Budget Study Session No. 2: The 2nd Study Session was held on May 26, 2026, in which the City Council received a presentation from the City Clerk, Community Development, and Recreation & Community Services Departments. Comments and follow-up actions discussed during the meeting are provided below. Responses to items are provided in blue.

CITY CLERK’S OFFICE
• Request for staff to provide a list of Cesar Chavez Memorial contributors: On October 6, 2024, City Council approved an initial funding plan for the César E.

Chávez Memorial site (available digitally through web link). No additional reporting to City Council was identified following the site’s construction. Staff recently contacted the Pueblo Y Salud to inquire about additional records of contributors; however, they were unable to supply records on brick and plaque sales or donations.
• Suggestion to augment banners that encourage the community to vote during the election season: The City’s next election is March 2028. Staff will incorporate in July 20, 2026 Special & Regular CC Mtg Page 37 of 364
ATTACHMENT “A”
2027-2028 budget process for additional consideration and request through Los Angeles County Election Office resources.
• Request to provide a comment drop box for City Council Meeting preferred translators: Staff will review costs and determine a comment box review process to present to the City Council consideration and direction. • Recommendation for City Clerk’s Office to attend the elections ballot processing center: Staff annually attends the Los Angeles County Registrar/Recorder’s Annual City Clerk Summit where election information is presented. Additionally, the City Clerk has previously visited the ballot processing center. A time will be scheduled for the Deputy City Clerk/Management Analyst to visit and review the ballot processing center.
• Request for information distinguishing the City Council Handbook from Procedural Manual and timeline: The City Council Procedural Manual covers processes that occur during a City Council Meeting and City Council’s roles and responsibilities, with specific references to the Government Code, meeting management, and required elected official forms. Whereas the City Council Handbook serves as an orientation guide that outlines key policies, benefits and compensation, key staff contacts, technology and security practices, and travel and conference procedures, etc. to help Councilmembers understand operational processes and available resources.

COMMUNITY DEVELOPMENT DEPARTMENT
• Staff to provide clarification regarding the $65,000 enhancement for legal services, as listed at no net cost: While other enhancements are cost-only, legal services for code enforcement will also collect fees on outstanding cases. The revenues then offset the expense, resulting in an estimated net cost of zero.

RECREATION & COMMUNITY SERVICES (RCS) DEPARTMENT
• Events Discussion:
o Can non-profit organizations assist with Senior Fest and San Fernando Valley Mile Run events: Yes, partnering with interested organizations to sponsor events is always welcomed. The challenge has been due to staffing, as there is no dedicated position within Recreation & Community Services to market and recruit sponsorships. In turn, this role is only conducted intermittently between special event coordination as time allows.
o Provide a list of special events to include additional information regarding co-sponsorships, complete staff costs including regular time vs overtime costs, and attendance: A list is available digitally through web link. o Consider partnering with the City of Los Angeles for future 4th of July Events: Staff will reach out to the City of Los Angeles to determine July 20, 2026 Special & Regular CC Mtg Page 38 of 364
ATTACHMENT “A”
feasibility of request and return with additional information for the 2027 Independence Day Event.
o Consider replacing/merging El Grito with Menudo Festival using Area B Funds: One-time funding was appropriated in Fiscal Year 2025-2026 at $12,000 for the El Grito Event. If the City Council approves continuing as an ongoing event along with restructuring, Area B funds could be considered for use.
o Provide costs if Tree Lighting Event were combined with re-routed Parade and consider use of Area B Funds. Councilmember Lopez will also reach out to ask Emprende organization to provide a presentation to City Council regarding their role in organizing a Christmas Parade: A meeting was scheduled with Councilmember Lopez, Emprende organization, and staff on June 3, 2026 to discuss collaboration and cost. Based on the discussion, staff will present estimated cost on June 15, 2026 for consideration. The proposal will include Emprende serving as the parade organizer to include event planning, community outreach, participant recruitment, sponsorship development and promotional efforts. The City would support through street closures, traffic control, safety plan development, permitting and task force establishment for ongoing event logistics coordination.
o Provide information regarding Vendor Selection Process for Events: The Special Events Vendor Application (available digitally through web link) provides businesses and organizations the opportunity to showcase their products and services at various City‑hosted events throughout the year.

