CITY OF MENIFEE
SUBJECT: Master Agreements for the CDBG Minor Home Rehabilitation Grant Program and the Single-Family Home Improvement
Grant
MEETING DATE: December 6, 2023
TO: Mayor and City Council
PREPARED BY: Edna I. Lebrón, Senior Management Analyst
REVIEWED BY: Cheryl Kitzerow, Community Development Director APPROVED BY: Rebekah Kramer, Acting City Manager
-------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Approve the two separate Master Service Agreements for the Minor Home Rehabilitation Grant Program (MHRGP) and the Single-Family Home Improvement Grant (SFHI) pre- approved contractors; and

2. Authorize the City Manager to execute individual Master Service Agreements with pre- approved contractors through June 30, 2025; and

3. Authorize the Finance Department to issue individual Purchase Orders (PO) against Master Agreements for approved individual home repair projects.

DISCUSSION
The Community Development Department’s Planning Division is responsible for the administration of the Community Development Block Grant (CDBG) Program and a portion of the American Rescue Plan Act (ARPA). Both programs offer home repairs to qualified low-income residents or permanently disabled homeowners. Eligible repairs are designed to improve the quality of life for homeowners and increase independence in circumstances where seniors and disabled individuals are residing in a home. Eligible repairs or replacements include, but are not limited to: HVAC, roof, plumbing, electrical, windows, and handicap accessibility. These repairs are provided by licensed contractors with good standing from the State of California’s Contractor Licensing Board and have not been placed on the debarment list by the U.S.

Department of Housing and Urban Development (HUD).

Pursuant to the Menifee Municipal Code, all purchases, goods and/or services, of $2,000 or greater require City Manager or City Council approval, in addition to adherence with any Item Title: 10.29
Master Agreements for the CDBG Minor Home Rehabilitation Grant Program and the Single-Family Home Improvement Grant

applicable competitive quote/bid process. To satisfy these requirements, individual requisitions were historically submitted for review and ultimate approval under the authority of the City Manager. Ultimately, all contractors awarded a project for home repair must have a PO before any work can commence. Given the high demand for the MHRGP and SFHI Programs, as well as the time sensitivity in being able to move forward with much-needed home repairs, staff has reviewed the current approval process for these programs and identified some operational process improvements to streamline approvals.

Staff is proposing that instead of obtaining individual approval by requisition specific to each individual project, the City Council approve the Master Service Agreement and pre-approved licensed contractors. The proposed agreements would cover the remainder of Fiscal Year (FY) 2023/24 and FY 2024/25.

In total, each individual master agreement would not exceed $100,000 for the contract period, and individual projects approved against the master agreements would not exceed the total available and approved program budgets, as approved during the budgetary process. In order to be pre-approved contractors participating in the program(s), each contractor would need to meet the following minimum requirements:

1. Maintain current and active applicable trade license(s) required to complete work.

2. Maintain an active City of Menifee Business License prior to initiating any work.

3. Maintain current and active Sam.gov registration demonstrating eligibility to provide federally funded works, as the two programs involve federal grant funding.

4. Be able to provide detailed project-specific quotes for staff review/approval.

From time to time, the Community Development Department will review additional eligible contractors interested in participating in the programs and approve for participation as a pre- approved contractor.

To ensure the most competitive pricing, and the most cost-effective use of the funds, staff would continue to request and obtain three competitive quotes for each project. Upon reviewing the quotes, program staff would request the Finance Department issue a corresponding PO to the approved contractor against the executed Master Agreement. This would condense the review/approval process for issuing individual purchase orders and allow projects to begin earlier.

In no event would the total purchase orders issued to any specific contractor exceed the total not- to-exceed established contract amount. The total purchase order issued collectively for the program would not exceed the total available program budget for the respective fiscal year(s).

STRATEGIC PLAN OBJECTIVE
Thriving Economy -
Implementation of the Master Service Agreement would support objectives in the City’s Strategic Visioning for a Thriving Economy by streamlining internal development-related processes and providing more transparency of contract service expenditures for ease of future reporting and contract monitoring.

