OBJECTIVE
The objective of this report is to provide the Council with information necessary to conduct a public hearing to receive comments and consider adopting Resolution 25-15 which authorizes the application for the Permanent Local Housing Allocation (PLHA) Program and adopts the related Five-Year Plan.

RECOMMENDED ACTION
Staff respectfully recommends that the City Council:
1) Conduct a public hearing;
2) Find that the PLHA Program and Five-Year Plan is exempt from California Environmental Quality Act (CEQA) review pursuant to §15060(c) and 15378(a) (Not a Project) of the CEQA Guidelines; 3) Adopt Resolution 25-15 (Attachment 1) which authorizes the application for the PLHA Program and adopts the related Five-Year Plan (Attachment 2); and
4) Authorize the City Manager, or his designee, to execute and deliver the application and related documents and, if funded, execute a Standard Agreement, all amendments thereto, and any other related documents.

BACKGROUND
In September 2017, the California Legislature approved Senate Bill 2 (SB 2), known as the Building Homes and Jobs Act (Act), which established a $75 recording fee on real estate documents to increase the supply of affordable housing. The Act established the Permanent Local Housing Allocation (PLHA) Program administered by the State Department of Housing and Community Development (HCD). The PLHA Program provides a permanent source of funding to counties and cities to help meet the unmet need for affordable housing and increase the supply of affordable housing units.

Under the PLHA Program, local governments that are entitlement cities and receive Community Development Block Grant (CDBG) funding are eligible for this grant funding. As an entitlement City, West Sacramento’s PLHA funding allocation is based upon the federal formula used to allocate CDBG funding. Eligible PLHA activities include, but are not limited to, the following:

1. Acquisition and development costs for affordable, multi-family rental housing;

2. Acquisition and development costs for affordable rental and ownership housing, including accessory dwelling units;

3. Preservation and creation of permanent supportive housing;

4. Assisting persons experiencing or at risk of homelessness, including rapid re-housing, rental assistance, operating and capital costs for emergency shelters, and creation and preservation of permanent and transitional housing;

ANALYSIS
In October 2024, HCD released a Notice of Funding Availability (NOFA) for the PLHA Program that covers funding for the remaining three calendar years in the current five-year period covering 2019-2023. Funding for each Calendar Year (CY) is as follows: CY 2021 ($404,832), CY 2022 ($202,903) and CY 2023 ($155,518).

Applications to HCD for these funds are due by February 28, 2025. Based on other funding sources and housing activities prioritized by Council in 2019 and 2020, the City did not apply for CY 2019 and CY 2020 funding that was made available under a separate NOFA.

On January 24, 2025, staff released for public review a draft Five-Year Plan for the PLHA Program funds. Staff is recommending that available funds be allocated as follows:

Proposed Grant Fund Allocations* CY 2019** CY 2020** CY 2021 CY 2022 CY 2023 (1) Multifamily Rental Housing N/A N/A 55% 55% 55%
(2) Homeownership Opportunities -
Accessibility Modifications Owner
Occupied
N/A N/A 40%* 40%* 40%*
Program
Administration N/A N/A 5% 5% 5%
* The NOFA requires that 40% of each CY allocation be used for homeownership opportunities. ** City did not apply for funding in CY 2019 or CY 2020.

Multifamily Rental Housing
The first proposed activity will support the affordable housing component of the Grand Gateway Master Plan. A proposal solicitation for the Grand Gateway Master Plan area, which is located at the intersection of Grand Street and Tower Bridge Gateway, was conducted in Summer 2023 and an Exclusive Negotiation Agreement with SKK Developments and Urban Core was approved by Council on June 26, 2024. It is anticipated that City funds will be necessary to support the development of a ± 114-unit affordable housing project included as part of the Grand Gateway development. The PLHA funds will also help leverage additional funding needed for the affordable housing component. This activity will support Housing Element Program HE-PR-1.9: Cooperation with Affordable Housing Providers.