Vendors may apply to participate in a single event or multiple events using the same application. In cases where multiple vendors offering similar products or services apply, selections are made on a first‑come, first‑served basis, with a rotational schedule implemented to ensure equitable participation. Instances requiring this approach, however, have been limited. Moving forward, staff will post a call-for-vendor on social media to increase outreach.
o Provide information on the cost of combining Movies at the Park and Concerts at the Park into one event: The current cost for the Summer Concert Series is $29,812 and Movies at the Park is $12,853, for a combined total of $42,665 across the duration of both programs. While consolidating the events into a combined three-week format may appear to present cost-saving opportunities, projected expenses for staffing and event coordination would still total approximately $42,500, resulting in minimal overall savings. Both programs are distinct in nature, requiring different equipment, operational needs, and event setups, while also attracting different audiences and community interests. As a result, combining the events would provide limited financial benefit.

July 20, 2026 Special & Regular CC Mtg Page 39 of 364
ATTACHMENT “A”
• Provide a list of all programming activities, with complete costs including staff time, supplies, and attendance information, including Afterschool Program: A list is available digitally through web link.
• Status on locating permanent home for Liberty Bell: The Lopez Adobe House was evaluated as a potential site; however, Public Works staff expressed concerns regarding possible vandalism. Staff also assessed the City Hall lobby, which appears to be a viable alternative but would require further evaluation to determine appropriate mounting needs. Staff welcomes additional direction from the Council on any other locations and will present a proposal to Council at a later date.
• Cost Estimates for City Farmer’s Market: Per City Council authorization on May 4, 2026, staff released a request for proposals (RFP) on May 7, 2026 for a Farmers Market operator. The RFP encourages proposals with no-cost or revenue sharing models for operation. The deadline for submittal is July 9, 2026.

ADDITIONAL COMMENTS
• Contact the Los Angeles County Elections Division and United States Postal Service (USPS) regarding new changes in mail handling as it relates to ballot processing: The Los Angeles County Registrar recommends voters who want to return their ballot by United State Postal Services (USPS) mail should go into a Post Office to request a postmark of their ballot which will ensure it is counted on/before Election Day. Staff published social media posts on May 29 and June 1 reminding voters that ballots must be postmarked on or before June 2, encouraging those mailing their ballots to obtain a postmark inside a USPS facility to verify timely mailing and eligibility for inclusion in the official ballot count. • Consider cost and procedural impacts of San Fernando becoming a Charter City:

With City Council consensus and direction, staff will return with this additional information.
• Provide additional information regarding paying off future debt: The Fiscal Year 2026-2027 Proposed Budget includes a request for funding towards a long-range financial forecast. If the budget is adopted to include this enhancement, information regarding future debt pay-off will be incorporated.

Budget Study Session No. 3: A third Study Session No. 3 was held on June 8, 2026, in which the City Council received a presentation from the Public Works Department. Comments and follow-up actions discussed during the meeting are provided below. Responses to items are provided in blue.
• Request for staff to bring back information for a (1) city-hosted or co-sponsorship of the Welcome Home Veterans Day event and (2) city-hosted or co-sponsorship for a monthly Veterans meeting:

AGENDA REPORT
ADMINISTRATIVE SERVICES DEPARTMENT 117 MACNEIL STREET, SAN FERNANDO, CA 91340 (818) 898-1200 WWW.SANFERNANDO.GOV REVIEW: ☒ City Clerk ☒ Director of Admin. Services ☒ City Manager To: Mayor Victoria Garcia and Councilmembers
From: Kanika Kith, City Manager
By: Erica D. Melton, Director of Administrative Services

Date: July 20, 2026
Subject: Consideration to Adopt a Resolution Approving the Warrant Register RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. 26-072 (Attachment “A”) approving the Warrant Register.

