REPORT TO COUNCIL

SUBJECT
Action on Written Petition Regarding Street Tree Canopy Advocacy

COUNCIL PILLAR
Enhance Community Engagement and Transparency

BACKGROUND
Per Council Policy 030 - Adding an Item on the Agenda, any member of the public may submit a written request raising any issue or item within the subject matter jurisdiction of the Council. The written request will be submitted on the agenda, in the form substantially provided by the requestor, without any staff analysis, including fiscal, legal or policy review. If a simple majority of the City Council supports further study of the request, then a full staff analysis shall be prepared within thirty days, unless otherwise directed by the City Council.

The City Clerk’s Office received three Written Petitions (Attachment 1) submitted by Craig Larsen, Charlotte Bobek, and Terri Peters requesting to place an agenda item on a future Council meeting to discuss the following:

Santa Clara Tree Canopy Advocacy:

1. Tree Advocacy: protect existing tree canopy

2. 2020 Risk Mitigation Report

3. Tree Advocacy Proposal
The Written Petitions were discussed at the June 7, 2022 City Council meeting under Agenda Item 12 (RTC #22-776), and Council approved a motion to place the discussion of the Tree Canopy Advocacy on the agenda of a future meeting. In accordance with Council Policy 030 noted above, this item is now being brought forward for Council consideration and action.

DISCUSSION
The Department of Public Works (DPW) maintains approximately 12,000 street trees in front of residential properties and 3,000 trees within medians and at various City properties. Maintenance includes trimming, planting, and removal of City trees when necessary due to failure, decay, or repeated property damage. The City has always taken great pride in maintaining and preserving Santa Clara’s urban forest with the goal of educating the public, preserving existing assets, and planting new trees where needed. The City hosts an Annual Arbor Day/Earth Day Event where school children are educated on the importance of protecting our environment and the important part City of Santa Clara Printed on 8/24/2022Page 1 of 4

trees play in that effort. Over the years the City has been recognized for its robust tree program through the following awards:
· 2022 Tree City USA Recognition Award (35th consecutive year) · 2022 Tree City USA Growth Award (22nd time receiving award) The City has also implemented various efforts to help improve the tree program with a focus of enhancing maintenance, preserving existing trees and planting new ones. These efforts include:
· Modifying pruning programs in 2020 to implement grid pruning to assure trees were receiving regular trimming. The City is divided into distinct areas and each year all the trees in various planned areas are pruned and inspected. This process helps achieve the goal of pruning each City street tree at least once every seven to eight years. · Participating in the Santa Clara Valley Urban Forestry Alliance to support collaborative urban forestry
· Revising the City’s Tree Ordinance in November 2021 through a multi-departmental public effort, which implemented new measures to preserve private trees, plant new trees, establish tree replacement ratios, and require tree protection plans during construction of development projects.
· Planting 427 trees in FY 2021/22
2020 Risk Mitigation Assessment
During May and June of 2020, DPW responded to over 50 emergency tree calls involving Modesto Ash trees, which was substantially more than normal. These incidents included major limbs and or entire trees falling down with some incidents causing damage to cars, homes and property. The approximate age of most Modesto Ash trees in Santa Clara is between 60-70 years. The Modesto Ash is a large tree and is not an ideal street tree in Santa Clara because of its size and limited room for growth. The majority of these trees were planted in the 1950’s and 1960’s. However, the City discontinued this type of tree as a street tree option because of soil conditions, issues with irrigation and limited room for root growth. Over the years Modesto Ash trees have been removed due to failure, decay, and root rot and many of the existing trees are reaching the end of their life. Given the high volume of emergency calls related to Modesto Ash trees in the City during 2020, DPW sought assistance from outside tree professionals to evaluate the Modesto Ash trees and provide recommendations to minimize the potential risk to property and the public.

Plan-It Geo LLC (Plan-It) was hired through a competitive process to perform a ground-level tree risk assessment to inspect, evaluate and assign risk ratings to help staff prioritize maintenance needs for the Modesto Ash trees. Plan-It was selected based on their experience performing similar risk assessments, understanding of the data the City was seeking to collect, and cost. The assessment included performing a site visit to each Modesto Ash tree and analyzing it in accordance with International Society of Arboriculture (ISA) principles and best practices. The results of the assessment were documented, and recommendations were made based on the health of the tree.

The results indicated that the majority of the approximately 1200 Modesto Ash trees assessed were not in “good” condition based on the ISA evaluation standards. The results identified approximately:
· Only 3 percent of the trees were considered in “good” condition · 82 percent of the trees exhibited some measure of crown dieback · 92 percent of the trees were noted as having poor structure · 96 percent of the trees exhibited some level of cavity decay City of Santa Clara Printed on 8/24/2022Page 2 of 4
powered by Legistar™
22-839 Agenda Date: 8/30/2022
· 14 percent of the trees were identified for removal due to risk of failure · 20 percent of the trees were identified for further evaluation from up in the canopy · 63 percent of the trees required pruning (Some required further evaluation as well) On February 23, 2021 the Council approved amendments for the City’s tree service agreements to increase funding to move forward with the initial phases of the Modesto Ash risk mitigation measures.