Homeownership Opportunities - Accessibility Modifications Owner-Occupied The second proposed activity will support accessibility improvements/modifications to lower-income owneroccupied residents. Specifically, staff proposes to provide grants of up to $30,000 to qualified low-income owneroccupied residents. Staff will assess expanding existing contracts with nonprofit entities currently providing home repairs to West Sacramento owner-occupants for this activity; however, in the event this is not feasible, staff will procure the services of a nonprofit organization for implementation. This activity will support Housing Element Program HE-PR-2.1.1: Housing Rehabilitation (Single Family).

Lastly, staff is recommending a 5% allocation of each CY funding for program administration, which is the maximum allowed by the PLHA Program.

Environmental Considerations
This action is not a project subject to CEQA because it is not an activity that may cause either a direct or reasonably foreseeable indirect physical change in the environment. (Pub. Resources Code, § 21065; CEQA Guidelines §§ 15060(c), 15378(a).) A Notice of Exemption is included as Attachment 3.

Commission Recommendation
On January 22, 2025, an update on the PLHA Grant Program opportunity was provided to the Economic Development and Housing Commission as part of the Director’s Report. Although no formal action was taken, the Commission supported staff’s efforts to apply for the grant funding.

Strategic Plan Integration
The application and Five-Year Plan align with the Council’s Strategic Plan Goals of facilitating housing production and housing options for everyone including the most vulnerable members of society. 1318
PLHA Application and Plan
February 19, 2025

Page 3 ends

Alternatives
The following alternatives to the recommended action are submitted for the Council’s consideration:

1. Elect to not adopt Resolution 25-15 authorizing the application and adopting the Five-Year Plan for the PLHA Program; and/or

2. Modify the proposed scope of the PLHA Program application and Five-Year Plan.

Alternatives 1 and 2 are not recommended as they reflect previous Council Strategic Plan direction and would eliminate potential funding to support a ± 114-unit affordable housing project included as part of the Grand Gateway development, as well as accessibility improvements to lower-income owner-occupied residents.

Coordination and Review
This report was coordinated with the City Manager’s Office, Finance Department and the City Attorney.

Budget/Cost Impact
If funded, the PLHA Program application has the potential to generate an estimated $763,253 in grant funding to support the development of a ± 114-unit affordable housing project included as part of the Grand Gateway development, as well as accessibility improvements to lower-income, owner-occupied residents. The PLHA Program funds do not require any local funds match.

Description of how the Plan is consistent with the programs set forth in the Local government’s Housing Element
Activities proposed in the Plan support Program HE-PR-1.9: Cooperation with Affordable Housing Providers and Program HE-PR-2.1.1: Housing Rehabilitation (Single-Family) of the Housing Element. Program HE-PR-1.9 states that the City will continue to “cooperate with affordable housing providers…and provide regulatory and financial incentives”; Program HE-PR-2.1.1 states 1325

MEETING DATE: February 19, 2025 ITEM # 23
SUBJECT:

CONSIDERATION OF RESOLUTION 25-24 APPROVING EXCEPTION TO THE 180-DAY

WAITING PERIOD TO HIRE A CALPERS RETIRED ANNUITANT IN ACCORDANCE WITH GOVERNMENT CODE SECTIONS 7522.56 AND 21224

OBJECTIVE
The purpose of this report is to provide the City Council with sufficient information to approve a resolution to waive the 180-day waiting period for hiring a retired annuitant.

RECOMMENDED ACTION
Staff recommends that the City Council approve resolution 25-24 approving an exception to the 180-day waiting period for hiring a retired annuitant as an extra-help employee.

BACKGROUND
The Public Employees’ Pension Reform Act of 2013 (PEPRA) generally requires retired annuitants to be separated from employment for at least 180 days before returning to work for an employer in the same retirement system from which they receive a pension. An exception to this requirement may be made when the employer’s governing body certifies the nature of the employment and that the appointment is necessary to fill a critically needed position before 180 days have passed. The exception allows an employer to hire a retired annuitant to perform work of limited duration, such as to eliminate a backlog, work on limited term special projects, and perform work that is in excess of what regular staff can reasonably perform. PEPRA states that this appointment must be approved by the employer’s governing body in a public meeting as an action item. To secure a 180-day wait period exception, the employer must submit the approved resolution to CalPERS before the first day of reemployment.

