CITY OF WILDOMAR
CC - REGULAR MEETING
GENERAL BUSINESS
Agenda Staff Report # 3.3
Meeting Date: November 13, 2024
SUBJECT: Ordinance amending Chapter 5.04 (Bingo) of the Wildomar Municipal Code related to Nonprofit Bingo Overhead per
Senate Bill (SB) 1044
SUBMITTED BY: Janet Morales, City Clerk
ACTION:
Introduce and approve the first reading of an Ordinance entitled:
ORDINANCE NO. _______
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WILDOMAR, CALIFORNIA, AMENDING CHAPTER 5.04 (BINGO) OF THE WILDOMAR MUNICIPAL CODE SUMMARY:
Amending the Wildomar Municipal Code to be consistent with the new State Law related to Nonprofit Bingo Overhead.
BACKGROUND:
In 2008, the City Council adopted Chapter 5.04 of the Wildomar Municipal Code (WMC) which authorizes qualified organizations to conduct bingo games pursuant to Section 19 of Article IV of the California Constitution and Section 326.5 of the Penal Code. On July 15, 2024, the Governor approved an amendment to Penal Code 326.5 related to bingo overhead costs which requires an amendment to WMC Chapter 5.04 to be consistent with State law.
DISCUSSION:
Under the existing law, nonprofits are allowed to use a portion of the proceeds from bingo games for prizes and overhead costs such as rental costs and bingo equipment, administrative expenses, security equipment, and security personnel. The current overhead costs are limited to 20% of the proceeds before the deduction for prizes, or $2,000, a month, whichever is less. Beginning January 1, 2025, SB 1044 increases the overhead costs to 20% of the proceeds before the deduction for prizes, or $3,000, a month, whichever is less. In addition, SB 1044 allows the $3,000 threshold to be increased annually by the annual average percentage in the California Consumer Price Index for All Urban Consumers for the preceding calendar year. This Ordinance amendment ensures consistency between the Wildomar Municipal Code and State Law.
FISCAL IMPACT:
None.
ENVIRONMENTAL ANALYSIS:
Adoption of this ordinance amendment is not a project within the meaning of section 15378 of the CEQA guidelines because it will not cause either a direct physical change in the 1039
environment or a reasonably foreseeable indirect physical change in the environment and it involves continuing administrative activities under Section 15378(b)(2) of the CEQA Guidelines.
