Argument in Favor of Measure BG
Bell Gardens is in a fight to protect essential services this is the moment to step up.

Rising costs are putting intense pressure on our City budget. We must face a hard truth: Bell Gardens depends heavily on one major revenue source, Parkwest Bicycle Casino. If the Casino loses revenue, the City loses revenue.

That loss will not feel distant or invisible. It'll show up in our daily lives: fewer officers, slower response times, and deeper cuts that affect working families first.

We're at risk of losing federal funding the damage accelerates, and the choices get tougher.

Measure BG is the responsible, local solution to protect Bell Gardens before cuts become unavoidable. It increases the City's existing transactions and use tax from 3/4% to 1% and is expected to generate about $1.2 million each year.

A YES vote on Measure BG helps keep police patrols visible in our neighborhoods and maintain fast emergency response when seconds matter.

A YES vote on Measure BG helps protect programs that keep our kids safe, engaged, and supported after school and during the summer.

A YES vote on Measure BG helps protect senior services so our elders are cared for, and not left behind.

A YES vote on Measure BG helps keep the Community Family Service Center available for families who need support and resources.

A YES vote on Measure BG helps fix and improve our streets.

A YES vote on Measure BG helps protect the everyday City services that keep Be11 Gardens safe, clean, healthy, and working.

Measure BG does not raise property taxes and does not tax income. It applies only to taxable purchases. Does not apply to grocery store food or pharmacy purchases.

If you're frustrated or skeptical, we understand. This is your moment to protect what matters most: safety, stability, and a City that shows up for its people.

Vote YES on Measure BG.

CITY OF BELL GARDENS

COMMUNITY DEVELOPMENT DEPARTMENT

EXECUTIVE SUMMARY
TO: Honorable Mayor and Members of the City Council
FROM: Michael B. O'Kelly, City Manager
BY: Manuel Acosta, Director of Community Development
SUBJECT: Discussion Regarding Safe and Sane Fireworks
DATE: March 9, 2026
RECOMMENDATION:

It is staff's recommendation that the City Council take the following action:

1. Receive and file this report and take no further action; or

2. Direct staff to prepare a Safe and Sane Fireworks ordinance for consideration at a future City Council meeting.

BACKGROUND/DISCUSSION:

Fireworks fall into two categories, "Safe and Sane" and "Dangerous," and are defined in the California Health and Safety Code. (Health & Saf. Code §§ 12529 ["Safe and Sane Fireworks"], 12505 ["Dangerous Fireworks"].)
"Safe and Sane" fireworks are those that have been approved by the United States Consumer Product Safety Commission and have been carefully examined and tested by the State Fire Marshal, who has determined that the fireworks comply with the general and specific standards for design, construction, performance, and labeling for Safe and Sane fireworks, as set forth in Chapter 6 (commencing with Section 979) of Division 1 of Title 19 of the California Code of Regulations.
"Dangerous" fireworks are those made of particular compounds including, but not limited to: arsenic sulfide, arsenates, or arsenites; boron; chlorates, except as permitted under state law; gallates, or gallic acid; magnesium, except as permitted under state law; mercury salts; phosphorous, except as permitted under state law; picrates or picric acid; thiocyanates; titanium, except as permitted under state law; and zirconium. Dangerous fireworks include, but are not limited to: firecrackers; skyrockets and rockets; roman candles; chasers; sparklers more than 10 inches in length or one-fourth of one inch in diameter; auto-foolers, cigarette loads, exploding golf balls, and trick matches; "devil -on - the -walk" friction fireworks; torpedoes; and fireworks kits. Lastly, any other fireworks examined and tested by the State Fire Marshal and determined, with the advice of the

Page 789 of 797 ends

State Board of Fire Services, to be unsafe for use by any person not specially qualified or trained in their use.

At its July 22, 2019 regularly scheduled meeting, the City Council adopted Ordinance No. 894 adding Chapter 16.40 (Fireworks) of Title 16 (Health and Safety) of the City of Bell Gardens Municipal Code to prohibit the sale, use and discharge of safe and sane fireworks.

At the City Council meeting of February 23, 2026, Mayor De La Rosa directed staff to bring back an item to discuss the feasibility of amending the municipal code to allow for the sale, use, and discharge of "Safe and Sane" fireworks.

This report provides a breakdown of the procedures required to adopt an ordinance to amend the Bell Gardens Municipal Code:
1) City Council Initiation — The City Council through a motion and majority vote initiates an ordinance to modify the Bell Gardens Municipal Code.

Timeline: March 9, 2026
2) Research and Analysis — Staff will research standards and best practices to compose a draft ordinance and determine a recommendation to the City Council.

Timeline: March 10 - April 9, 2026
3) Proposed ordinance is presented to the City Council as a discussion item.

Timeline: April 13, 2026 (1St Reading)
April 27, 2026 (2"d Reading)
May 27, 2026 (Ordinance Effective)
Common Standards and Procedures
Common standards in fireworks ordinances typically include:
• Location restrictions, such as minimum distance requirements between stands and/or a maximum number of sales locations permitted citywide. • Seller eligibility requirements, which may limit applicants to qualified nonprofit organizations.
• Selection procedures, including an annual lottery, a first -come first -served process, or other established methods.
• Permitting fees, which may include amendments to the City's user fee schedule to establish a permit fee for fireworks sellers.

CONCLUSION:

Staff recommends the City Council direct staff to take no further action or commence drafting an ordinance for Safe and Sane fireworks. If directed to commence drafting an ordinance, Staff will research best practice standards to present to the City Council.

Anticipated timeframe to conduct all required ordinance procedures is three months.

