 1

Page 3 of 4 ends

To address these challenges, staff evaluated multiple options, including additional funding opportunities, project phasing, and scope modification. Based on this analysis, staff recommends a phased implementation approach that reduces the original scope of work into a Phase I scope that prioritizes essential park improvements and preserves the ability to complete additional project elements in a future Phase II, subject to securing additional funding.

The proposed Phase I scope includes improvements to the following park amenities:
• Playground: Renovation of the playground adding ADA accessibility and shading • Fitness Area: Renovation of the outdoor exercise equipment • Shade/Picnic Shelters: Renovation of the picnic shelters and walking path lighting • Basketball Courts: Renovation of the basketball court with lighting Example images of the Phase I improvements are shown on page 3 of Attachment “A”.

The revised scope Phase I preserves essential park improvements and ensuresthe park continues to meet community needs identified through community engagement conducted in the initial development of the project while remaining within the approved budget.

To allow the remaining work on the renovation project to proceed in Phase II of the revised project scope, staff has pursued additional grant funding opportunities such as the 2025 Competitive Los Angeles County Regional Park and Open Space District Grant. In October 2025, staff submitted a grant application for the proposed Phase II of the Las Palmas Park Revitalization Project which would fund improvements to additional amenities such as the two (2) ball fields and walking paths within the park. The City expects to receive notice no later than March 2026 on this additional grant funding application.

Should the City Council approve the Phase I/II approach, staff will present the revised scope of work to the California Department of Parks and Recreation (the granting agency) for final approval. City staff has kept the granting agency informed throughout the process and has provided regular updates to ensure alignment with grant requirements and expectations. Staff will continue to coordinate closely with the granting agency to facilitate a smooth review and approval process. Once final approval is received by the granting agency, staff will provide RJM Design Group with the notice to proceed with final design for Phase I.

BUDGET IMPACT:

The City received a $4.2 million grant award through the California Department of Parks and Recreation for the Las Palmas Revitalization Project. The design component has incurred costs of $299,090 under the RJM Design Group contract and $41,598 has been expended for Public outreach activities under the Pacoima Beautiful contract. The aggregate expenditure for these February 17, 2026 Special & Regular CC Mtg Page 403 of 448 Discussion and Consideration to Approve a Revised Scope of Work for Las Palmas Park Revitalization Project, Phase 1

Page 4 of 4 ends

components is $531,719, leaving an available balance of approximately $3.7 million for the project.

Due to continued construction cost escalation and inflationary pressures, the projected cost of completing the full original project scope now exceeds the available resources. Refining the project into a Phase I scope enables the City to advance the work while remaining within the currently available project budget balance of $3.7 million.

Staff have submitted a Grant Application for up to $4 million to the Los Angeles County Regional Park and Open Space District for the 2025 Competitive Grant Cycle for the proposed Phase II of the Las Palmas Park Revitalization Project. If approved, staff will return to City Council to appropriate the additional funds and provide more detailed specifications for the proposed Phase II portion of the project.

CONCLUSION:

It is recommended that the City Council:
a. Approve a revised scope of work for the Las Palmas Park Revitalization Project which divides the project into two (2) phases: Phase I at $3.7 million and Phase II at approximately $6.5 million (Attachment “A”); and
b. Authorize to proceed with final design and construction of Phase I of the revised project.

Subject: Discussion and Consideration to Place a One-Quarter Cent Local Sales Tax Increase Measure on the Ballot for the City’s June 2, 2026 General Municipal Election RECOMMENDATION:

It is recommended that the City Council:
a. Discuss placing a one-quarter cent (0.25 percent) local transactions (sales) and use tax increase measure on the ballot for the City’s June 2, 2026 General Municipal Election; and b. Provide staff direction, as appropriate.

BACKGROUND:

1. In Fiscal Year (FY) 2012-2013, the City declared a fiscal emergency and held a special election for the San Fernando electorate to decide on a temporary half cent (0.50 percent) Transaction and Use Tax (an add-on tax to the standard sales tax).

2. On June 4, 2013, the “City Services Emergency Protection Measure” (Measure “A”) was approved by 60% of voters. The Tax became effective on October 1, 2013, with a sunset date of October 1, 2020.

3. On November 6, 2018, the “San Fernando Preservation and Beautification Measure” was approved by 69% of voters to extend the half cent local Sales Tax indefinitely.

4. On November 3, 2020, the “Keep Sales Tax Local” measure to increase the local transaction tax by an additional one-quarter cent (0.25 percent) was approved by 56% of voters.

5. The City began collecting the additional Transaction Tax on April 1, 2021, for a total Local Sales Tax of three-quarters cent (0.75 percent).

6. In January 2026, through the League of California Cities, staff was notified that the Los Angeles County Board of Supervisors was considering a temporary one-half cent general sales tax measure to be placed on the ballot for the June 2, 2026 Statewide Direct Primary Election.

7. On February 6, 2026, the City issued a letter of opposition to Los Angeles County Supervisor Lindsey Horvath regarding the proposed temporary one-half cent general sales tax measure (Attachment “A”) and submitted the letter as a public comment for the Los Angeles County Board of Supervisors’ Regular Meeting on February 10, 2026.