FISCAL IMPACT
There would be no additional fiscal impact from the use of master agreements for the CDBG MHRGP and/or Single-Family Home Improvement Program. Funding for the CDBG and ARPA programs are included as part of the approved year’s operating budget (FY2023/24 and 2024/25), including applicable budget carryovers. As previously stated, the total purchase orders issued to any specific contractor would not exceed the total not-to-exceed established contract amount, and the total purchase order issued collectively for the program would not exceed the total available program budget for the respective fiscal year(s).

CITY OF MENIFEE

MASTER CONTRACT SERVICES AGREEMENT FOR

CDBG-QUALIFIED MINOR HOME REHABILITATION GRANT PROJECTS

THIS MASTER CONTRACT SERVICES AGREEMENT FOR CDBG-QUALIFIED MINOR HOME REHABILITATION GRANT PROJECTS (“Agreement”) is made and effective this _________ day of ___________, 2023 (“Effective Date”) by and between the CITY OF MENIFEE, a California municipal corporation, (“City”) and «Contractor», a «Entity_Type» (“Contractor”). City and Contractor are sometimes hereinafter individually referred to as “Party” and hereinafter collectively referred to as the “Parties.” SECTION 1. SERVICES.

1.1 Background. City participates in the Community Development Block Grant (“CDBG”) program administered by the United States Department of Housing and Urban Development (“HUD”) under Title I of the Housing and Community Development Act of 1974 (42 U.S.C. §§ 5301 et seq.) as amended from time to time, and the regulations promulgated thereunder (24 C.F.R. §§ 570 et seq.). Pursuant to the CDBG program, City receives funds from HUD (“CDBG Funds”) to be used for the support of community development activities that meet at least one of the three national objectives of the program: (i) benefiting low- and moderate- income persons, (ii) preventing and eliminating slums and blight, and (iii) addressing a community development need having a particular urgency. City operates a Minor Home Rehabilitation Grant Program (“Program”) using CDBG Funds. To participate in the Program, a homeowner applies for certain home improvements to be made to the home. For qualified homeowners, City facilitates specified home improvements and uses CDBG Funds to pay for those home improvements. Each participating homeowner enters into a construction contract with the contractor selected to perform the work for the specific homeowner’s home improvements.

1.2 Purpose. The purpose of this Agreement is to authorize Contractor to provide services on a CDBG-qualified project through purchase orders issued by the City Manager or designees (each a “Purchase Order”) subject to the terms and conditions herein (the “Services”).

1.3 No Guaranteed Work. The Parties acknowledge that this Agreement serves as a master services agreement to establish Contractor as an approved contractor which may perform Services as part of the Program for the City pursuant to Purchase Order(s) issued in the discretion of the City Manager. This Agreement does not guarantee that Contractor will be issued any work from City, or any particular amount of work, including for any Services. By entering into this Agreement, Contractor is obtaining the ability to receive Purchase Orders from the City Manager, and the City is obtaining the ability to issue Purchase Orders without a requirement for subsequent City Council approval.

1.4 Quotes for Work. Prior to issuing a Purchase Order, City shall solicit at least three (3) quotes from pre-approved contractors for the work subject the specific Purchase Order.

1.5 Commencement of Work. Contractor shall not commence work until Contractor has received a signed Purchase Order from City. Any work commenced by Contractor prior to the receipt of a signed Purchase Order shall not be paid or compensated in any manner.

Each Purchase Order includes all work for a specific homeowner who is participating in the Program.

For any work so corrected, Contractor’s obligation hereunder to correct defective work shall be reinstated for an additional one (1) year period, commencing with the date of acceptance of such corrected work.
e. Skilled and Trained Workforce. Contractor, for itself and its subcontractors at every tier, hereby provides an enforceable commitment to comply with California Public Contract Code section 2600 et seq., which requires use of a skilled and trained workforce to perform all work on the agreements that fall within an apprenticeable occupation in the building and construction trades.

Acceptance of any work by City shall not constitute a waiver of any of the provisions of this Agreement including, but not limited to, Section 4 and Section 5, pertaining to insurance and indemnification, respectively. For Services performed on a mobile home, the California Department of Housing and Community Development (“HID”) may also inspect Contractor’s work performed pursuant to this Agreement.

1.9 Assignment of Personnel. Contractor shall assign only competent personnel to perform the Services. Contractor shall make every reasonable effort to maintain the stability and continuity of Contractor’s staff and subcontractors, if any, assigned to perform the Services.