ANALYSIS
Staff recommends that Lynda Vargas be hired to work as an extra help retired annuitant performing work similar to a Senior Analyst. Ms. Vargas retired effective January 24, 2025, with roughly 25 years of institutional knowledge, and has been an integral part of the Fire Department administrative operations.

The Fire Department is seeking to bring back Lynda as an extra help employee to ensure continuity of operations and proper knowledge transfer. While we have successfully filled the permanent position, the complex nature of the fiscal and administrative responsibilities requires additional support to maintain operational efficiency. The position involves critical functions that occur at various times throughout the fiscal year, including budget preparation, personnel management, payroll processing, and financial oversight. Many of these tasks are timesensitive and require specific knowledge of established procedures, departmental policies, and institutional history.

Although the new hire is competent and capable, there wasn't sufficient overlap time with Lynda to adequately cover all the nuanced aspects of the position, particularly those duties that occur on an annual or periodic basis.

Lynda’s expertise would be invaluable in providing guidance on these specialized tasks and ensuring smooth transitions during critical periods.

This strategic approach will ensure long-term success in these essential administrative functions while maintaining operational continuity during this transition period.

As a retired annuitant, Ms. Vargas will be limited to no more than 960 work hours per fiscal year. To bring Lynda Vargas back before July 23, 2025, a resolution must be submitted to CalPERS to comply with state laws applicable to the hiring of a retired annuitant. CalPERS typically requires that this action be approved as part of the City Council’s regular agenda, as opposed to the consent agenda, the attached resolution 25-24 meets all requirements set forth by CalPERS.

Commission Recommendation

Strategic Plan Integration
City government that is financially sound with a superior workforce.

Alternatives
The Council could decide not to approve the resolution and direct staff to identify another solution to this staffing and training need. This alternative is not recommended because Lynda Vargas is uniquely qualified to fill staffing gaps and provide training specific to the City of West Sacramento administrative fire processes. Any other alternative would not provide the same level of experience and institutional knowledge.

Coordination and Review
Fire staff have coordinated with Human Resources on this report.

Budget/Cost Impact
Any costs related to this item will be absorbed into the current Fire Department budget.

OBJECTIVE
The objective of this report is to provide the Mayor and Members of the City Council with the information needed to appoint members to the city Boards and Commissions.

RECOMMENDED ACTION
Staff respectfully recommends that the Mayor, with the support of the City Council, make the following appointments:

1. Arts, Culture, & Historic Preservation Commission: 7 members and 1 alternate member;

2. Board of Appeals: Continue recruitment for applicants;

3. Disaster Council: Continue recruitment for applicants;

8. Transportation, Mobility, & Infrastructure Commission: 7 members and 1 alternate member.

BACKGROUND
Board and Commission members serve in an advisory role to help to direct policy by making suggestions and recommendations to the City Council. This system of commissions is intended to be representative of, and responsive to, the communities they serve. Information about the eight City boards and commissions is available on the city website.

Appointments and/or reappointments to the City’s boards and commissions are made every two years of each odd-numbered year. The mayor appoints all members and alternates of the boards and commissions, subject to approval by the City Council (WSMC 2.20.030 (A)).

The City Clerk opened recruitment September 3, 2024. Recruitment closed on December 31, 2024 and was extended to January 3, 2025 due to a technical issue with the online application.

The Mayor and Members of the City Council were provided all the applications that were submitted by eligible candidates on January 6, 2025.

Because not enough applicants applied to fill neither the Board of Appeals or the Disaster Council, staff is recommending reopening recruitment and appointment members at a later date. This will not impact any current projects or work within the city.

Following appointments to the Boards and Commission, if approved at the February 19, 2025 City Council meeting those appointed will receive a letter inviting them to an orientation to be scheduled the week of March 10, 2025. The exact date has yet to be finalized at the time this report is being prepared.

The applications of individuals who are not appointed to a board or commission will be kept on file for two years.

If there are any unscheduled vacancies, their application will be considered to fill the vacancy.
