redevelopment. Refer to the attached Applicant Letter for a discussion of the requested additional nonresidential square footage.
Nonresidential Growth Management Ordinance
Adopted in 2013, the City’s Nonresidential Growth Management Program limits certain new nonresidential growth to a total of 1.35 million net new square feet until December 31, 2033. This floor area limitation is divided among three development categories:
Community Benefit Projects, Small Additions, and Vacant Property. The initial allocations by City Council were: 600,000 square feet for Community Benefit Projects; 400,000 square feet for Small Additions; and 350,000 square feet for Vacant Property. New nonresidential projects must be allocated floor area from one or more of the three categories and must also be consistent with the City’s Traffic Management Strategy as implemented by Santa Barbara Municipal Code (SBMC) Section 30.170.030. Community Benefit Projects include three subcategories: Community Priority Projects, Economic Development Projects, and New Vehicle Sales Projects. The applicant requests designation of the proposed project as a Community Benefit Project, under the Community Priority subcategory.
Community Benefit Project Designation
As stated above, the City Council already designated the project as a Community Benefit project on June 27, 2023, and January 23, 2024, allocating a total of 9,500 square feet.
The project qualified under the subcategory Community Priority Project, which is described as having a broad public benefit, not principally operated for private profit, and necessary to meet a present or projected need directly related to public health, safety, or general welfare (e.g., museums, childcare facilities, health clinics).
The additional 883 square feet of requested Community Benefit Project floor area for Providence School at 531 E. Ortega Street represents 0.14 percent of the original 600,000 square feet allocated to Community Benefit Projects in the Nonresidential Growth Management Program until 2033. As of April 14, 2025, City Council has allocated a total of 368,475 square feet from the Community Benefit Category to the 16 projects identified in the table below. Additionally, 142,668 square feet of expired Small Addition floor area has been reallocated to the Community Benefit category by the Planning Commission since 2013. To date (approximately halfway through the 20-year allocation period), more than 80 percent of the floor area remains available for Community Benefit Projects through 2033.

The proposed use is the same as when it was designated on June 27, 2023, and January 23, 2024; therefore, staff recommends that City Council designate the project as a Community Benefit Project and allocate the additional 883 square feet of nonresidential floor area from the Community Priority Project subcategory. The project is in the Downtown Development Area and is therefore eligible for an allocation of floor area from the Community Priority Project category pursuant to the City’s Traffic Management Strategy. The project is consistent with General Plan Policy LG7 Community Benefit NonResidential Land Uses, which includes educational institutions in the Community Priority Development category.
GENERAL PLAN (2011)

Providence School (531 E. Ortega Street) qualifies as a Community Priority Project and can be allocated 883 net square feet of additional nonresidential floor area from the Community Benefit category of the City’s Nonresidential Growth Management Program.
The proposed project is consistent with the City’s Traffic Management Strategy as implemented by SBMC Section 30.170.030, because it is in the Downtown Development Area, which allows allocations from the Community Priority Project category by Council.
BUDGET/FINANCIAL INFORMATION:
The requested designation would have no budgetary or financial impact.
ENVIRONMENTAL REVIEW:
The Community Benefit designation and allocation of floor area are not subject to environmental review pursuant to the California Environmental Quality Act.
Environmental review has been completed with Planning Commission’s approval of the project on March 14, 2024.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 29, 2025
TO: Mayor and Councilmembers
FROM: Airport Department
SUBJECT: Santa Barbara Airport Fixed Base Operator Redevelopment Update
RECOMMENDATION
That Council:
A. Receive a report on the Fixed Base Operator redevelopment process at the Santa Barbara Airport, including an update on the Request for Proposals timeline, associated challenges, and efforts to ensure a competitive and flexible selection process; and
B. Provide feedback to staff on Council’s preference for weighting the scoring criteria contained in the Request for Proposals, desired community benefits, and other input as needed.
DISCUSSION:
Background
The Airport Department is moving forward with the redevelopment of the Fixed Base Operator (FBO) facilities in alignment with the Airport Master Plan, with the goal of securing long-term leases for FBOs, on the northeast quadrant of the Airport. Each FBO will be required to make a significant capital investment, estimated to be between $60 million and $100 million per site. The Request for Proposals (RFP) is in its final stages, and the department is working diligently to finalize the document and ensure a fair, competitive process that allows for innovation while meeting the Airport’s minimum standards.