Additional funding was approved as a Budget Amendment in the form of a new Capital Improvement Project through the FY 2021/22 & 2022/23 operating budget process to continue implementing the risk mitigation measures identified in the Plan-It assessment.

Additional Developments After Risk Mitigation Assessment In several instances, the tree contractor noticed significant defects in the canopy of trees that were designated for trimming and recommended removal due to risk of failure. DPW’s Arborist, who has a Tree Risk Assessment Certificate, was contacted to evaluate the trees in question. Some of the trees were able to be saved by removing isolated branches with cavities in connection to other branches or deadwood and reducing the canopy. However, some of the trees assigned for trimming were deemed to be unsafe and removed at the direction of the DPW Arborist after consulting with the homeowners.

Based on subsequent evaluations, there is the potential for more Modesto Ash trees to be removed over the next two-year period.

Outreach to the Public
DPW has performed extensive outreach to the public regarding Modesto Ash tree removals and to encourage homeowners to plant new trees in front of their homes. Prior to the scheduled (non- emergency) removal of any Modesto Ash tree, homeowners were sent a letter advising them that their tree would be removed and to contact DPW with questions. The trees were posted for removal seven days in advance to give the public the opportunity to call with questions. DPW also notified the community of Modesto Ash tree removals in the June 7, 2021 edition of City Hall News and the August 2021 Sustainability Newsletter.

In addition, DPW has promoted the City’s free tree planting services to the public. Information on requesting a new City tree is published on a dedicated webpage (SantaClaraCA.gov/Trees <https://www.santaclaraca.gov/our-city/departments-g-z/public-works/maintenance-operations/city- trees>). In May 2021, staff mailed 191 letters to property owners informing them of the benefits of trees and availability of free tree planting services in response to a request from a concerned resident. Articles promoting tree planting were published the August 2021 and April 2022 Sustainability Newsletters and the Fall 2021 edition of Inside Santa Clara.

REPORT TO COUNCIL

SUBJECT
Action on a Council Written Request (Council Policy 030) Submitted by Vice Mayor Jain Requesting to Place an Agenda Item at a Future Council Meeting to Discuss the Possibility of a Ballot Measure to Change the Chief of Police and City Clerk Position from Elected to Appointed

COUNCIL PILLAR
Enhance Community Engagement and Transparency

BACKGROUND
Council Policy 030 - Adding an Item on the Agenda (Attachment 1) sets forth the procedure for written petitions. Any member of the public or Council may submit a written request raising any issue or item within the subject matter jurisdiction of the Council. Per the policy, the written request will be submitted on the agenda, in the form substantially provided by the requestor, without any staff analysis, including fiscal review, legal review and policy review. If a simple majority of the City Council supports further study of the request, then a full staff analysis shall be prepared within thirty (30) days, unless otherwise directed by the City Council.

DISCUSSION
The City Clerk’s Office received a Council Written Request on June 24, 2022 requesting to place an agenda item at a future council meeting to Discuss the Possibility of a Ballot Measure to Change the Chief of Police and City Clerk positions from Elected to Appointed (Attachment 2).

In the request, Vice Mayor Jain states:

Santa Clara is the only city in the State of California with an elected Chief of Police.

Also is seems that only 28% of California cities have elected City Clerks which means 2.5 times as many cities have non-elected clerks than elected clerks.

State Law says that a person needs to be a resident of the City of Santa Clara in order to run for the office of Chief of Police. I imagine that when the provision was put in our Charter for an elected Chief of Police, most of the police officers lived in the City. Currently there are only 12 sworn officers (including the Chief) out of a force of 153 sworn who live in the City.

The ranks of officers currently living in the City are as follows:

Police Chief - 1
Police Captain - 1
Police Lieutenant - 2
Police Sergeant - 1
City of Santa Clara Printed on 8/24/2022Page 1 of 3
powered by Legistar™
22-858 Agenda Date: 8/30/2022
Police Officer - 7
This seems to me to be a very limited pool to draw from and, when considering management experience, the pool shrinks even further.

I believe that Santa Clara should be able to recruit from the best police forces in the Nation for our Police Chief just like all the other cities in California do.

The Santa Clara County Sherriff has had numerous complaints and yet she kept getting re-elected.

Eventually, the entire board of Supervisors voted unanimously that they had lost confidence in her and she is retiring. This shows that the power of incumbency and that name recognition can keep someone in office who probably should not be there. I explain this because the residents of Santa Clara often claim that having an elected Chief of Police makes them more accountable to the residents.

