1. The proposed project includes improvements to six existing intersections within the City of West Sacramento.

Improvements would occur within existing right-of-way and would install flashing beacons and upgrade signal equipment to improve safety. The project does not require or propose any construction other than the boring up to six feet six inches in depth to enable installation of the new poles. No other ground disturbance is proposed or required. The proposed project does not include the construction of any structures. In addition, none of the improvement would hinder any future improvements as part of any future projects, nor would any other projects be required fulfil the purpose of the proposed project.

2. The proposed project was included in the West Sacramento Systemic Safety Analysis Report (WSSSAR) which was adopted by the City in 2018. The WSSSAR was developed after a thorough safety analysis that identified numerous pedestrian and safety improvements needed for intersections within the City. The proposed project focuses on increasing safe use of intersections for pedestrians and bicyclists and reducing conflicts with vehicles. This would help fulfil City goals to provide safe and efficient multimodal transportation alternative. Overall, the proposed project would make a substantial contribution to the safety these local roadways, which would be considered a benefit to residents. The project includes almost entirely above ground improvements, would create little disturbance, and as such, the proposed project would not generate public controversy.

3. The proposed project includes minor construction at 6 intersections. Improvements would occur to signalization, traffic control, vehicle detection, warning signs, other signage, pedestrian improvements, and new to enhance safety and access for pedestrians and vehicles. The proposed project does not meet the definition of a Type I project, as it would not reconfigure any roadways to accommodate the proposed improvements. The proposed project would not add any lanes, or increase truck or bus traffic. The proposed improvements also would not alter the existing vertical or horizontal alignment of any roadway would not encourage additional vehicle trips, or result in the generation of substantial new noise sources post construction.

4. The proposed project involves construction related activities needed to remove minimal amounts of hardscape and install footings for new poles, and other improvements related to signalizations, warning signs, crossing improvements, and vehicle detection systems. The proposed project is anticipated to require minimal saw cutting and minimal removals of hardscape and subsurface soils. Total removals are not anticipated to remove more than a few yards of material. The proposed project would not require pile driving or other construction techniques that would result in excessive construction-related noise. This location; however, is not located immediately adjacent to any sensitive uses. Construction and other improvements would not generate excessive noise during the construction period. Any noise generated would be temporary and short term in nature. All construction operations would be limited to the hours of 7:00 a.m. to 6:00 p.m. Monday through Friday and 8:00 a.m. to 5:00 p.m on weekends in accordance with City requirements. Approval from the City would be required for work before or after hours and construction noise would not make a substantial contribution to the existing noise environment. .

5. The proposed project is in a NAAQS non-attainment or maintenance area for ground level 1-hour and 8-hour Ozone (O3) and fine particulates (PM10) (Yolo County, 2020). The County is out of attainment for the state standard for 1- hour and 8 hour, unclassified for PM10, and out of conformance for the 24 hours PM2.5 (Yolo Air Pollution Control District, 2020). The proposed project would not change vehicular travel routes or roadway capacity, but would improve pedestrian and bicycle safety and enhance the multimodal transportation network.

6. The proposed project is considered exempt from the requirement of conformity, as it falls under the “bicycle and pedestrian facilities projects” category shown in 40 CFR 93.126 Table 2.

9. The proposed project includes 6 locations that would be improved with new flashing beacons and upgraded signal equipment. Improvements are intended to reduce vehicle and pedestrian and bicycle conflicts and increase driver awareness. The proposed project would include installation of new signal masts. As such, the risk of upset of unknown hazardous materials is remote due to the discrete areas in which excavation would be required. It is anticipated that in sum only a few yards of materials would be removed. In addition, the California Waterboards Geotracker Website and Department of Toxic Substances Control (DTSC) were used to determine if any listed hazardous materials sites occur within or immediately adjacent to an proposed for improvements. Each location of project improvements was evaluated, and the findings are listed below. None of the listing in areas on properties close to the proposed improvements represent a condition that would impact project implementation, increase the risk of upset, or be exacerbated by project implementation.

1. 847 West Harbor Boulevard – ARCO #5786 Case #2–This site is listed as a leaking underground storage tank (LUST) cleanup site. The case was opened after an unauthorized release of gasoline from an underground storage tank. The case was closed as of April 4, 2014. There are a series of six monitoring wells in the vicinity. No listing appears on Envirostor. No violations are listed.