To ensure continuity of FBO services throughout the redevelopment process, the transition will be phased, beginning with the east site first, followed by the west site, which are currently both utilized by Signature Aviation, one of the current FBOs. This approach will ensure that general aviation users maintain access to essential FBO services while development progresses and will allow as many current tenants as possible to be accommodated through the transition.
Agenda Item No. 8
File Code No. 560.01
Council Agenda Report
Santa Barbara Airport Fixed Base Operator Redevelopment Update April 29, 2025
The City has received strong interest from both existing FBOs and at least five additional entities, with more likely to emerge once the RFP is officially published. Despite concerns that the RFP may be too restrictive, the process has been designed to provide maximum flexibility. The only mandatory requirements are those outlined in the City's minimum standards and policies, including the City’s sustainability guidelines. The proposed FBOs will have full discretion in shaping their operational models and facility plans, with additional offerings, such as amenities for based tenants or a restaurant, serving only to strengthen their proposals.
The Airport Department has taken a comprehensive approach to ensure the success of this redevelopment effort, including:
Phasing the selection and development of the FBO facilities, initially drafting a detailed RFP that outlines facility conditions, development requirements, and the City’s review process and timelines to ensure proposers fully understand the challenges of building at SBA.
Developing a draft lease to streamline negotiations and provide transparency on key terms.
Setting clear but minimal standards to qualify as a FBO, while leaving flexibility for proposers to differentiate themselves.
The City’s minimum RFP standards require that a FBO, at a minimum, provide retail fuel and oil sales, aircraft maintenance and repair, aviation line services, and aircraft storage.
Additionally, FBOs must provide a general aviation terminal of at least 5,000 square feet, a fuel farm with a minimum 40,000-gallon capacity, aircraft hangar storage, and adequate apron and parking areas. These standards ensure that SBA maintains a high level of service without dictating how proposers should structure their business operations.
The current proposed selection criteria include the following:
Financial Plan
Development Plan
Business Plan
Workforce Development and Community Engagement
Community Benefits
Miscellaneous
Staff is looking for Council direction on the weighting of these selection criteria as well as input on the types of Community Benefits the Council would like to see from the proposers in addition to any other feedback.
Challenges & Timeline Considerations:
One of the key challenges in this process is the misalignment of lease expiration dates:
The current FBO lease with Signature Flight Support expires on October 31, 2025, while the fuel farm lease remains in effect until March 13, 2027.
Council Agenda Report
Santa Barbara Airport Fixed Base Operator Redevelopment Update April 29, 2025
If Signature Flight Support were to be selected as the successful proposer, they will transition into the new lease immediately upon execution, seamlessly continuing operations.
If a new FBO operator is selected, the City intends to negotiate an early termination of the fuel farm lease to allow for a full transition.
If early termination is not feasible, Signature Flight Support will continue fuel operations under its existing lease until 2027, while the successful proposer focuses on planning, permitting, and facility development.
Next Steps:
The Airport Department is committed to keeping this process moving efficiently to avoid unnecessary delays. The RFP is expected to be published within the next few weeks.
Given the substantial capital investment required, the department is also requiring that proposers provide sufficient financial information to demonstrate their ability to support the long-term investment SBA requires.
This process represents a unique opportunity to enhance general aviation facilities at SBA while fostering competition and innovation among FBOs. Staff will continue refining the RFP and lease documents and will return to Council with any necessary updates as the selection process progresses.
BUDGET/FINANCIAL INFORMATION:
The financial impact of the FBO redevelopment process on the City’s budget is negligible, primarily limited to staff time and prior consultant work related to the RFP development.
However, the long-term benefits to the Airport’s financial health are significant. By securing long-term leases with well-qualified FBO operators committed to substantial capital investments, the Airport will enhance revenues through better use of available space, improved services, and increased economic activity. The redevelopment will also optimize lease terms to ensure fair market value for Airport property while fostering a more competitive and sustainable general aviation environment at SBA.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 29, 2025
TO: Mayor and Councilmembers
FROM: Community Development Department
SUBJECT: Access to Legal Counsel Pilot Program Evaluation RECOMMENDATION: That Council:
A. Receive an update on the Access to Legal Counsel Pilot Program; and B. Direct staff to either terminate the program as of July 31, 2025, or establish it as ongoing and authorize staff to solicit Requests for Proposals for a service provider to operate the program on an ongoing basis.