BACKGROUND:

For each City Council meeting the Finance Division prepares a Warrant Register for City Council approval. The Register includes all recommended payments for the City. Checks, other than special checks, generally are not released until after the City Council approves the Register. The exceptions are for early releases to avoid penalties and interest, excessive delays and in all other circumstances favorable to the City to do so. Special checks are those payments required to be issued between Council meetings such as insurance premiums and tax deposits. Staff reviews requests for expenditures for budgetary approval and then prepares a Warrant Register for City Council approval and or ratification. Items such as payroll withholding tax deposits do not require budget approval.

The Director of Administrative Services/City Treasurer hereby certifies that all requests for expenditures have been signed by the department head, or designee, receiving the merchandise or services thereby stating that the items or services have been received and that the resulting expenditure is appropriate. The Director of Administrative Services/City Treasurer hereby certifies that each warrant has been reviewed for completeness and that sufficient funds are available for payment of the warrant register.

CITY MANAGER’S OFFICE 117 MACNEIL STREET, SAN FERNANDO, CA 91340 (818) 898-1202 WWW.SANFERNANDO.GOV REVIEW: ☒ City Clerk ☒ Director of Admin. Services ☒ City Manager To: Mayor Victoria Garcia and Councilmembers

Date: July 20, 2026
Subject: Consideration to Approve Release of a Request for Proposals for Solid Waste Management Collection Services
RECOMMENDATION:

It is recommended that the City Council approve the release of a Request for Proposals (RFP) for Solid Waste Management Collection Services (Attachment “A”) to solicit proposals from qualified firms to provide garbage, recyclable material, and organic waste collection services for the City.

BACKGROUND:

1. On December 2, 2013, the City Council approved a 10-year franchise agreement with Republic Services (Contract No. 1731) to provide solid waste collection services in the City of San Fernando. Services went into effect on February 15, 2014, with an initial termination date of February 14, 2024, that could be extended for three (3) separate one (1) year terms.

2. On August 15, 2022, the City Council approved an amendment to Contract No. 1731 executing Article 2.01.1 of Contract No. 1731 extending the term by three (3) years (through February 14, 2027).

3. On June 16, 2025, the City Council approved creating a Waste Hauler Services Ad Hoc committee to review information and develop recommendations to City Council related to the City’s Waste Hauler Services.

4. On August 25 and November 6, 2025, the Waste Hauler Services Ad Hoc met to evaluate options for the evaluation of current waste hauler services and the steps and timeline needed to complete an RFP for Solid Waste Management Consulting Services and a proceeding RFP for Solid Waste Management Services.

5. On January 5, 2026, the City Council approved a Request for Proposals for Solid Waste Management Consulting Services to evaluate the current franchise agreement, prepare and administer an RFP process for Solid Waste Management Collection Services, and support contract negotiations for the selected contractor.

6. On April 6, 2026, the City Council awarded Contract No. 2493 (Attachment “B”) to R3 Consulting Group (R3) to evaluate the current franchise agreement, prepare and administer the RFP process for Solid Waste Management Collection Services, and support contract negotiations for the selected contractor.

7. On May 19 and May 20, 2026, R3 held community meetings with San Fernando residents and businesses to gather input on community needs, concerns, and desired service priorities for the upcoming solid waste collection agreement. Business owners expressed a need for improved maintenance and billing in the downtown area and residents expressed a desire for improved customer service.

8. On June 26, 2026, the City Council approved an extension to the current franchise agreement with Republic Services (Attachment “C” – Contract No. 1731(c)) to expire on August 13, 2027.

The RFP is structured for new collection services to begin on August 14, 2027, following the conclusion of the current agreement.

ANALYSIS:

The City of San Fernando is a small, fully built-out urban community that provides municipal services to residential, multi-family, commercial, institutional, and municipal customers. Solid waste, recycling, and organics services are currently provided through an exclusive franchise agreement with Republic Services under City oversight.

The proposed RFP is intended to secure continued collection services before the current agreement expires and to provide a transparent process for evaluating qualified providers. The City’s objectives are to maintain reliable service at reasonable rates, ensure compliance with applicable State law, preserve continuity for residents and businesses, and establish updated contract terms that reflect current regulatory and operational best practices.

The RFP requests proposals for one (1) exclusive Collection Service Agreement for residential, multi-family, commercial, industrial/roll-off, and City collection services. The proposed agreement term is 10 years, with one (1) optional five-year extension at the City’s discretion.