The current City Clerk position is part-time and this person handles only election related matters while the bulk of the traditional City Clerk duties (like meeting agendas and packets, meeting minutes, meeting voting, are handled by a professional Assistant City Clerk who is fulltime and is supported by a number of staff members. It makes little sense to me for the City Clerk to be someone who ran for office and is thus a political person who had to raise money and get endorsements. There are no requirements for experience or training before being elected to the position. There are also no requirements as to how many hours the City Clerk works, nor office hours held nor meeting attendance. There is essentially no accountability to anyone except to the voters every 4 years or via recall and I believe the bar for recall is extremely high. Clearly a super-majority of cities in California have chosen to make this position appointed/hired rather than elected and I believe for good reason.

I would like to have a discussion about the possibility of a ballot measure to change the Chief of Police and City Clerk positions from elected to appointed.

FISCAL IMPACT
There is no fiscal impact associated with considering the request to be placed on a future agenda except for staff time.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(b)(5) in that it is an administrative activity that will not result in direct or indirect physical changes to the environment.

PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City’s official-notice bulletin board outside City Hall Council Chambers. This seems to me to be a very limited pool to draw from and, when considering management experience, the pool shrinks even further.

I believe that Santa Clara should be able to recruit from the best police forces in the Nation for our Police Chief just like all the other cities in California do.

The Santa Clara County Sheriff has had numerous serious complaints against her and yet she kept getting re-elected. Eventually , the County Board of Supervisors voted unanimously that they had lost confidence in her and she is finally retiring. This shows that the power of incumbency and that name recognition can keep someone in office who probably should not be City of Santa Clara

REPORT TO COUNCIL

SUBJECT
Action on a Council Written Request (Council Policy 030) Submitted by Vice Mayor Jain Requesting to Place an Agenda Item at a Future Council Meeting to Discuss Changing the Parking Policy Since Providing Free Parking at the Convention Center is Very Expensive

DISCUSSION
The City Clerk’s Office received a Council Written Request on June 15, 2022 from Vice Mayor Jain requesting to place an agenda item at a future council meeting to discuss changing the parking policy since providing free parking is very expensive (Attachment 2).

In the request, Vice Mayor Jain states:

Recently the City Council approved an annual renewal of the Parking Maintenance District at the Convention Center. Parking is free but there are no accumulating reserves to make any major repairs to the parking structure which is aging.

I recently attended a Boy Scout breakfast event at the Santa Clara Marriott on Mission College Blvd.

They were charging $5/car parking.

I also recently visited the Baylands Park in Sunnyvale. They charge $6.00 per car.

Valley Fair Shopping Mall has also started charging for parking including for employees. Valley Fair just did a very large expansion which included adding a lot of parking in a parking structure which probably cost more than $50,000 per spot. Valley Fair is trying to get people to carpool and to use public transit or other forms of mobility.

When I brought up charging for parking at the convention center, I was told that the City has a policy against charging for parking. I’m asking for a discussion of changing this policy since providing free City of Santa Clara Printed on 8/24/2022Page 1 of 2

parking is very expensive as explained in Donald Shoup’s book: “The high cost of free parking”.

Perhaps charging for parking at the Convention Center could be used to put aside money for future repairs of the parking structure.

FISCAL IMPACT
There is no fiscal impact associated with considering the request to be placed on a future agenda except for staff time.

ENVIRONMENTAL REVIEW
The action being considered does not constitute a “project" within the meaning of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines section 15378(b)(5) in that it is a administrative activity that will not result in direct or indirect physical changes to the environment.

PUBLIC CONTACT
Public contact was made by posting the Council agenda on the City’s official-notice bulletin board outside City Hall Council Chambers. A complete agenda packet is available on the City’s website and in the City Clerk’s Office at least 72 hours prior to a Regular Meeting and 24 hours prior to a Special Meeting. A hard copy of any report to Council may be requested by contacting the City Clerk’s Office at (408) 615-2220, email [email protected] <mailto:[email protected]> or at the public information desk at any City of Santa Clara public library.

SUBJECT
Action on a Council Written Request (Council Policy 030) Submitted by Vice Mayor Jain Requesting to Place an Agenda Item at a Future Council Meeting to Discuss how to Change the Noticing Policy so as to Reach More People

COUNCIL PILLAR

DISCUSSION
The City Clerk’s Office received a Council Written Request on March 22, 2022 from Vice Mayor Jain requesting to place an agenda item at a future council meeting to discuss how to change the noticing policy so as to reach more people (Attachment 2).

In the request, Vice Mayor Jain states:

On March 22, 2022, the Patrick Henry Drive Specific Area plan was on the agenda for Council Action.