Contractor shall notify City of any changes in Contractor’s staff and subcontractors, if any, assigned to perform the Services, prior to and during any such performance. In the event that City, in its sole discretion, at any time during the term of this Agreement, desires the reassignment of any such persons, Contractor shall, immediately upon receiving notice from City of such desire of City, reassign such person or persons.

1.10 Time. Time is of the essence in the performance of this Agreement. Contractor shall devote such time to the performance of the Services pursuant to this Agreement as may be reasonably necessary to satisfy Contractor’s obligations hereunder. Contractor shall commence the Services pursuant to this Agreement upon receipt of a written notice to proceed and shall perform all Services within the time period(s) established therein. When requested by Contractor, extensions to the time period(s) specified in the Purchase Order may be approved in writing by the Contract Administrator but not shall not exceed one hundred eighty (180) days cumulatively.

Contractor acknowledges the insurance policy must cover inter-insured suits between City and other insureds.

Contractor agrees that the requirement to provide insurance shall not be construed as limiting in any way the extent to which Contractor may be held responsible for the payment of damages to any persons or property resulting from Contractor’s activities or the activities of any person or persons for which Contractor is otherwise responsible nor shall it limit Contractor’s indemnification liabilities as provided in Section 5. Insurance required by this Agreement shall be satisfactory only if issued by companies qualified to do business in California, rated “A” or better in the most recent edition of Best Rating Guide, The Key Rating Guide, or in the Federal Register, and only if they are of a financial category Class VII or better, unless such requirements are waived by the Contract Administrator in the Contract Administrator’s sole discretion. 4.1 Workers’ Compensation. In the alternative, Contractor may rely on a self- insurance program to meet those requirements, but only if the program of self-insurance complies fully with the provisions of the California Labor Code. Determination of whether a self-insurance program meets the standards of the California Labor Code shall be solely in the discretion of the Contract Administrator. The insurer, if insurance is provided, or Contractor, if a program of self- insurance is provided, shall waive all rights of subrogation against City and its officers, officials, employees, and authorized volunteers for loss arising from the Services performed under this Agreement. 5.3 Subcontractors. Contractor shall incorporate similar indemnity agreements with its subcontractors. Contractor shall be fully responsible to indemnify City, and failure of City to monitor compliance with these provisions shall not be a waiver hereof.

5.4 Limitation of Indemnification. The provisions of this Section 5 do not apply to claims occurring as a result of City’s sole or active negligence. The provisions of this Section 5 shall not release City from liability arising from gross negligence or willful acts or omissions of City or any and all of its officers, officials, employees, and agents acting in an official capacity.

In the event any applicable law contains a limitation on indemnification under this Agreement, such limitation shall supersede the provisions herein only to the extent required by said law.

SECTION 6. INDEPENDENT CONTRACTOR.

Except for the fees paid to Contractor as provided in this Agreement, City shall not pay salaries, wages, or other compensation to Contractor for performing the Services hereunder for City. City shall not be liable for compensation or indemnification to Contractor for injury or sickness arising out of performing the Services hereunder. Notwithstanding any other City, state, or federal policy, rule, regulation, law, or ordinance to the contrary, Contractor and any of its employees, agents, and subcontractors providing services under this Agreement shall not qualify for or become entitled to any compensation, benefit, or any incident of employment by City, including but not limited to eligibility to enroll in the California Public Employees Retirement System (“PERS”) as an employee of City and entitlement to any contribution to be paid by City for employer contributions and/or employee contributions for PERS benefits. 7.2 Compliance with Applicable Laws. In the case of any conflict between the CDBG Requirements and this Agreement, the CDBG Requirements shall control; it being understood, however, that in order to be in compliance with this Agreement and the CDBG Requirements, Contractor shall, to the extent possible, comply with the most restrictive provisions in this Agreement and the CDBG Requirements. Contractor shall not hire or employ any person to perform work within City or allow any person to perform the Services required under this Agreement unless such person is properly documented and legally entitled to be employed within the United States. Contractor acknowledges and agrees that it shall be independently responsible for reviewing the applicable laws and regulations and effectuating compliance with such laws. 7.4 Licenses and Permits, Fees, and Assessments. Contractor represents, warrants, and covenants to City that Contractor and its employees, agents, and any subcontractors have all licenses, permits, qualifications, and approvals of whatsoever nature that are legally required to practice their respective professions, and to perform the Services. Contractor represents, warrants, and covenants to City that Contractor and its employees, agents, and subcontractors shall, at their sole cost and expense, keep in effect at all times during the term of this Agreement any licenses, permits, and approvals that are legally required to practice their respective professions, and perform the Services. In addition to the foregoing, Contractor and any subcontractors shall obtain and maintain during the term of this Agreement valid business licenses from City. Contractor shall have the sole obligation to pay for any fees, assessments, and taxes, plus applicable penalties and interest, which may be imposed by law and arise from or are necessary for Contractor’s performance of the Services, and shall indemnify, defend and hold harmless City, its officers, employees or agents of City, against any such fees, assessments, taxes, penalties or interest levied, assessed, or imposed against City hereunder.

