STOCKTON CITY COUNCIL
RESOLUTION TO AUTHORIZE THE CITY OF STOCKTON’S MEMBERSHIP IN THE
EAST BAY COMMUNITY ENERGY AUTHORITY AND PARTICIPATION IN ITS
COMMUNITY CHOICE AGGREGATION PROGRAM
The City of Stockton has been actively investigating options to provide electricity supply services to constituents within the City with the intent of achieving greater local involvement over the provision of electric supply services, competitive electric rates, the development of local renewable energy projects, reduced greenhouse gas emissions and the wider implementation of energy conservation and efficiency projects and programs, and
Community Choice Aggregation (CCA) is a mechanism by which local governments assume responsibility for supplying electrical power for residential and commercial customers in their jurisdiction in partnership and competition with local commercial energy purveyors and owners of transmission facilities, which in the case of the City of Stockton is Pacific Gas & Electric Co., and CCA has the potential to reduce greenhouse gas emissions related to the use of power in the City of Stockton; provide electric power to customers at a competitive cost; carry out programs to reduce energy consumption; stimulate and sustain the local economy by developing local jobs in renewable energy; and through local control of electric generation resources, and
Staff has examined and identified CCA as a key strategy to meet local clean energy goals and projected greenhouse gas reduction targets, and City of Stockton has completed studies and taken additional proactive steps to determine a CCA program is feasible, and
Alameda County and cities in Alameda County have developed the East Bay Community Energy Authority Joint Powers Agreement (JPA) which creates the East Bay Community Energy Authority (EBCE) which governs and operates its CCA program, and EBCE is interested in providing potential services to the City of Stockton and made a presentation to City Council at its special meeting of November 9, 2021, and formally invited the City to pursue membership on May 12, 2022, and A standard JPA Agreement must be executed with EBCE to participate in the CCA program; now, therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF STOCKTON, AS FOLLOWS:
1. The recommendation in this report is not a project under the California Environmental Quality Act (CEQA) because it does not involve any commitment to a specific project which may result in a potentially significant physical impact on the environment, as contemplated by Title 14, California Code of Regulations, Sections 15378, therefore, not subject to CEQA pursuant to CEQA Guidelines section 15060.
2. The City Council of Stockton hereby approves the agreement titled “East Bay Community Energy Authority – Joint Powers Agreement” in order to participate with other signatories in a Community Choice Aggregation JPA for regional municipalities.
3. The City Manager is authorized to execute the agreement.
4. The City Manager is hereby authorized to take appropriate and necessary actions to carry out the purpose and intent of the Resolution.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF STOCKTON APPROVING THE EAST BAY
COMMUNITY ENERGY AUTHORITY JOINT POWERS AGREEMENTAND
AUTHORIZING IMPLEMENTATION OF ITS COMMUNITY CHOICE AGGREGATION
PROGRAM
WHEREAS, The City of Stockton has an interest in achieving greater local involvement over the provision of electricity supply services, competitive electric rates, the development of local renewable energy projects, reduced greenhouse gas emissions, and the wider implementation of energy conservation and efficiency projects and programs; and
WHEREAS, Assembly Bill 117 codified as Public Utilities Code Section 366.2 (the “Act”), authorizes any California city or county whose governing body so elects, to combine the electricity load of its residents and businesses in a community-wide electricity aggregation program known as Community Choice Aggregation (CCA”); and WHEREAS, The Act allows a CCA program to be carried out under a joint powers agreement entered into by entities that each have capacity to implement a CCA program individually. The joint powers agreement structure reduces the risks of implementing a CCA program by immunizing the financial assets of participants; and WHEREAS, The City of Stockton CCA feasibility study and evaluation showed that implementing a program was likely to provide multiple benefits to the residents, including the following:
1. Providing customers a choice of power providers;
2. Increasing local control over energy rates and other energy-related matters;
3. Providing electric rates that are competitive with those provided by the incumbent utility;
4. Reducing greenhouse gas emissions arising from electricity use;
5. Increasing local and regional renewable generation capacity;
6. Increasing energy conservation and efficiency projects and programs;
7. Encouraging local economic and employment benefits through energy conservation and efficiency projects.
WHEREAS, Representatives from Alameda County and Alameda County cities have developed the East Bay Community Energy Authority Joint Powers Agreement (“Joint Powers Agreement”), attached hereto as Exhibit A. The Joint Powers Agreement creates the East Bay Community Energy Authority (“Authority”) which will govern and operate the CCA program. The County and a majority of major Alameda County cities have elected to participate in the CCA program by executing the Joint Powers Agreement and adopting an ordinance electing to implement a CCA program, as required by Public Utilities Code Section 366.2(c)(12), and 1655
2 WHEREAS, The Authority has entered into agreements with electric power suppliers and other service providers and, based upon those agreements, the Authority has provided electrical power to residents and businesses at rates that are competitive with those of the incumbent utility. Upon the California Public Utilities Commission’s certification of the implementation plan prepared by the Authority, the Authority has provided service to customers within its member jurisdictions. Under Public Utilities Code Section 366.2, customers have the right to opt-out of a CCA program and continue to receive service from the incumbent utility. Customers who wish to continue to receive service from the incumbent utility will be able to request to do so at any time, and
WHEREAS, The Authority made a presentation to City Council at its November 9, 2021, meeting; showed interest in exploring potential services to the City of Stockton; and the City Council authorized staff to investigate participation in the CCA program with the Authority, and
WHEREAS, Concurrent with the introduction of this ordinance, the City Council considered a resolution that authorized the City Manager to execute the East Bay Community Energy Authority Joint Powers Agreement;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
STOCKTON, AS FOLLOWS:
SECTION 1. FINDINGS.
Based upon the findings set forth hereinabove, the City Council elects to participate in, and approves the implementation of a Community Choice Aggregation program within the City of Stockton’s jurisdiction by and through the East Bay Community Energy Authority.
SECTION 2. ENVIRONMENTAL.
The passage of this ordinance is not a project under the California Environmental Quality Act (CEQA) because it does not involve any commitment to a specific project which may result in a potentially significant physical impact on the environment, as contemplated by Title 14, California Code of Regulations, Sections 15378, therefore, not subject to CEQA pursuant to CEQA Guidelines Section 15060.

ADOPT AN ORDINANCE AMENDING THE STOCKTON MUNICIPAL CODE BY ADDING CHAPTER 8.94, RELATING TO THE FLYING OF UNMANNED AIRCRAFT SYSTEMS IN THE
PORT OF STOCKTON ZONING DISTRICT
RECOMMENDATION
It is recommended that the City Council:
1. Adopt an ordinance amending the Stockton Municipal Code by adding Chapter 8.94, relating to the flying of unmanned aircraft systems (UAS/drones) in the Port of Stockton (PT) zoning district.
2. Authorize the City Manager, or designee, to take all appropriate and necessary actions to carry out the purpose and intent of the ordinance.
Summary
The Federal Aviation Administration (FAA) regulates airspace, but not the location of launching/landing or where the operator is located during UAS operations. The FAA advises that local jurisdictions may enact legislation to regulate areas where the operation of UAS should be prohibited.
The Port of Stockton currently has a UAS Permit application process available for those wishing to operate a drone within the Port (PT) zoning district. However, without a Stockton Municipal Code (SMC) that prohibits drone activity in all the Port (PT) zoning district without prior approval, the permit process can only be enforced on those wishing to operate a drone from within the fenced Secure/Restricted Area of the Port.
The proposed addition to the SMC will prohibit the operation of any drone within the Port (PT) zoning district. The exceptions to this ordinance include search and rescue operations, fire protection, and law enforcement by any federal, state, or local public safety agency, and drones operated by (or with permission of) the Stockton Port District.