8. On February 10, 2026, the Los Angeles Board of Supervisors adopted a resolution ordering, calling, and giving notice of a special election to implement a one-half cent Countywide general retail transactions and use sales tax measure to be placed on the ballot for the June 2, 2026 Statewide Direct Primary Election (Attachment “B”).

ANALYSIS:

Under California Revenue and Taxation Code Section 7285.9, cities, subject to voter approval, may implement local transactions and use taxes which are similar to the standard sales and applies to many of the same types of purchases as the standard sales tax. If presented to voters as a general tax whose proceeds may be used for any governmental purposes, then such taxes may be approved by simple majority of votes cast at a city election. This tax is assessed in addition to the existing sales tax and is collected concurrently and in a similar manner. With certain exemptions—such as most unprepared food items and prescription medications—the tax generally applies to over-the-counter sales of tangible goods and restaurant transactions. There are, however, some distinctions from traditional sales taxes. For large purchases like appliances or furniture, the tax applies only if the item is delivered to a San Fernando address or picked up from a store within the city. For vehicles, trailers, and watercraft, the additional tax is imposed only when the item is registered to a San Fernando address, regardless of where the purchase occurs.

The Bradley‑Burns Uniform Local Sales and Use Tax Law imposes the California statewide base sales tax rate of 7.25%, which includes a 1.00% local Bradley‑Burns tax returned to cities and counties. Beyond this base, local jurisdictions (both cities and counties) may adopt local transactions and use taxes, subject to a cumulative statutory cap of 2.00%. In other words, as a general rule, both a county and the cities within the county may layer their own transactions and use taxes on top of the statewide sales tax rate provided the combined effect of these taxes does not raise the overall tax rate by more than 2.00%. From time to time, however, a county or a city may secure special legislation from the State which allows them to add an additional layer to the overall tax rate without the added layer counting toward the 2.00% cap. This has been done multiple times by the County of Los Angeles. Without such special legislation, however, any proposed add on layer would be limited to whatever unused portion of the 2.00% happens to remain for the taxing jurisdiction.

In Los Angeles County, for most cities
including San Fernando, the total sales tax
rate is currently capped at 10.75%. In addition
to the State and County tax base, San
Fernando has a voter approved transaction
and use tax of 0.75%. Consequently, the
current cumulative sales tax rate in San
Fernando is 10.50%. The City of San
Fernando, therefore, can claim up to a 0.25%
add-on tax for local use and investment to
meet the maximum tax cap. A breakdown of
the existing sales tax rate, by taxing entity, is
provided in the above illustration. Additional
details regarding each measure are included
as Attachment “C”.

Many jurisdictions in Los Angeles County have
already reached or exceeded this cap through
special legislation (Attachment “D”). Of the 88 cities within Los Angeles County, sales tax rates range between 9.75% - 11.25% as follows:

Sales Tax Rate No. LA County Cities

9.75% 29

10.25% 6

10.50% 40

10.75% 11

11.25% 2
On February 10, 2026, the Los Angeles County Board of Supervisors advanced a countywide halfcent sales tax increase. The County tax measure is being proposed to address the County public health services needs resulting from federal funding cuts. If the County measure is approved by voters, the increase would raise the overall sales tax rate in San Fernando and secure the balance of the local tax capacity, with nearly all incremental revenue flowing to the County rather than the City. We are informed that a number of cities with access to the currently available 0.25% of the overall 2.00% cap are considering placing measures on the June ballot so that the 0.25% is not absorbed by the contemplated County of Los Angeles measure approved for the June 2026 Statewide Primary election ballot for June 2, 2026.

For consideration is the question of whether the remaining allowable capacity under the sales tax cap should be allocated to the City or to the County. The following scenarios outline potential outcomes:

Page 4 of 5 ends

• If no action taken by City Council: The County’s sales tax measure as proposed exceeds the maximum tax cap. To levy at 0.50% across all cities in the County, special legislative action is required (Attachment “E”). If denied, the County may only be able to levy up to the maximum cap within each city, which would be 0.25% in the City of San Fernando.

The legislative review and approval are still pending. In either case, residents would still pay the higher tax rate, but the County would entirely benefit from the increased revenue.

The sales tax rate for the City would increase up to 11.00%. • If City Council approves the proposal of a Sales Tax Measure: The City could propose up to the maximum 0.25% cap. Both the City and County measures would appear on the ballot.
o If the City measure passes but the County measure fails: In this scenario, the new sales tax rate for the City would increase to 10.75% with San Fernando retaining its local revenue stream. Future ability for the County to levy taxes beyond the maximum cap would require special legislative approval. o If the City measure fails but the County measure passes: Same outcome as no action taken by City Council.
o If both sales tax measures pass: At this time, it is unknown how the State would reconcile the competing tax measures and which would prevail. When confronted with a similar situation in Northern California in 2024 when competing city and county tax measures both one, the California Department of Tax and Fee Administration, the State agency responsible for collecting sales taxes referred the matter to the State Attorney General to render an opinion on the matter. Before a opinion could be drafted, however, the legislative intervened with special legislation that exempted the County tax from the 2.00% cap thereby rendering the issue moot and allowing both taxes to be collected without one cancelling the other out.