2. 847 West Harbor Boulevard – ARCO #5786 This case was reported in March 26 of 1992 and was gasoline from a LUST. The leak was stopped and the case was closed on July 21, 1993. –No listing appears on Envirostor. No violations are listed.

3. 847 West Harbor Boulevard P&D Properties LLC. Permitted underground storage tank (UST).

4. 1001 Sacramento Avenue, Former Tesoro 67055/Former Beacon #3694 – LUST Cleanup site. The case was opened after an unauthorized release of gasoline from an underground storage tank. The case was closed as of March 6, 1985. The leak was stopped, remediation was completed, and the case was closed with a no further action letter November 1, 2013. There are a series of 15 monitoring wells in the vicinity.

The project intersections at Harbor Boulevard and Reed Avenue, Harbor Boulevard and Riverpoint Court, Harbor Boulevard and Duluth Street, and Jefferson Boulevard and Michigan Boulevard were not reported in proximity to any known hazardous materials sites according to the California Waterboards Geotracker website of the Department of Toxic Substances Control (DTSC) Envirostor website.

Improvements at the intersections of Jefferson Boulevard and Sacramento Avenue would consist of only one installation, a new post, that would require subsurface work resulting in the risk of upset. Due to the discrete location, then fact the work would require minimal excavation to install a new pole, the risk of encountering any subsurface contamination at this site is remote. No further evaluation would be required.

10. The proposed project would occur entirely within existing roadway right of way and is not located within or adjacent to any water resources rivers, streams, bays, inlets, lakes, or drainage sloughs, vernal pools, or any other water resource. The proposed project does not include the removal or discharge of any fill to any water.

11. The proposed project is located in the City of West Sacramento in Yolo County and is not in the vicinity of a solesource aquifer. According to the United States Environmental Protection Agency (EPA), the nearest sole source aquifer is the Santa Margarita in Scotts Valley aquifer approximately 107 miles to the southwest (EPA, 2020).

12. The proposed project is not in a Coastal Zone. The nearest coastal zone is located approximately 78 miles to the east.

13. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps (FIRM) Panel Number 0607280005B, (effective 01/19/1995) (FEMA, 1995), the 6 intersection that would be improved by the proposed project improvements are located in an area with no digital data available. The City is located adjacent to the Sacramento River and flood protection is provided by a series of levees. The West Sacramento General Plan (WSGP) does identify that the City is within a 200-year floodplain. The City website notes that most of West Sacramento is currently designated Flood Zone X, which means there is not a statutory requirement for flood insurance. New construction and expansion of existing structures are allowed in Flood Zone X without being subject to elevation and flood-proofing requirements. FEMA is currently evaluating the existing designation and it is possible they will change the designation to a Special Flood Hazard Area (City of West Sacramento, 2020).

The proposed project would not interfere with any improvements or affect flood flows or floodplain designations.

The proposed project includes improvements to existing signals, signage, pedestrian crossings, replacement o PPB with APS systems, EVP detection masts, cameras, radar, and other above ground traffic controls. The project does not propose to place any new structures, habitable or otherwise within any of the project areas. The proposed project would not induce growth to a flood zone. The proposed project also would not encroach into any existing regulatory floodway, and would not affect existing drainage patterns.

14. The City of West Sacramento is on the western bank of the Sacramento River. A portion of the American River that flows into the Sacramento River from its eastern side is mapped as a wild and scenic river. The confluence is approximately 0.12 miles from the City of West Sacramento and greater than 0.25 miles from any of the proposed improvements. None of the proposed improvements are in, across, or adjacent to the river, and none of the improvements would be visible from the American River or obstruct views of the American River.