The proposed RFP incorporates feedback received through Community Workshops, interviews with each City Councilmember, discussions with staff involved with solid waste management, and a community survey. A comprehensive overview of results from community engagement efforts by R3 can be found in Attachment “D”.

The proposed RFP includes the following key service and contract elements:
• Collection of garbage, recyclable materials, and organic waste for residential, multi-family, commercial, industrial/roll-off, and City service recipients.

• Continued bundled three-cart service for single-family residential customers, including recycling and organics service as part of the base service level. • Organic waste collection services in compliance with Senate Bill (SB) 1383 and other applicable State requirements.
• Customer service, billing, reporting, education, outreach, and technical assistance requirements, including bilingual education and outreach. • Additional community services such as bulky item collection, used oil and universal waste collection/drop-off (i.e. batteries, electronic waste, etc.), holiday tree collection/drop-off, City-sponsored event support, and other community drop-off or diversion-related services.
• Evaluation criteria that consider service rates and value, quality and reliability of service, customer service and outreach, and sustainability.

The RFP also reserves the City’s rights during the procurement process, including the right to reject any or all proposals, issue subsequent requests for proposals, postpone or modify the process, negotiate with one (1) or more providers, solicit best and final offers, accept other than the lowest proposed rates, and waive informalities or irregularities in proposals when in the City’s best interest.

The following is the anticipated RFP schedule. Dates are subject to change as needed by the City:

The proposed timeline provides the City with time to issue the RFP, receive questions, evaluate proposals, conduct interviews, negotiate with the preferred providers, and return to the City Council with an award recommendation before the anticipated August 14, 2027, service commencement date. This lead time is important to preserve service continuity and allow sufficient time for transition planning, customer outreach, container procurement or replacement, route planning, billing setup, and other implementation activities if a new contractor is selected.

Communications Protocol.

The City will commit to a procurement process for Solid Waste Management Collection Services that is open, objective, and carefully monitored. The following rules will be adhered to and enforced:

Until the City Council awards the Collection Service Agreement, all contact between proposers and the City, shall be in writing by email to R3’s established point of contact. Any proposer who fails to comply with the established communication process will be notified of its violation and may be subject to disqualification from the selection process at the sole discretion of the City.

Proposal Evaluation Process.

Proposals that have passed an initial “Pass/Fail” review by R3 will be evaluated and scored by an Evaluation Panel that will consist of City staff and qualified Solid waste experts from other local government agencies, as needed, based on the Evaluation Criteria listed in Attachment 3 of the RFP. The results of the evaluation will dictate which respective provider the City selects for negotiation of a final Collection Service Agreement. A negotiated final Collection Service Agreement will be presented to the City Council with a recommendation for the award of an Agreement.

The weight of each evaluation criteria was determined using feedback from the Community Survey, and interviews with City Council and the relevant City staff. The following scoring scale is proposed to be used for the panel evaluation:
• Service Rates & Value (25 points)
• Quality and Reliability of Service, and References (30 points) • Customer Service, Communication, & Outreach (30 points) • Sustainability (15 points)
Release of the RFP does not commit the City to award a contract, reimburse proposal preparation costs, or procure services. Any final Collection Service Agreement and associated service rates will return to the City Council for consideration and approval before award.

BUDGET IMPACT:

There is no direct budget impact associated with approving the release of the RFP for Solid Waste Management Collection Services. Costs associated with the future Collection Service Agreement, including proposed customer rates and contractor payments to the City, will be evaluated through the RFP process and presented to the City Council with the anticipated award recommendation.

CONCLUSION:

Staff recommends that the City Council approve the release of an RFP for Solid Waste Management Collection Services to solicit proposals from qualified firms to provide garbage, recyclable material, and organic waste collection services for the City of San Fernando.