DISCUSSION
Background
Over the past several years, there has been drone activities causing safety issue concerns in the Port (PT) zoning district. Drones have been operating over vessel loading/off-loading operations posing a risk to staff and property if the drone crashes/lands on a vessel, transfer hose/conveyor, or loading station. The publicly accessible areas on the Port have been used as the main area for these landing and launchings. Most individuals stop when asked, but a few have challenged the Port and City of Stockton Page 1 of 2 Printed on 9/7/2022
powered by Legistar™
1664
File #: 22-0770, Version: 1
know that without an SMC, if the area is publicly accessible, the only condition is that the drone is properly registered.
In addition to safety, security has been a concern to the Port (PT) zoning district. Drone flights over vessel activity and other federally designated restricted areas are considered a breach of security by the Coast Guard and must be reported. The Port of Stockton has reported several security breaches by drones over the past year. An UAS crash incident in the summer of 2021, on the deck of a vessel resulted in a reportable breach to the Coast Guard. Though nobody was hurt in the incident, it did escalate to a joint investigation involving the FBI Task Force to ensure the drone activity wasn’t terrorist related.
Present Situation
The launching, landing, and operation of UAS in publicly accessible areas within the Port District are not currently regulated, causing safety and security issues. The Council Legislation Environmental Committee met on January 19, 2022, to review the request from the Port of Stockton presented by the Port of Stockton Police Chief Rick Salsedo.
The Port of Stockton is requesting an SMC section that would prohibit the launching, landing, and operation of UAS from Port District property unless approved by the Port District, due to safety and security reasons.
FINANCIAL SUMMARY
There is no financial impact to the City's General Fund or any other unrestricted fund by adopting the ordinance.

APPOINTMENT TO THE STOCKTON CIVIL SERVICE/EQUAL EMPLOYMENT COMMISSION
RECOMMENDATION
Adopt a resolution appointing one member to the Civil Service Commission/Equal Employment Commission for a term commencing immediately and ending December 31, 2025.
Summary
The Civil Service Commission currently has one vacancy. The first step towards filling the stated vacancy was to recruit and engage the public to complete an application and interview. The interviews were recorded and broadcasted on the City’s website so that they could be viewed through the archive by the members of the City Council before tonight’s meeting. The second step is the City Council appointment process, which is scheduled before you this evening.
DISCUSSION
Background
Pursuant to Stockton Charter Article XXV, Sections 2502 and 2503, the City Council appoints the five -member Civil Service Commission; each term is for three years. The function of the Stockton Civil Service Commission is as follows:
· To adopt, amend or repeal rules for the Civil Service System · To investigate either upon complaint or upon its own motion concerning any matter touching the administration of the Civil Service Commission
· To act in an advisory capacity to the City Manager on problems concerning personnel administration
· As provided by rule, to hear appeals of dismissals, demotions, or reductions submitted by any person in the competitive service. Prepare or cause to be prepared a written statement of facts, findings, and recommendations on every appeal. The effect of the Commission’s recommendation in case of discharge, demotion or reduction shall be final and binding upon all parties.
· To make an annual report and such other reports as it deems desirable to the City Council covering the administration of the personnel system.
The Office of the City Clerk initiated the recruitment to fill the vacancy, which opened on April 5, 2021 and accepted applications until interviews were conducted on May 31, 2022 and June 7, 2022.

Pursuant to Council Policy Chapter 3.02, City Council and Mayoral Appointments to Boards, Commissions, and Committees, the following two-step interview and appointment process is used to fill current vacancies on boards and commissions:
1. The City Clerk conducts the initial applicant interviews, which are recorded so that the Council can view from the archive; and,
2. The Council makes the appointment at a regularly scheduled Council meeting.
The City Clerk's Office interviewed the following applicants Virtu Arora
Nancy Muniz
Doug Vigil
All applicants were notified of tonight's meeting; however, their attendance is not mandatory.