7.5 Conflicts of Interest. Contractor represents, warrants, and covenants that Contractor presently has no interest, direct or indirect, which would interfere with or impair in any manner or degree the performance of Contractor’s obligations and responsibilities under this Agreement. Contractor further agrees that while this Agreement is in effect, Contractor shall not acquire or otherwise obtain any interest, direct or indirect, that would interfere with or impair in any manner or degree the performance of Contractor’s obligations and responsibilities under this Agreement.

7.6 Unfair Business Practices Claims. In entering into this Agreement, Contractor offers and agrees to assign to City all rights, title, and interest in and to all causes of action it may have under Section 4 of the Clayton Act (15 U.S.C. § 15) or under the Cartwright Act (Chapter 2, (commencing with Section 16700) of Part 2 of Division 7 of the Business and Professions Code), arising from purchases of goods, services, or materials related to this Agreement. This assignment shall be made and become effective at the time City renders final payment to Contractor without further acknowledgment of the Parties.

7.7 Liquidated Damages. Since the determination of actual damages for any delay in performance of this Agreement would be extremely difficult or impractical to determine in the event of a breach of this Agreement, Contractor and its sureties shall be liable for and shall pay to City the sum of FIVE HUNDRED DOLLARS ($500.00) as liquidated damages for each working day of delay in the performance of any of the Services. City may withhold from any monies payable on account of the Services performed by Contractor any accrued liquidated damages.

SECTION 8. TERMINATION AND MODIFICATION.

8.1 Termination. City may terminate this Agreement at any time and without cause upon thirty (30) days’ written notification to Contractor. City may also terminate this Agreement pursuant to Subsection 8.8.

8.2 Termination by Contractor. Contractor may terminate this Agreement upon sixty (60) days’ written notice to City.

8.3 Consequences of Termination. In the event of termination, Contractor shall be entitled to compensation for the Services satisfactorily performed up to the date of termination; City, however, may condition payment of such compensation upon Contractor delivering to City any or all materials provided to Contractor or prepared by or for Contractor or City in connection with this Agreement. Upon receipt of any notice of termination, Contractor shall immediately cease all Services hereunder except such as may be specifically approved by the Contract Administrator.

8.4 Amendments. The Parties may amend this Agreement only by a writing signed by all the Parties. The Contract Administrator shall have the authority to execute amendments to this Agreement which do not materially change the terms hereof, in the Contract Administrator’s discretion, to the extent permitted by applicable federal, state, and local law. The Contract Administrator may refer any proposed amendment to the City Council for review and approval.

8.5 Assignment and Subcontracting. City and Contractor recognize and agree that this Agreement contemplates personal performance by Contractor and is based upon a determination of Contractor’s unique personal competence, experience, and specialized personal knowledge.

Moreover, a substantial inducement to City for entering into this Agreement was and is the professional reputation and competence of Contractor. Contractor may not assign this Agreement or any interest therein without the prior written approval of the Contract Administrator. Contractor shall not subcontract any portion of the performance contemplated and provided for herein, without prior written approval of the Contract Administrator. In the event of any unapproved assignment, including in connection with any bankruptcy proceeding, this Agreement shall be void. No approved assignment shall release Contractor or any surety of Contractor of any liability hereunder without the express consent of City.

8.6 Survival. All obligations arising prior to the expiration or termination of this Agreement and all provisions of this Agreement allocating liability between City and Contractor shall survive the expiration or termination of this Agreement.