SECTION 2.0: Instructions To Proposers / Rules Governing RFP

2.1 Procurement Goals
The City’s intent with this RFP is to continue to provide the community with the appropriate level of service, of the highest quality, and at the best Service Rates (Section 5, Form K). The specifications contained within this RFP are designed to establish an effective, efficient, environmentally clean, uniform, and safe system of solid waste collection. To this end, this RFP includes information to allow Proposers to properly prepare their responses and compute fair and reasonable compensation and rate Proposals. While the City has endeavored to be as accurate as possible, the City makes no guarantee of the accuracy of information included in this RFP. The City will not consider a financial review after award unless a material change of law occurs, as specifically defined in the forthcoming Draft Agreement. It is the sole responsibility of proposers to gather and attain any and all relevant information needed to provide complete, valid, and accurate proposals, including but not limited to rate proposals.

Proposers shall gather any relevant information without interrupting existing services being provided by the current service provider.

Except where this RFP provides new and/or enhanced services greater than are provided in the City today, the City further intends for all current solid waste services to continue without interruption, irrespective of whether those services are specifically identified in this RFP or in the forthcoming Draft Agreement. It is the sole responsibility of proposers to conduct their independent due diligence in identifying, understanding, and committing to providing all current solid waste services without interruption if awarded a contract.

Examination of the Request for Proposals
Proposers must carefully examine the entire RFP, any addenda thereto, and all related materials and data referenced herein or otherwise available to Proposer. Proposers shall be presumed to be familiar with all specifications and requirements of this RFP. The failure or omission to examine any form, instrument, or document shall in no way relieve Proposers from any obligation with respect to this Proposal.

Addenda
The City will issue written addenda to make changes, additions, or deletions to this solicitation.

Oral communications regarding this RFP will NOT be valid or binding, nor excuse prospective Proposers of any obligations hereunder, unless set forth in writing by the City. Addenda will be sent to all Prospective Proposersthat have attended the mandatory pre-proposal conference and completed Form A (the RFP Communications Protocol). It is the responsibility of each Proposer to ensure that they are a Prospective Proposer in order to receive all addenda.

2.2 General Guidelines
This RFP does not commit the City to award a contract, to defray any costs incurred in the preparation of a Proposal pursuant to this RFP, or to procure or contract for work. The City may reject any or all Proposal(s) without providing reason(s) underlying the declination. A failure to award a contract to the Proposer with the lowest cost Proposal shall not constitute a valid cause of action against the City. The City shall not be responsible for work done, even in good faith, prior to final approval of the proposed contract. The City may investigate the qualifications of any Proposer under consideration, require confirmation of information furnished by the Proposer, and require additional evidence or qualifications to perform the Services described herein.

The City reserves the right to:
• Reject any or all Proposals
• Issue subsequent Requests for Proposal
• Postpone opening for its own convenience
• Remedy technical errors in the Request for Proposal process • Negotiate with any, all, or none of the Proposers
• Solicit best and final offers from all or some of the Proposers • Accept other than the lowest proposed fees
• Waive informalities and irregularities in Proposals
Public Records
All Proposals submitted in response to this RFP become the property of the City and are subject to the California Public Records Act. By submitting a Proposal, Proposers acknowledge and accept that the contents of the Proposal and associated documents will be subject to public inspection and review.

Trade secrets may be marked as “confidential” only to the extent they meet the requirements of California Government Code Section 6254.7. If a Proposer submits an entire Proposal marked “confidential”, it will be considered non-responsive. Each Proposer should be aware that although the California Public Records Act recognizes that certain confidential trade secret information may be protected from disclosure, the City may not be able to establish that the information which a Proposer submits, is a trade secret. If a request is made for information marked “confidential”, the City will provide the Proposer who submitted such information with reasonable notice to allow the Proposer to independently seek protection from disclosure by a court of competent jurisdiction.

A Proposer may withdraw their Proposal before the expiration of the time for submission of Proposals by emailing [email protected] with a request for withdrawal signed by, or on behalf of, the Proposer. This request must be received by the City prior to the expiration of the time for submission of Proposals.

Proposers must keep their own copies of their submittals for future reference. If Proposer receives an award because of its Proposal submission, failure to have made such investigations and examinations will in no way relieve the Proposer from its obligation to comply in every detail with all provisions and requirements of the Forthcoming Draft Agreement, nor will ignorance of such conditions and requirements be accepted as a basis or justification for any claim whatsoever by the Proposer.