Based on the above scenarios, staff is seeking direction from City Council if staff should return with additional information regarding a local sales tax measure or take no action at this time.

Process to Place a Tax Measure on the Ballot at a Regular Election.

In order to place a tax measure on the ballot at the June 2, 2026 regular election, the City Council must adopt a resolution, approving the ballot question, and directing the City Attorney to draft the impartial analysis. The City must also adopt an accompanying ordinance that, if approved by the voters in June 2026, would become law and effectuate the proposed tax. The resolution must be transmitted to the County of Los Angeles Registrar/Recorder no later than March 6, 2026. Both actions may be taken at a Regular or Special meeting of the City Council.

Page 5 of 5 ends

BUDGET IMPACT:

There is no immediate fiscal impact from discussion regarding a local sales tax measure. If the City Council directs staff to place a one-quarter cent sales tax measure on the ballot for the June 2, 2026 Statewide Primary Election, additional revenue analysis, draft ballot language and impartial analysis, community engagement plans and election administration costs will be returned for review at the next City Council Meeting on March 2, 2026.

CONCLUSION:

Staff is seeking direction from City Council if staff should return with additional information regarding a local sales tax measure of one-quarter cent, continue to monitor the Los Angeles County Board of Supervisors’ proposal or take no action at this time.

RE: LETTER OF OPPOSITION - Motion by Supervisor Mitchell – Securing Funding to Preserve Critical County Services Cut by H.R.1
Dear Supervisor Horvath,
On behalf of the San Fernando City Council, the City respectfully expresses its opposition to Supervisor Holly J. Mitchell’s recent motion calling for a temporary ½ cent general sales tax measure to be placed on the June primary ballot. The proposed measure would generate revenue for health and safety net services that are at risk of disappearing due to funding cuts associated with H.R.1.

The City recognizes the serious fiscal challenges presented as a result of H.R.1 on L.A. County Department of Health Services’ (DHS) budget. However, the proposed sales tax increase would create significant indirect financial impacts for residents and cities that are already experiencing substantial economic strain countywide.

In particular, the City is concerned with the potential loss of local control, given that the motion would enable LA County to seek a legislative exemption allowing this sales tax measure to bypass the state cap on local sales taxes. If such legislation passed, cities such as San Fernando that are already at or near the cap will be left with limited future options to generate revenue towards much-needed local services in our communities.

Additionally, the City has concerns regarding the structure of the proposed revenue model. As outlined in the motion, revenues generated would be deposited into L.A. County's General Fund, which technically classifies the dollars as unrestricted operating funds in future years. If a measure of this nature is pursued, it should be structured as a special tax to ensure appropriate safeguards and accountability, and to guarantee that revenues are dedicated to protecting residents’ health and well-being.

The City is also concerned about the temporary nature of the measure. While the motion states the measure will only be effective from October 1, 2026, to October 1, 2031, other temporary L.A. County measures have recently been extended (i.e.

Measure H evolving into Measure A in 2024). This has led residents to reasonably question whether temporary taxes remain temporary in practice.

Further, if this general sales tax measure were to be extended, it would have serious, long-term implications for cities’ ability to generate much-needed local revenue. For these reasons, the City of San Fernando respectfully requests that the Board reconsider this approach and engage in an open dialogue with cities to collaboratively address today’s fiscal challenges without placing additional burdens on residents or constraining cities.

Thank you for your leadership and continued commitment to the well-being of residents in our community. Please do not hesitate to reach out to my office with any questions you may have on the City’s position.

Sincerely,

Review of Rental Control Policies in the City of San Fernando Agenda: Tuesday, February 17, 2026
Problem:San Fernando is currently facing challenges related to rental afford ability and tenant protections. Many residents are experiencing increasing rent costs, which can lead to displacement and housing insecurity. The existing rental policies may not fully address the needs of low- and moderate-income families, leaving a gap in protections for tenants and stability in the rental market.

Proposed Solution:Conduct a comprehensive review of the city's current rental control and tenant protection policies. Explore options for strengthening rent control measures, improving tenant rights, and providing resources to landlords to maintain safe and affordable housing. Consider programs that balance tenant protections with incentives for property owners to maintain and improve rental units.
□ □
Direct city staff to prepare a report on the current rental control regulations, identify gaps or weaknesses, and present recommendations for policy updates or new initiatives. The goal is to ensure rental affordability, protect tenants from displacement, and maintain a stable and fair rental market in San Fernando.

Current Situationln 2002, the City approved the construction of a new Public Works Maintenance and Operations Yard facility located at 500 First Street, San Fernando, CA 91340. Additionally, the facility was intended to offer appropriate rest and support areas for employees, as the department operates seven days a week and is often required to respond to emergencies on a 24-hour basis.

Additionally, this discussion would serve as a starting point to explore possible funding opportunities and available resources to support necessary upgrades or improvements to the facility.

Photographs of the facility will be presented during the presentation.