8.7 Disputes, Default. In the event that Contractor is in default under the terms of this Agreement, City shall not have any obligation or duty to continue compensating Contractor for any of the Services performed after the date of default. Instead, City may give notice to Contractor of the default and the reasons for the default. The notice shall include the timeframe in which Contractor may cure the default. This timeframe is presumptively thirty (30) days, but may be extended, though not reduced, in the sole discretion of the Contract Administrator. During the period of time that Contractor is in default, City shall hold all invoices and shall, when the default is cured, proceed with payment on the invoices. In the alternative, City may, in its sole discretion, elect to pay some or all of the outstanding invoices during the period of default. If Contractor does not cure the default, City’s remedies shall include, but not be limited to, any or all of the following:
a. Immediately terminate this Agreement;
b. Retain the plans, specifications, drawings, reports, design documents, and any other work product prepared by Contractor pursuant to this Agreement; c. Retain a different contractor to complete the Services; and/or Item Title: 10.29

d. Charge Contractor the difference between the cost to complete the Services that is unfinished at the time of breach and the amount that City would have paid Contractor pursuant to Section 2 if Contractor had completed the Services.

Any failure on the part of City to give notice of Contractor’s default shall not be deemed to result in a waiver of City’s legal rights or any rights arising out of any provision of this Agreement.

8.8 Claims by Contractor. Claims, as that term is defined in California Public Contract Code Section 9204, by Contractor and, where applicable, any subcontractor, in connection with a public works project shall by subject to the mediation procedure in California Public Contract Code Section 9204.

SECTION 9. KEEPING AND STATUS OF RECORDS.

9.1 Records. Contractor shall keep, and require subcontractors to keep, such ledgers books of accounts, invoices, vouchers, canceled checks, reports (including but not limited to payroll reports), studies, or other documents relating to the disbursements charged to City and the Services performed hereunder (the “Books and Records”), as shall be necessary to perform the Services required by this Agreement and enable the Contract Administrator to evaluate the performance of such Services. Any and all such Books and Records shall be maintained in accordance with generally accepted accounting principles and shall be complete and detailed. The Contract Administrator shall have full and free access to such Books and Records at all times during normal business hours of City, including the right to inspect, copy, audit, and make records and transcripts from such Books and Records. Such Books and Records shall be maintained for a period of three (3) years following completion of the Services hereunder, and City shall have access to such Books and Records in the event any audit is required. In the event of dissolution of Contractor’s business, custody of the Books and Records may be given to City, and access shall be provided by Contractor’s successor in interest. Under California Government Code Section 8546.7, if the amount of public funds expended under this Agreement exceeds TEN THOUSAND DOLLARS ($10,000.00), this Agreement shall be subject to the examination and audit of the State Auditor, at the request of City or as part of any audit of City, for a period of three (3) years after final payment under this Agreement.

9.2 Reports. Contractor shall periodically prepare and submit to the Contract Administrator such reports concerning the performance of the Services required by this Agreement as the Contract Administrator shall require. Contractor hereby acknowledges that City is greatly concerned about the cost of the Services to be performed pursuant to this Agreement. For this reason, Contractor agrees that if Contractor becomes aware of any facts, circumstances, techniques, or events that may or will materially increase or decrease the cost of the Services contemplated herein or, if Contractor is providing design services, the cost of the project being designed, Contractor shall promptly notify the Contract Administrator of said fact, circumstance, technique, or event and the estimated increased or decreased cost related thereto and, if Contractor is providing design services, the estimated increased or decreased cost estimate for the project being designed.