Modification of Proposals
Any Proposer who wishes to make modifications to a Proposal already received by the City before the Submittal Deadline must withdraw their Proposal to make the modifications. All modifications must be made via email, properly by the Proposer’s authorized representative, executed, and submitted in accordance with the terms and conditions of this solicitation. 2.4 Compliance with Collection Service Agreement
Successful Proposers will be required to enter into a Collection Service Agreement, as represented by the Forthcoming Draft Agreement. Proposers must carefully review the Draft Agreement. Any comments/exceptions to this contract must be included in your Proposal.

Precise substitute wording must be offered in place of any excepted language. It is not sufficient to state merely that an exception is noted to a particular paragraph. Deviations considered excessive by the City may reduce or eliminate a Proposer, and the City is under no obligation to agree to any exceptions whatsoever.

Proposed Service Rates must meet the terms and conditions of the Draft Agreement. Proposers must propose Service Rates that do not include any Exceptions to the Draft Agreement.

Commitments, Warranty, and Representations
The Proposal submitted in response to this RFP will be included as part of the final Collection Service Agreement. Proposers are cautioned that if a contract is awarded resulting from this procurement process, any written commitment by a Proposer within the scope of this procurement shall be binding upon Proposers, whether or not incorporated into a contract document. Failure of the Proposer to fulfill any such commitment shall render such Proposer liable for liquidated or other damages due the City under the terms of the Contract. For the purpose of this procurement, a commitment by a Proposer includes:
• Any modification of, or affirmation or representation as to the above, which is made by a Proposer in or during the course of negotiation.
• Any representation by a Proposer in a Proposal, supporting document, or negotiations subsequent thereto as to services to be performed, regardless of the fact that the duration of such commitment may exceed the duration of the contract.

2.5 Cashier’s Check
Proposers are required to submit one cashier’s check in the amount of twenty-five thousand dollars ($25,000) to guarantee Proposers’ obligation to negotiate in good faith and execute a Collection Service Agreement with the City of San Fernando at proposed Service Rates. If a Proposer fails, refuses, or neglects to furnish the required cashier’s check, the Proposer’s Proposal will be deemed non-responsive and will not be considered in the evaluation process.

The cashier’s check must be received by the City and marked with the words “PROPOSAL DEPOSIT” and the Proposal number no later than 72 hours after the Proposal due date and time for the Proposer to be considered responsive.

The address to which the cashier’s check can be sent or delivered is:

Upon receipt of the cashier’s check, the City will notify the submitting Proposer of receipt via email (provided that contact information for that Proposer has been provided) and immediately deposit the check. Upon City’s award of a contract, or the City’s closure of the RFP without a contract award, the City will issue reimbursement checks to all Proposers that did not violate this RFP’s requirements in terms of communication protocol (Form A) and obligation for good-faith negotiations.

2.6 Proposal Validation Pass/Fail Review
A panel of staff members from the City, as well as any other parties that the City deems necessary (Evaluation Panel), will conduct an initial “Pass/Fail” review of all Proposals submitted to check for completeness and compliance with the Proposal requirements. Proposals that have been determined to be complete and in compliance with the Proposal requirements will undergo further evaluation. The City’s waiver of an immaterial deviation or defect shall in no way modify the RFP documents or excuse Proposers from full compliance with the RFP requirements, if awarded a contract.

2.8 Proposal Evaluation
Those Proposals that have passed an initial “Pass/Fail” review described below will be evaluated and scored by the Evaluation Panel based on the Evaluation Criteria listed in Attachment 3. July 20, 2026 Special & Regular CC Mtg Page 144 of 364

Page 20 ends

The Evaluation Panel may contact and evaluate Proposer’s and subcontractors’ references; contact any Proposer to clarify any response; contact any current users of a Proposer’s services; solicit information from any available source concerning any aspect of a Proposal; and seek and review any other information deemed pertinent to the evaluation process. In determining and evaluating the best Proposal, the Service Rates will not necessarily be controlling; reliability and quality of Collection service, customer service, and sustainability will also be considered, along with any other relevant factors deemed relevant and appropriate by the Evaluation Panel. The following subsections provide a discussion of each of the Evaluation Criteria. The full and exact list of Evaluation Criteria can be found in Attachment 3.