15. The proposed improvements would be located within existing right-of-way of the 6 intersections and would not encroach on any undeveloped land or previously undisturbed area. The proposed project would not directly impact any native habitat or critical habitat that would be used by a federally listed threatened or threatened or endangered species. The area surrounding the proposed improvements is highly urbanized with commercial, industrial, and residential uses. The proposed project site would occur entirely in paved areas and would not disturb any aquatic resources or fish habitat. The project sites do not provide habitat linkages and the project area does not provide logical connectivity to any off-site undisturbed habitat areas. Special status species that were determined to have the potential to occur in the vicinity of the project site and that could be affected was prepared by the United States Department of the Interior – Fish and Wildlife Service (USFWS) based on an Information for Planning and Consultation (IPac) website. These species include least Bell’s Vireo (Vireo Bellii pusillus), Giant Garter snake (Thamnophis gigas), California Red-legged Frog (Rana draytonii), Calfironia Tiger Salamander (Ambystoma californiense), Delta Smelt (hypomesus tranpacificus), Valley Elderberry Longhorn Bettle (Democerus californincus dimophus), Vernal pool Fairy shrimp (Banchinecta lyunchi), and Vernal Pool Tadpole Schrimp (Lepidurs packardi). The project area also is shown in critical habitat for the Delta Smelt (Hypomesus transpacificus). As discussed above, the proposed project would occur entirely within existing right-of-way, adjacent sidewalks, and areas with hardscape. The project site does not have any areas that would provide habitat for any of the listed species.

16. As discussed in sub 15), above the project site occurs in a highly urbanized and disturbed environment and would not remove any native vegetative habitats or species. Some of the project areas are located adjacent undeveloped areas with non-native landscaping, including trees, and upland ruderal vegetation. The proposed project would not require the remove any trees, and the proposed project is unlikely to affect any migratory or nesting birds. None-theless, prior to project implementation if construction occurs during the nesting season, as a part of the standard permitting conditions, a nesting bird survey by a qualified biologist would be conducted for sites with adjacent trees or other nesting habitat. If required, and as part of the proposed project, conditions of project approval would be included that would minimize disturbance to nesting species.

17. As discussed in sub 15) and 16) above, the project site is highly urbanized, and improvements would occur within existing paved right-of-way and in previously disturbed areas and areas with paved hardscape or bare dirt. The project site does not contain any streams, wetlands or any other waters. The National Wetlands Inventory (NWI) surface water and wetlands mapping tool, identifies one water within an undeveloped field north of the Jefferson Boulevard and Sacramento Avenue intersection (USFWS, 2020). This area is outside the project footprint. The only project component adjacent to this area would be a solar powered flashing beacon assembly that is proposed to be installed outside of but within approximately 10 feet of the concrete culvert through which the water flows. Neither this improvement or any other improvements would affect the water within this culvert or any other water of the US.

18. The proposed project would occur in a completely urbanized environment and there is no agricultural land within, adjacent to, or surrounding any of the improvement sites. The California Department of Conservation (CDOC) Important Farmland Finder shows that all project areas would occur in Urban and Built Up Land (CDOC, 2018). No agricultural wetlands would be disturbed.

19. Construction equipment needed for the proposed project would be minimal because the project does not include any grading or construction of any buildings. The project site consists of paved hardscape in existing right-of-way. Areas proposed for improvements would not require access through or use any undeveloped areas containing non-native weedy species. All construction equipment would be washed prior to reaching and entering any area of the construction areas. In addition, project equipment would have limited contact with any undeveloped areas and the potential for the proposed project to result in the spread of non-native noxious weeds is very low.

20. The proposed project site is within a highly urbanized areas and within the existing right-of-way. The areas surrounding the proposed improvement areas are largely characterized by industrial, commercial, and residential sites. None of the sites are located adjacent to an existing public park. All project improvements would occur in previously disturbed and paved areas and the proposed project would not negatively impacts any publicly owned parks, recreation areas, wildlife or waterfowl refuges.

21. The proposed project would not occur in an area using National Park Service (NPS) Land and Water Conservation Funds (LWCF). The proposed project is not shown on the most current LWCF map provided by the LWCF coalition website. (LWCF, 2020).

22. The proposed project is within existing roadway rights-of-way and areas that have been heavily disturbed and are characterized by hardscape. The project areas have existing traffic signals, pedestrian signals, signage, or traffic monitoring devices. These existing lights and devices would be upgraded to improve crossing safety for pedestrians and bicyclists and to reduce the potential for vehicle conflicts. The proposed project does not include removals of existing vegetation, and does not include the installation of any elevated structures that could obstruct viewsheds or block site lines. The existing topography of the project areas is flat and there would be no changes to any significant landforms, existing structures, nor does the proposed project include obtrusive signage or lighting that is inconsistent with what exists or the urban environment. The proposed project scored a 7 using the Visual Impact Assessment Questionnaire (refer to Appendix E) (Caltrans, 2020b). Visual changes would be minimal and would not change substantially change the existing urbanized landscape.