The Fair Housing Act was amended in 1988 to provide protections from discrimination in any aspect of the sale or rental of housing for families with children and persons with disabilities. The Fair Housing Act also establishes requirements for the design and construction of new rental or for-sale multi-family housing to ensure a minimum level of accessibility for persons with disabilities.
c. Section 109 of Title I of the Housing and Community Development Act of 1974, as amended, including 42 U.S.C. 5301 et. seq., 42 U.S.C. 6101 et. seq., and 29 U.S.C. 794. This law provides in part that no person on the grounds of race, color, national origin, sex, or religion shall be excluded from participation in, be denied the benefits of, or otherwise be subject to discrimination under any activity funded in whole or part with funds under this Title. d. Section 104(b) of Title I of the Housing and Community Development Act of 1974, as amended, including 42 U.S.C. 5301 et. seq. This law provides in part that any grant under Section 106 shall be made only if the grantee certifies to the satisfaction of the Secretary of HUD that the grantee will, among other things, affirmatively further fair housing. 1 This exhibit is a list and summary of some of the applicable legal requirements and is not a complete list of all Contractor requirements. e. Contractor will comply with all provisions of Executive Order 11246 of September 24, 1965, and of the rules, regulations, and relevant orders of the Secretary of Labor. f. Contractor will furnish all information and reports required by Executive Order 11246 of September 24, 1965, and by rules, regulations, and orders of the Secretary of Labor, or pursuant thereto, and will permit access to his books, records, and accounts by the “Administering Agency” (as specified in 41 C.F.R. § 60-1.3) and the Secretary of Labor for purposes of investigation to ascertain compliance with such rules, regulations, and orders. g. CITY OF MENIFEE
SUBJECT: Golden Meadows Major Modification and Zoning Code Amendment
MEETING DATE: December 6, 2023
TO: City Council
PREPARED BY: Russell Brown, Senior Planner
REVIEWED BY: Cheryl Kitzerow, Community Development Director APPROVED BY: Rebekah Kramer, Acting City Manager
------------------------------------------------------------------------------------------------------------------------------

RECOMMENDED ACTION

1. Adopt a Resolution approving an Addendum to the certified Final Environmental Impact Report (“FEIR”) (State Clearinghouse No. 2003061122) for Golden Meadows Tentative Tract Map (“TTM”) No. 31194; and

2. Introduce an Ordinance approving Zoning Code Amendment (“ZCA”) No. PLN21-0201 to TTM No. 31194; and,

3. Adopt a Resolution approving Major Modification ("MJMOD") No. PLN21-0199 to TTM No. 31194, generally located north of Wickerd Road and west of Sherman Road.

DISCUSSION
On February 8, 2023, the Planning Commission held a public hearing and voted 5-0 to recommend denial to City Council of the Golden Meadows TTM No. 31194 ZCA and MJMOD (“Project”), along with the Addendum to the certified FEIR. The Planning Commission determined that the additional lots proposed within Phase 4, along with the proposed minimum lot size, would be incompatible with the existing surrounding land uses.

On June 7, 2023, the City Council held a public hearing and voted 5-0 to remand the Project back to the Planning Commission to allow the applicant the opportunity to continue working with City staff and the surrounding neighbors to find an agreeable design solution to present to the Planning Commission for consideration.

On July 26, 2023, the Project was presented to the Planning Commission as a workshop item as recommended by the City Council to further address community input related to the proposed modifications to Phase 4. The Planning Commission and nearby residents provided feedback on Item Title: 11.1

the proposed Project (described in further detail below). The applicant has modified the Project plans to incorporate the feedback received at the workshop and incorporated into the revised plans that are attached for the Council’s consideration. Since all of the requests by the Planning Commission have been incorporated into the Project, staff is recommending approval of the Project.

On November 8, 2023, the Planning Commission held a public hearing and voted 4-0 (Thomas absent) to recommend approval to the City Council of the Project, along with the Addendum to the certified FEIR. Several nearby residents spoke in opposition of the Project, citing similar concerns that were raised at the June 7, 2023 City Council meeting.

The Planning Commission determined that the updated Project, which incorporated recommendations provided at the July 26, 2023 Workshop, would be compatible with existing surrounding land uses. As a result of the Workshop, the updated site plan includes the following changes:
•Minimum lot size increased from 3,780 square feet to 4,000 square feet •Minimum lot sizes along Wickerd Road increased from 4,500 square feet to 6,000 square feet
•As a result of the new minimum lot sizes listed above, the revised Project proposes 19 less residential lots (79 lots opposed to 98 lots) from what was previously proposed Furthermore, the Applicant has volunteered additional concessions which would assist in offsetting the effects the additional residential lots may bring to the area. The additional concessions or supplemental conditions are:

1. Gate(s) at Country Haven Lane to deter pass-through traffic (not to exceed $85,000)

2. Expedite Wickerd/Haun traffic signal timing – 275 th to 138th building permit issued

3. AC berm and sidewalk along the southern side of Garbani Road from the Project to the middle school to increase pedestrian safety

4. CC&Rs identifying/acknowledging rural character of surrounding communities

5. Future homeowner disclosure notifying buyers of existing rural character

6. Community trail to be equestrian-friendly with proper signage

7. Park to include equestrian resting station which includes hitching post and water station

8. Deed restrict approximately 49 acres as Natural Open Space area to prohibit additional residential units from being constructed

9. Rural-themed development including rural architecture and community names For further information on the MJMOD and ZCA, please refer to the attached November 8, 2023 Planning Commission staff report.