Service Rates & Value (25 points)
The Service Rates category of the evaluation criteria is intended to provide an equitable basis for comparison between Proposals and an evaluation of the effect of programs on Service Rates.

Only Service Rate information as submitted by Proposers will be used in this evaluation. The Proposals will be reviewed to verify that the proposed Service Rates are consistent with the activities described in the Proposal as well as the Proposer’s Technical Plan and Collection Service Operations Plan, and, as part of the evaluation, the City may require Proposers to provide detailed assumptions made in developing their Service Rates. Proposed Service Rates, including Service Rates for optional services, will be compared by services. Note, however, that Service Rates for hauler-proposed alternatives, as provided for in Section 3.2, Proposal Section 6, will not be included as part of the Service Rates evaluation.

Please note the following:
• All Service Rates are intended to be bundled and charged based on Garbage container size, and inclusive of minimum levels of Recyclable Materials and Organic Waste. • Throughout the term of the Collection Service Agreement, the selected Proposer may not charge for any service not explicitly included in the final Service Rates. • Throughout the term of the Collection Service Agreement, the selected Proposer will not receive any revenue that is not based on approved services as allowable to bill using the schedule of Service Rates.
• Throughout the term of the Collection Service Agreement, the only adjustment to Service Rates will be as provided for via annual rate adjustments (methodology provided in the forthcoming Draft Agreement).

Quality and Reliability of Service, and References (30 points) The experience, past practices, and prior performance of each Proposer will be evaluated to determine the relative ability of each Proposer to implement the program elements described in this RFP and to attain the City’s objectives for Solid Waste Collection Services.

Qualifications and areas of experience to be considered will include, without limitation:
• Qualifications and structure of project management team, relationships between management team and corporate management, and internal controls.

• Experience in designing, implementing, and operating public education and information programs that promote high participation and diversion. • Demonstrated expertise in designing and using data management systems to assure accurate data collection, analysis, and reporting.
• An evaluation of financial statements.
• A financial review of each Proposer, including a review of key financial indicators, outstanding debt and debt coverage ratios, and ability to finance capital purchases and needed start-up investments in equipment.
• Proposer's capacity and plans for responding to fluctuations in the value of Recyclable Material markets.
• References whom the Cities may contact regarding past practices and prior performance. • Litigation history.

Customer Service, Communication, & Outreach (30 points) Each Proposal will be evaluated based on Proposer’s proven reliability and responsiveness to customers, including, but not limited to, excellent customer communications, follow-up, followthrough, and ability to listen to customer feedback, including customer needs and concerns regarding billing and services. Each Proposal will also be evaluated based on Proposer’s approach to providing effective and innovative bilingual outreach to customers to increase participation in diversion programs and reduce contamination of collected Organic Waste and Recyclable Materials. Within this category each Proposal will be evaluated based on Proposer’s proven ability to engage in proactive communications with public agency staff and partners.

Sustainability (15 points)
Each Proposal will be evaluated based Proposer’s proposed efforts and demonstrated ability to decrease waste, increase recovery of waste materials, and comply with SB 1383 via creative and/or innovative solutions, technological improvements, technical assistance, education and outreach, customer engagement, and continuous improvement. Criteria to be considered will include, without limitation:

July 20, 2026 Special & Regular CC Mtg Page 146 of 364

Page 22 ends

• Demonstrated ability to support City efforts to mitigate environmental and infrastructural impacts of solid waste collection, including, but not limited to, reducing vehicle miles travelled (VMT), air pollution (GHG), and damage to City roadways. • Proposed approach to facilitating the City’s implementation of its Climate Action and Resilience Plan (CARP), supporting the City’s Strategic Goals, supporting the City in adhering to L.A. County’s Zero Waste Plan, and advancing any other existing or future environmental initiatives.
• Approach to the use of alternative fuels in collection vehicle fleet, in a blend consistent with EPA and Department of Energy standards for alternative fuels, and approach to the implementation of California Air Resources Board’s (CARB’s) Advanced Clean Fleet (ACF) regulations.
• Internal sustainability programs (use of local vendors, innovative “green” approach to providing services, corporate sustainability, etc.).