23. The proposed project is located entirely within existing disturbed and paved right-of-way. The proposed project would not require the take or relocation of any structures, businesses, or homes.

24. The proposed project would occur within the existing travel lanes and sidewalks of project related roadways and intersections. The proposed project would not require any takes, full or partial, of any non-public right-of-way.

25. The proposed project would be consistent with the WSSSAR. The WSSSAR identified a list of traffic safety projects to implement to increase safety based on a benefit-cost ratio. The document identified projects that would improve safety of vehicles, bicyclists and pedestrians on local facilities throughout the City. The proposed project also is consistent with the City of West Sacramento General Plan (WSGP). The WSGP discusses the multimodal transportation system to include connectivity, safety, and integration, for vehicles, pedestrian, bicycles, and connections to residential, commercial, employment, and transportation centers (West Sacramento, 2035).

26. The proposed project includes the construction of flashing beacons, upgraded signal equipment, and other improvements that would improve the multi-modal transportation network in 6 locations. The proposed project is intended to, and would increase pedestrian and cyclist safety by installing safety equipment, signals, and signage to reduce conflicts with vehicles. The proposed project would not impair the economic vitality of any businesses or reduce accessibility to community resources such as parks, shopping areas, or emergency services. The proposed project is in a highly urbanized areas, would occur within existing right-of-way and therefore, and would not result in the physical division of any neighborhoods or communities. The proposed project would enhance connection between neighborhoods and communities, commercial areas, recreational areas through the installation of the improvements.

27. The proposed project would provide improved pedestrian and cyclist road crossing through the installation of new signalization, pedestrian notifications and signage, and vehicle detection systems/devices. The proposed project would not require the relocation of any residences or businesses or require the closing of any businesses. Overall, the proposed project is considered to be a beneficial use, would be consistent with existing applicable planning documents and would not disproportionately affect low-income and/or minority populations.

28. The proposed project would require installation of new pole would require removal of overlying hardscape and excavation to a maximum depth of 6’6” to install the footings for these improvements. Due to the extremely limited earthwork needed, no utility adjustments or relocations including electrical, water, natural gas, telephone, storm drain, and sanitary sewer would be required.

29. The proposed project includes the improvements at 6 intersections and roadway locations within the City. As discussed above, the proposed project would improve pedestrian safety and visibility for drivers. All improvements would occur within existing roadways and adjacent right-of way. Improvements would occur within roadways serving adjacent residential, commercial, and industrial uses. The proposed project would not substantially interfere with access to or deny operation or use of any of these areas.

30. The locations of the 6 proposed improvements do not occur in proximity to any state highway system and would not affect the operation of any on- or off-ramps to the state highway system. The project would not affect any other connection point, or interfere within any mainline freeway lanes.

31. The proposed project would be implemented so that no road closures are required. The proposed project may require temporary closure of a single lane(s), but access to through traffic at all on of the project sites would be maintained.

As such no detours would be required. Lastly, the proposed project does not occur in proximity to the state highway system and no ramp closures would be required.

32. The proposed project would occur within the existing right-of-way of existing streets and intersections. There is no parking at the location of the improvements and no parking would be lost.

33. The proposed project is located within existing disturbed and paved areas, within existing City right-of-way. The proposed project would not occur on any state or federal land.

34. The proposed project is in an urbanized area and almost entirely within existing paved right-of-way. There is no farmland within or adjacent to the project site. The California Department of Conservation (CDOC)-California Important Farmland Finder does not identify any Prime Farmland, Farmland of Statewide Importance, or Unique Farmland within or adjacent to the proposed project. The proposed project is in an areas shown as Urban and Built up land. The proposed project would not convert any farmland (CDOC, 2018).

35. A Cultural Resources Study will be undertaken by professionally qualified staff (PQS) in order to satisfy the requirements of Section 106 Programmatic Agreement.

36. The proposed project is located within existing disturbed and paved areas, within existing right-of-way. The proposed project is not within or adjacent to Tribal Land.

A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). Recommended contents of a Biological Assessment are described at 50 CFR 402.12.

If a Federal agency determines, based on the Biological Assessment or biological evaluation, that listed species and/or designated critical habitat may be affected by the proposed project, the agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service recommends that candidate species, proposed species and proposed critical habitat be addressed within the consultation.