Environmental Determination
An EIR for the approved Project was certified by the County on April 10, 2007 (State Clearinghouse No. 2003061122). The Certified EIR addressed potential impacts to the physical environment that would or may occur from implementation of the approved Project. An Addendum to the Certified EIR has been prepared in accordance with Sections 15162 and 15164 of the California Environmental Quality Act (“CEQA”) Guidelines. The City, as the lead agency under CEQA, has prepared an Addendum to the Certified EIR to consider environmental impacts Item Title: 11.1

associated with proposed MJMOD and ZCA, which would entail changes to Phase 4 of approved TTM No. 31194 and changes to the approved zoning code through a zoning text amendment.

The Addendum examines whether, as a result of any changes or any new information, a subsequent EIR may be required. The proposed changes that would result from the development of the proposed Project would not result in any of the conditions outlined in CEQA Guidelines Sections 15162(a)(1) to (3) because the proposed changes would not result in new significant environmental effects or a substantial increase in the severity of previously identified significant effects requiring major revisions to the Certified EIR, and, as explained herein, no new information of substantial importance meets any of the conditions in CEQA Guidelines Section 15162 (a)(3).

Accordingly, this Addendum provides the substantial evidence required by CEQA Guidelines Section 15164(e) to support the finding that a subsequent EIR is not required and an addendum to the Certified EIR is the appropriate environmental document to address changes to the proposed Project.

Findings
Findings for the EIR Addendum, ZCA and MJMOD are included in the attached Resolutions.

Public Notice
A public hearing notice for the proposed Project was published in The Press Enterprise on November 26, 2023 for the December 6, 2023 City Council hearing. All relevant public agencies, including all interested parties, were notified of the public hearing as were all property owners within a 300-foot radius of the project site. On-site posting was also provided.

WHEREAS, on December 6, 2023, the City Council held a duly noticed public hearing on the Project, considered all public testimony as well as all materials in the staff report and accompanying documents for ZCA No. PLN21-0201 and MJMOD No.

PLN21-0199, which hearing was publicly noticed by a publication in the Press Enterprise, a newspaper of general circulation, an agenda posting, on-site posting, notice to property owners within 300 feet of the Project boundaries, and to persons requesting public notice.

NOW, THEREFORE, the City Council of the City of Menifee resolves as follows:

Section 1: The City Council hereby makes the findings listed below for MJMOD No.

PLN21-0199 in accordance with Title 9, Article 2, Chapter 9.30.120(C)(2)(b) and declares that a major modification shall be processed in the same manner and subject to the same standards as the original application.

Finding 1 - The proposed subdivision and the design and improvements of the subdivision is consistent with the Development Code, General Plan, any applicable specific plan, and the Menifee Municipal Code.

TTM No. 31194 was originally approved by the County of Riverside prior to the City’s incorporation; at the time the project was approved, the zoning of the site was R-1 – One Family Dwellings, R-4 – Planned Residential and R-5 – Open Area Combined Development. The Planned Development Overlay was established by the City in January 2020 to identify planned development projects (“County Projects”) approved by the City (shortly after incorporation) or the County of Riverside prior to the City’s incorporation and in most cases, the projects contain special development standards specific to the planned development project. The Project is identified as a Planned Development by Title 9 of the MCC. The zoning of the site is currently PDO-5 or PD-5.

The General Plan land use designation for the subject parcels is 2.1-5 du/ac Residential (2.1-5R) and Rural Residential – 5 Acre Minimum (RR5). Surrounding properties to the north and to the east have a similar designation, while the properties to the south are designated Rural Residential ½ Acre Minimum and 1 Acre Minimum and the properties to the west are designated Rural Residential – 1 Acre Minimum and Public Facilities (PF). The intent of the Project’s land use designation is for single-family detached and attached residences with a density range of 2 to 5 dwelling units per acre. The proposed overall density of TTM No. 31194 is 2.69 dwelling units per acre and the proposed density within Phase 4 is 2.72 dwelling units per acre. The proposed Project would add 79 additional residential lots for a total of 240 compared to the 161 residential lots of the previously approved project. This would increase the overall number of proposed dwelling units over the entire TTM No. 31194 site (including Phases 1 to 3) from 486 to 552 dwelling units within the same development footprint.