Additional Information and Interviews
If, during the evaluation process, the City is unable to determine a Proposer's ability to perform, the City has the option of requesting any additional information which the City deems necessary to determine Proposer’s ability. Proposers will be notified and permitted five (5) working days to comply with any such request. Proposers may be invited to interview with the City. The City may also schedule site visits / facility tours with Proposers, at its discretion.

Proposal Evaluation and Selection Process
All Proposals shall be reviewed and evaluated by the Evaluation Panel to verify that the Proposer has met the minimum requirements. Proposals that have not complied with requirements, do not meet minimum content and quality standards, or include unacceptable deviations from the General Terms and Conditions of the Collection Service Agreement will be eliminated from further consideration.

The City reserves the right to reject any or all Proposals, rescind selection of any or all Proposers, or make no award. The City also reserves the right to require modifications and/or follow up with requests for additional information, including, but not limited to, follow‐up interviews. The City may request Best and Final Offers based upon improved understanding of the offers or changed scope of service. The City will negotiate with that Proposer to determine final Service Rates and contract form. Because this Proposal is negotiable, all Service Rate proposals will remain confidential until after an award is made, and there will be no public opening and reading of Proposals. At all times, the City will comply with the provisions of the California Public Records Act. Overall responsiveness to the RFP is an important factor in the evaluation process.

Pre-Award Negotiations
After the Proposals are opened, but prior to award, the City may elect to conduct negotiations with the highest ranked Proposer for purposes of:
• Resolving minor differences and information.

July 20, 2026 Special & Regular CC Mtg Page 147 of 364

Page 23 ends

• Clarifying necessary details and responsibilities.
• Emphasizing important issues and points.
• Receiving assurances from Proposers.
• Cost/budget clarifications.

If the City cannot successfully negotiate a contract with the highest ranked Proposer, the City may begin negotiations with the second highest-ranked Proposer. Selection may be made without further discussion, negotiations, or Proposer’s presentations; therefore, Proposer shall offer the most favorable terms in response to this RFP. The Proposer must demonstrate an understanding of the scope of service to be provided and the ability to accomplish the tasks set forth. Proposer should include information that will enable the City to determine the Proposer’s overall qualifications. The City reserves the right to request additional information or clarification on any matter included in the Proposal response, to enable the City to arrive at the final award decision.

2.9 Awards
Award will be made to the Proposer offering the most advantageous Proposal after consideration of all evaluation criteria set forth herein. The City Council of the City of San Fernando will have final authority over which Proposer is awarded a Collection Service Agreement. The City shall not be obligated to award a Collection Service Agreement to the Proposer with the lowest Service Rates, though the City doesrequest proposals that provide the lowest Service Rates to all sectors.

An award, if made, will be in the best interest of the City after all factors have been evaluated.

The City shall be the sole judges of the successful Proposals hereunder.

The City reserves the right to negotiate with any or all Proposers and to award a Collection Service Agreement to the Proposer that is not highest ranked. Proposers are advised that it is possible awards may be made without discussion or any contact concerning the Proposals received.

Accordingly, Proposals must contain the most favorable terms, from a service rate and technical standpoint, that the Proposer can submit to the City. Do not assume you will be contacted or afforded an opportunity to clarify, discuss, or revise your Proposal.

An award will be made by means of a written Collection Service Agreement with the successful Proposer. A Notification of Intent to Award may be sent to any Proposer selected. Award is contingent upon successful negotiation of final Collection Service Agreement terms and approval by the City Council. Negotiations shall be confidential and not subject to disclosure to competing Proposers unless an agreement is reached. If negotiations cannot be concluded successfully, the City may negotiate with other qualified Proposers. The successful Proposer will be required to provide the City with the following:
• Fully executed Collection Service Agreement for Garbage, Recyclable Materials, and Organic Waste.
• Performance Bond in the amount specified in the forthcoming Draft Agreement. • Insurance Required by Collection Service Agreement.
• W-9 Form.