Discussion Regarding Citywide Cannabis Status Update
March 9, 2026
RECOMMENDATION:

It is staff's recommendation that the City Council receive and file this report.

BACKGROUND/DISCUSSION:

This report provides a background of the City's Cannabis ordinances and a status update of the City's Cannabis businesses including current stage of development, entitlement expirations, revenues, and code enforcement procedures.

Background
On June 26, 2023, the City Council adopted Ordinance No. 934 conditionally allowing cannabis retail uses within portions of the City's Commercial and Industrial zones. The uses are subject to certain siting requirements and conditions of approval for a term of 18 months, or longer upon the execution of a development agreement (DA) with the City.

The DA provides for an initial five (5) -year term, subject to an option to extend for an additional five (5) years, for a total ten (10) -year term.

At its April 22, 2024 regularly scheduled meeting, the City Council adopted Ordinance No. 942 amending Title 5 (Business Licenses, Regulations and Taxes) of the Bell Gardens Municipal Code ("BGMC") to limit the number of Business Regulatory Permits for cannabis retail uses not to exceed a total of seven (7) permits.

At its June 9, 2025 regularly scheduled meeting, the City Council adopted Interim Urgency Ordinance No. 956-U thereby authorizing a moratorium on the acceptance, processing, and approval of all forms of applications for cannabis retail businesses for a period of 45 days.

Page 792 of 797 ends

At its June 23, 2025 regularly scheduled meeting, the City Council adopted Interim Urgency Ordinance No. 958-U thereby authorizing an extension to a moratorium on the acceptance, processing, and approval of all forms of applications for cannabis retail businesses for a period of 10 months and 15 days.

Development Status
The City currently has seven (7) active Conditional Use Permits (CUP) and Development Agreements (DA) allowing for the retail sale of cannabis. Among the seven, one (1) operator is currently operating, and the others remain in various stages of development.

Businesses are granted permission to operate with a temporary C of O when building and zoning corrections are not life and safety threats. Upon completion of the minor corrections, the business is granted a permanent C of O. Corrections include relocation of a water heater, installation of an awning above the main entrance, and installation of store front doors.

Conditional Use Permit Entitlement Status
Seven operators have active CUPs. Zen Garden was approved for a CUP on April 16, 2025, and the ordinance for the development agreement was approved on June 9, 2025.

The operator has not executed the development agreement, which was required to be signed within 60 days of ordinance effectuation. The City will proceed with an administrative process to formally revoke Zen Garden's CUP. As stipulated in Section

9.50.170 (Termination of a variance or conditional use permit) of Chapter 9.50 (Variances and conditional use permits) of Title 9 (Zoning and Planning Regulations) of BGMC and

Page 793 of 797 ends

required by the conditions of approval for the CUP, operators must actively pursue operations and/or maintain operations to remain in compliance with their CUP. Failure to actively pursue operations or abandon operations for a period of one (1) year shall cause the City to seek revocation of the CUP. Six of the operators are either currently operating or actively pursuing operation.

Revenues
Per the DAs, all operators are subject to two separate "Community Benefits" fees: an Annual Community Benefits Fee and a Quarterly Community Benefits Fee. Annual Community Benefits fees are required upon execution of the DA, and then again on January 15th of each subsequent year for the length of the DA. The Quarterly Community Benefits fee is payment of 7% of the total gross receipts and is required after the business commences operation.

Additionally, two operators, Kureleaf and Zen Garden, are subject to an Annual Youth - Specific Benefits Fee of $25,000. The first Annual Youth -Specific Benefits Fee is due prior to the issuance of the operator's building permit. Then, beginning the following year, the operator must pay the $25,000 fee annually by January 1591.

The table below lists the fees collected from each operator to date.

Per the terms of the DA, City staff has sent Notice of Default letters to operators with pending 2026 Annual Community Benefits fees on February 20, 2026 and provided a deadline of March 6, 2026, to correct the default. The City will commence procedures for terminating the DA with each respective business that has defaulted and is not timely cured.

If the operator/s fail to cure the default by March 6, 2026, they will be subject to late penalty fees and or the City Manager may begin the process to terminate the DA. If the City Manager begins the process, he will notify the Community Development Director of the City's intent to begin the termination or modification process.

The Community Development Director will then prepare a report for the Planning Commission and schedules a public hearing in accordance with applicable local and state noticing requirements. At the hearing, the Planning Commission will determine whether substantial evidence demonstrates that the operator is in default and make a recommendation to the City Council on whether to terminate or modify the DA.

The operator may appeal the Planning Commission's determination to the City Council within 14 days after such determination is made. The City Council will then hear and decide the appeal within 60 days of the operator filing the appeal.

Code Enforcement Procedures
Pursuant to the Condition of Approvals of the operator's CUPs, City staff, the Bell Gardens Police Department, the Los Angeles County Fire Department, and the Department of Cannabis Control have the right to enter any operator Site at any time for the purpose of conducting inspections to verify compliance with the CUPs, the DAs, and all applicable local, county, and state laws.

The Code Enforcement Division is drafting cannabis specific code enforcement procedures. Prior to the start of business for each operator, code enforcement officers will undergo site specific training identifying, among other things, the permissible hours of operation, number of required security personnel, allowed signage, and number of required security cameras. Code enforcement officers will regularly visit sites to ensure operators are in compliance with CUP conditions and obligations under the DA.

CONCLUSION:

Staff recommends the City Council receive and file this report. One of the six active DA's is currently in operation, and the others are in various stages of development. All the businesses remain current with their respective CUPs, and are currently not at risk of expiration. Lastly, the Code Enforcement Division is establishing business specific training to ensure each operator remains in strict compliance. Staff will continue to monitor and report on City wide cannabis activity.