Present Situation
Tonight, the City Council will proceed with the following method for appointment pursuant to Council Policy Chapter 3.02:
1. From the list so provided to the Council, each Councilmember, including the Mayor, will rank the applicants for each Commissioner such that the number of applicants that each Councilmember ranks will be one number greater than the number of vacancies and/or the number of Commission members whose terms will be expiring. (This will likely avoid tie votes.) For example, if there is only one vacancy or only one term expiring, the Councilmember’s first choice for appointment will be ranked with the number “2” and the Councilmember’s second choice with the number “1.” If because of a vacancy and/or because of an expiring term, there is more than one appointment to a Commission, the Councilmember will assign to the Councilmember’s first choice the higher(est) number and lesser number(s) to the Councilmember’s other choice(s). For example, if there were one vacancy and one term expiring, each Councilmember would rank three applicants, assigning the number “3” to the Councilmember’s first choice, the number “2” to the Councilmember’s second choice and the number “1” to the third choice.
2. After the Council has ranked the applicants, the City Clerk will tally the rankings and the applicant(s) receiving the highest number(s) would, subject to Council ratification, be appointed. If there is a tie, then the process described in A above will be repeated only as to the applicants who are tied.
The City Clerk will present the resolution upon appointment of the individuals selected to fill the vacancy effective immediately and ending on December 31, 2025.

ADOPT A RESOLUTION RENAMING BROOKVIEW COURT AS FMF DOC GNEM COURT
RECOMMENDATION
It is recommended that the City Council adopt a resolution:
1. Authorizing the City Manager to process a street name change to rename “Brookview Court” as “FMF DOC GNEM Court” with the next 30 days.
2. Authorizing the City Manager to take other actions which are necessary and appropriate to carry out the purpose and intent of this Resolution.
Summary
In July 2020, Stocktonian Christopher "Bobby" Gnem was killed in one of the deadliest military training accidents in recent years. The Mayor was approached by Gnem’s mother requesting that the City honor Gnem. Now, the Mayor asks Council to consider renaming Brookview Court (an uninhabited cul de sac next to Nelson park frequented by Mr. Gnem during his life) in honor of his sacrifice.
Renaming this street is appropriate under SMC 16.160.040(A) as the proposed street name complies with Stockton street naming standards and honors Mr. Gnem’s service in that it includes his abbreviated U.S. Navy title --Fleet Marine Forces (FMF), Hospital Corpsman (known as DOC).
Because the street is uninhabited, the name change requires only a certificate of correction in compliance with 16.192.050 (amendment to recorded maps).
DISCUSSION
Background
U.S. Navy Hospital Corpsman Christopher “Bobby” Gnem and eight Marines died during a training exercise aboard a U.S. Marine Amphibious Assault Vehicle that sank on July 30, 2020, in hundreds of feet of water off the Southern California coast. Gnem assisted in saving three people’s lives in the accident that ultimately ended in his death. In August 2020, Gnem, 22, was laid to rest with full military honors.
Gnem was raised in Stockton, attending Oakwood Elementary and August Knodt, then continued to Lincoln High School , where he graduated in 2016 and joined the Navy. He was an was known for having a positive attitude and powerful impact in our community.
Gnem frequented Nelson Park during his life and the street naming is intended to honor his sacrifice.

Gnem's mother approached the Mayor asking that the city consider honoring her son.
Present Situation
The street identified for renaming is currently named “Brookview Court.” At this time, the street does not yet have signage and is uninhabited (i.e., no residents or businesses are located on this street) as it is a cul de sac entrance into the park. It is proposed that the street be re-named as “FMF DOC GNEM Court”.
The proposed street name complies with Stockton street naming standards and includes his abbreviated U.S. Navy title --Fleet Marine Forces (FMF), Hospital Corpsman (known as DOC).
The name change may be carried out per SMC 16.160.040(A) using a certificate of correction in compliance with 16.192.050 (amendment to recorded maps) as the identified street is uninhabited.
FINANCIAL SUMMARY
There are no financial impacts to the general fund from this action.