I was surprised that the noticing for the specific plan was only 500 feet considering that the project is so large. At an expected residential population in the development of 26, 760 for scenario A, that represents a 20% population increase for the entire city and certainly qualifies for the FPPC “public generally” exclusion for recusals. This project will affect a large number of residents beyond 500 feet.

From the Council Packet Resolution:

Whereas, notices of the public hearing on the proposed Specific Plan were mailed to all property owners within 500 feet of the Project Site, according to the most recent assessor’s roll, and to all local agencies expected to provide essential facilities or services to the project, on January 13, 2022 I am asking to put on the agenda a discussion of how to change the noticing policy so as to reach City of Santa Clara Printed on 8/24/2022Page 1 of 2

more people. It could be based on reaching a certain number of people or could have a different radius or notification based on the size of the project. This could be a study session or a staff proposal which Council can consider adopting.

I want to see the City Council place on a future agenda the issue of council person Karen Hardy and Raj Chahal attendance as a guest of 49ers at game on November 15, 2021 in violation of Santa Clara City Council gift policy, Santa Clara law that prohibits lobbyist, like the 49ers execs, from giving any gifts of any value to any Councilmember and violates a state law that requires them to declare any gift received. I also would like Hardy and Chapel reprimanded for these violations.

REPORT TO COUNCIL

SUBJECT
Action on a Written Petition (Council Policy 030), Submitted by Victor Ojakian Requesting to Place an Agenda Item on a Future Council Meeting for Council to Adopt a City Suicide Prevention Policy

COUNCIL PILLAR
Enhance Community Engagement and Transparency

BACKGROUND
Council Policy 030 - Adding an Item on the Agenda (Attachment 1) sets forth the procedure for written petitions. Any member of the public may submit a written request raising any issue or item within the subject matter jurisdiction of the Council.

DISCUSSION
The City Clerk’s Office received a Written Petition on July 11, 2022 from Victor Ojakian, requesting to place an agenda item on a future council meeting for Council to adopt a city suicide prevention policy (Attachment 2).

In the request Victor Ojakian states:

I am asking the Santa Clara City Council agenda and adopt a city suicide prevention policy. To date all other Santa Clara County cities have already adopted this policy, making it the norm, not an exception. A city suicide prevention policy should provide for city staff, but also community residence, needs. Often the City Manger’s administration, the community service personnel, and/or police personnel have involvement. For those unaware, suicide is the leading cause of death in the City of Santa Clara since 2018, dwarfing deaths by homicide and most other causes of death. Santa Clara County adopted a suicide prevention strategic plan (2010) and has a robust implementation program.

Several services/trainings are available with no fee charged. The crisis line number is 1-855-278- 4204 and the crisis text line is the prefix word “Renew” 741741.

AGENDA ITEMS TO BE SCHEDULED TO A FUTURE DATE

22-000 Response to Vice Mayor Jain’s Written Request to Discuss making the Youth Soccer Park Parking Lot available when there are no events at the Youth Soccer Park (soccer gets absolute priority) in order to Generate Revenue for the City approved to be agendized to a future meeting
22-184 Action on a Council Written Request (Council Policy 030) Submitted by Councilmember Jain Requesting to expand the scope of a previous council written request relating to the Youth Soccer Park Parking Lot (Council Policy 030) agenda item already approved to be agendized at future meeting for discussion with additional topics: 1) Under Measure-R, can the City contract out annually to the SCYSL to manage parking the parking lot as it sees fit and charge for parking when there is no soccer activity at YSP? The Parks and Rec department would retain control and could override any decision by the SCYSL. 2) It is my understanding that there have been games at the YSP but no practices this past year due to lack of City staff to schedule practices. I would like a discussion of how scheduling works at the YSP and Reed and Grant. Are only SCYSL events allowed at YSP? Under Measure R, could the SCYSL do its own scheduling, again with override authority (ultimate control) by Parks and Rec? 3) Can the City prioritize staffing a scheduler for YSL as Parks and Rec begins to hire more staff that was reduced under COVID so that we can start having practices at YSP? 4) If staffing for scheduling is short for YSP, can the City look at acquiring some facilities scheduling software to make the process more efficient? SCUSD uses Facilitron. Perhaps this software could be used to schedule all parks and rec facilities. It would be nice for the public to make scheduling requests online to Parks and Rec for meeting rooms, picnic areas, etc. and 5) Can we get a report of the staffing and budget needed to support soccer at YSL and Reed and Grant?

22-000 Action on a Written Petition (Council Policy 030), Submitted by Brian Doyle, to Place an Agenda Item at a Future Council Meeting to Discuss an Explanation by Councilmember Kevin Park of the Apparent Inconsistent Statements in Official Filings Regarding His Employment and Sources of Income – Return at a later date upon completion of litigation.