DISCUSSION:
On December 6, 2022, City Council set aside $250,000 from the Fiscal Year 2022 General Fund operating surplus to fund an Access to Legal Counsel Pilot Program, with the goal of providing legal services to tenant households at risk of eviction. On July 23, 2024, Council approved the establishment of an Access to Legal Counsel Pilot Program (pilot program) limited to serving Very Low-Income1 tenant households who live in the City of Santa Barbara. The intent of the pilot program was to ensure tenants have proper representation in litigation. Legal Aid Foundation of Santa Barbara County (Legal Aid2) has operated the pilot program to provide these services for the City since August 1, 2024. 1 Very Low-Income is defined as less than 50 percent of the area median income (AMI), adjusted by household size, of the city of Santa Barbara, or the smallest area including the city for which such figure is available, as determined by the U.S. Department of Housing and Urban Development (HUD) and amended from time to time.
2 Legal Aid is a local nonprofit civil law firm established in 1959 whose mission is to provide high-quality civil legal services to low-income and other vulnerable residents of Santa Barbara County to ensure equal access to justice. Their services include the provision of legal information and advice, assistance with preparation of legal documents, and representation in court proceedings.

Access to Legal Counsel Pilot Program Evaluation
April 29, 2025
Program Update
The pilot program began on August 1, 2024, with the goal of Legal Aid increasing its current capacity by providing legal advice or representation to a minimum of 80 incomequalified households at risk of eviction and living in the City of Santa Barbara.
By March 31, 2025, 50 households had initiated cases. Most fell into two categories: 17 cases were for unlawful detainers and 28 were for termination notices. Twenty cases have been closed with the following outcomes:
Advice provided (two)
Negotiated settlement without litigation (four)
Negotiated settlement with litigation (seven)
Uncontested court decision (two)
Contested court decision (two)
Limited action (three)
All cases fell within pilot program income guidelines, with two categories of income identified. There were 43 households in the 0–30 percent AMI (Extremely Low-Income) and seven households in the 31–50 percent AMI (Very Low-Income). Thirty-two percent of cases (16 of 50) required Spanish language assistance.

****Per federal regulations under Title 2 CFR 200.414, a de minimis rate of up to 15 percent is allowed for indirect costs.
Program Requirements
Legal Aid has submitted quarterly financial and program progress reports to the City as a condition of the funding. Income levels and certain demographics have been collected to assess program success according to specific populations as a condition of the funding (Attachment 1).
The agreement between the City and Legal Aid requires that if Council decides to discontinue the program after the first pilot year, the City must provide a minimum of 60 days’ notice to Legal Aid prior to the termination date (Attachment 2).
Conclusion
Staff requests Council’s direction on whether to continue or to terminate the program after the pilot year is completed on July 31, 2025. If Council directs staff to establish it as an ongoing program, staff will need Council’s authorization to release a Request for Proposals (RFP), a common City procedure for procuring a service provider. Legal Aid was selected for the pilot program; however, if the program becomes ongoing, a formal call for proposals should be issued. If Council directs staff to terminate the program, staff will issue a Notice of Termination to Legal Aid by no later than May 30, 2025, to adhere to the minimum 60 days’ notice requirement.
Council Agenda Report
Access to Legal Counsel Pilot Program Evaluation
April 29, 2025
BUDGET/FINANCIAL IMPACT:
If Council directs staff to establish the program as ongoing, a dedicated funding source needs to be identified. Any unspent funds from the pilot program could be reinvested; however, a long-term funding source is still required. As of March 31, 2025, a total of $102,811 (41 percent) of the $250,000 Council set aside for the pilot program has been used. If Council wishes to continue the program, staff recommends allocating General Fund funds, with a reduced amount of approximately $125,000, to more accurately reflect anticipated expenditures based on the pilot program. Should the City move forward with continuing the Access to Legal Counsel program, a more accurate estimate of ongoing funding needs will be available following completion of the RFP process.