CONDUCT A PUBLIC HEARING FOR THE FORMATION OF THE MIRACLE MILE COMMUNITY
IMPROVEMENT DISTRICT
RECOMMENDATION
It is recommended that the City Council conduct a Public Hearing to consider public comment and testimony regarding the approval and adoption for the formation of the Miracle Mile Community Improvement District (MMCID).
At the conclusion of the public input portion of the public hearing, it is recommended that the City Clerk tabulate all ballots received.
If after tabulation of the ballots, the ballots in favor of the MMCID formation exceed the opposition (weighted by the amount of the assessment), it is recommended that the City Council adopt a resolution to:
1. Approve the formation of the Miracle Mile Community Improvement District authorized under the City of Stockton’s Community Improvement District Ordinance 2022-03-12-211 (Attachment A - SMC Ordinance) and designated as the “Miracle Mile Community Improvement District No. 2022-01,” with separate benefit zones designated “Zone 1,” “Zone 2,” “Zone 3,” and “Zone 4,” the boundaries of which are shown in the Boundary Map (Exhibit 1 to the Resolution);
2. Approve the assessment formula and levying of the assessments;
3. Declare the assessment is lawfully authorized and direct the Clerk to cause the Boundary Map to be filed in the Office of the San Joaquin County Recorder and, concurrently therewith, to record a Notice of Assessment with respect to the properties in the Office of the County Recorder of the County of San Joaquin;
4. Approve and adopt the final Management District Plan and Engineer’s Report (Exhibit 2 to the Resolution); and
5. Authorize the City Manager to take necessary and appropriate actions to carry out the purpose and intent of the resolution.
Summary
A Community Improvement District (CID) is a flexible financing tool to allow Stockton business districts new mechanisms to establish innovative ways of attracting, retaining, and expanding their businesses to remain competitive with other areas of the region. The formation of a CID is authorized under the City of Stockton’s Community Improvement District Ordinance 2022-03-12-1211 City of Stockton Page 1 of 4 Printed on 9/7/2022

(Attachment A - SMC Ordinance #2022-03-22-1211). The levy of assessments on real property within the proposed district will support activities and improvements for the assessed properties, including enhanced security and maintenance, landscape beautification, advocacy services, marketing, events, and administration throughout the district. The Miracle Mile Improvement District Owner’s Association has requested that the City of Stockton consider the formation of the Miracle Mile Community Improvement District (MMCID) for a 20-year term, beginning January 1, 2023.
DISCUSSION
Background
On May 24, 2022, the City Council adopted Resolution No. 2022-05-24-1503, stating its intention to form the MMCID, accepting petitions of property owners, preliminarily approving the Management District Plan and Engineer’s Report, approving a proposed boundary map, setting a date for a public hearing of protests, providing for property owner ballots, and authorizing the City Manager to sign the ballot for all City-owned property which is proposed to be assessed in favor of the formation of the MMCID. Assessment ballots and the notice of public hearing were mailed to property owners within the district on June 9, 2022.
On July 12, 2022, the City Council adopted Resolution No. 2022-07-12-1204, rescinding the Resolution of Intention for formation of the MMCID adopted by City Council on May 24, 2022, due to a City mailing error. At the same July 12, 2022, meeting, the City Council adopted Resolution No. 2022-07-12-1203, a Resolution of Intention for the formation of the MMCID accepting petitions of property owners, preliminarily approving the Management District Plan and Engineer’s Report, approving a proposed boundary map, setting a date for a public hearing of protests, providing for property owner ballots, and authorizing the City Manager to sign the ballot for all City-owned property which is proposed to be assessed in favor of the formation of the MMCID. Assessment ballots and the notice of public hearing were mailed to property owners within the district on July 13, 2022, pursuant to the new Resolution of Intention.
A Community Improvement District (CID) is a catalyst for creating private-sector, self-governed management districts. These districts provide the resources for enhanced maintenance, safety, marketing, management, and advocacy services through property assessments. Property owners pay these assessments directly as part of their annual tax bill. Funds raised through a CID cannot be diverted to government programs. Currently, the Miracle Mile Property and Business Improvement District (MMPBID) is one of two existing Property and Business Improvement Districts within the City of Stockton.
The proposed formation of the MMCID will continue to operate similarly to the MMPBID. It will provide supplemental services to the Miracle Mile and Harding Way commercial corridors, including enhanced security and maintenance, landscape beautification, marketing, and events.
Present Situation
On September 13, 2022, a public hearing will be held in compliance with the requirements of Government Code Section 53753(d), which requires that the City Council conduct a public hearing for protests and tabulation of property owner’s assessment ballots prior to the formation of the MMCID. During the hearing, the City Council may hear testimony from property owners in support or City of Stockton Page 2 of 4 Printed on 9/7/2022

in protest of the district formation or components thereof.
After the close of the public input portion of the public hearing, ballots are tabulated, weighted by the amount each owner will pay. If a majority of the ballots received are in favor of the formation, then the City Council may adopt a resolution approving the formation of the MMCID, the boundary map, the assessment formula and levying of the assessments, the Management District Plan and Engineer’s Report.
MANAGEMENT DISTRICT PLAN
The Management District Plan (Exhibit 2 to the Resolution) includes the proposed boundary map of the MMCID, district improvement and activity plan, assessment methodology, district rules, regulations and governance, implementation timetable, assessment roll of properties included, and other provisions required by law. The MMCID comprises approximately 25 square blocks consisting of 155 parcels owned by 95 property owners, as identified in the Management District Plan (MDP).
The MMCID will provide services funded by the assessments to specifically benefit the properties within the district that are above and beyond those provided by the City and other government agencies, including:
· Support increased commerce
· Enhance business attraction and retention
· Retain and increase commercial property rentals
· Attract new residential developments
· Enhance safety and cleanliness in the district
· Improve District identity
· Fund specialized beautification and enhanced services for the property owners, businesses, visitors, and residents within the district
The MMCID’s MDP gives property owners flexibility in determining the type and frequency of special benefit services that the district will allocate yearly. As MMCID evolves, services needed one year may not be required the next. Therefore, “bundles” or categories of special benefit funding have been created and divided into four broad categories. Each bundle is allocated funding percentages with the flexibility to prioritize or minimize a service within each bundle. The following bundles of services and allocations are included in the MDP:
1. Civil Sidewalks (clean & safe) - 60%
2. District Identity and Placemaking - 15%
3. Administration/District Management - 22%
4. Contingency/Reserve - 3%
The proposed assessments are a sum of the building square footage, lot size, and linear frontage costs per parcel per benefit zone. The initial annual rate for each zone is shown in the table below.
Assessment rates may be subject to yearly increases not to exceed 5% per year and shall not exceed the actual increases in costs and services.

As provided by state law, the MMCID assessment will appear as a separate line item on the annual San Joaquin County property tax bill. The assessment will be implemented beginning January 1, 2023, and the district will have a 20-year term. The County will collect the assessments annually from each assessed property owner and forward them directly to the MMCID. The projected annual budget for operations in year one for the MMCID is $230,550, funded by property assessments.
FINANCIAL SUMMARY
The MDP requires local governmental agencies, including the City of Stockton, to pay assessments for special benefits conferred to their property within the boundaries of the MMCID, pursuant to Article XIIID of the State of California Constitution.
There are 11 City-owned properties along the MMCID. Total assessments for the calendar year 2023 are $21,639.84, paid from the Administrative Services Department General Fund, General Administration Division, Tax Collection Costs program account. This assessment will continue for a period of 20 years.
The Resolution of Intention adopted on July 12, 2022, authorized the City Manager to execute the property owner’s assessment ballot for all property owned by the City and proposed to be assessed in favor of the formation of the MMCID and the assessment.