The proposed Project is consistent with the existing General Plan land use designation of 2.1-5R as said use is intended to support the surrounding residential land uses. Furthermore, staff has reviewed and conditioned the proposed Project for consistency with subdivision ordinance requirements including, but not limited to, streets, domestic water, fire protection, sewage disposal, and other applicable requirements. The subdivision is consistent with the Subdivision Ordinance requirements.

In addition, the project is consistent with the following City of Menifee General Plan Policies:
•LU-1.1 Concentrate growth in strategic locations to help preserve rural areas, create place and identity, provide infrastructure efficiently, and foster the use of transit options.

The proposed Project is located within an area that is zoned for residential uses, with existing single-family residential homes to the north, south, east, and west. The Project would construct infrastructure and roadways (including a community trail) that would connect the existing school to the west of the site to other networks further east. The Project is consistent with this policy as it lends to the concentration of growth in strategic locations and preserves rural areas within the City.
•Policy LU-1.5: Support development and land use patterns, where appropriate, that reduce reliance on the automobile and capitalize on multimodal transportation opportunities.

The Project proposes site-adjacent roadway improvements consistent with City of Menifee General Plan cross sections.

Sidewalk and trail improvements developed by the project will be utilized by pedestrians. Thus, the Project is consistent with this policy.
•Policy LU-1.7 Ensure neighborhood amenities and public facilities (natural open space areas, parks, libraries, schools, trails, etc.) are distributed equitably throughout the City.

The subdivision preserves natural open space, particularly within the northwesterly portions of the site. The Project also proposes a community park and a recreation center for use by its residents and the public. Thus, the Project is consistent with this policy. •Policy LU-3.4 Require that approval of new development be contingent upon the project’s ability to secure appropriate infrastructure services.

The subdivision includes Conditions of Approval which require appropriate infrastructure. In addition, the subdivision has been reviewed and conditioned for consistency with the requirements for Item Title: 11.1

domestic water, fire protection, sewage disposal, fencing, and electrical communication facilities.
•Policy C-1.1 Require roadways to: Comply with federal, state and local design and safety standards.

The Project proposes improvements for roadways, including Wickerd Road, which are consistent with the City’s General Plan and the City’s Public Works and Engineering Department Standard Details.
•Policy CD-1.3: Strengthen the identity of individual
neighborhoods/communities with entry monuments, flags, street signs, and/or special tree streets, landscaping, and lighting.

The Project will include signs at the primary project entrance, street signs, coordinated street trees, landscaping throughout the project site, and streetlamps.
•Policy CD-3.1: Preserve positive characteristics and unique features of a site during the design and development of a new project; the relationship to scale and character of adjacent uses should be considered.

As previously stated, the Project proposes to preserve over 41- acres of natural open space near the northeasterly corner of the Project site. As such, the Project preserves unique features within the site.
•Policy C-2.2 Provide off-street multipurpose trails and on-street bike lanes as our primary paths of citywide travel and explore the shared use of low-speed roadways for connectivity wherever it is safe to do so.

The Project will provide an off-street walking trail and sidewalk improvements throughout the project site and along Wickerd Road consistent with this policy.
•Policy CD-3.19 Design walls and fences that are well integrated in style with adjacent structures and terrain and utilize landscaping and vegetation materials to soften their appearance.

The Project includes landscaping, as well as street trees, which will soften the appearance of the perimeter and site interior walls. An increased building setback along the northern side of Wickerd Road is being proposed as well. The walls that will be visible to the public will be constructed of decorative masonry block and pilasters which will be well integrated with the adjacent tracts to the northwest and northeast which also contain decorative masonry block walls.

Finding 2 - The tentative map does not propose to divide land which is subject to a contract entered into pursuant to the California Conservation Act of 1965, or the land is subject to a Land Conservation Act contract but the resulting parcels following division of the land will be of an adequate size to sustain their agricultural use:

The TTM does not propose to divide land which is subject to a contract entered into pursuant to the California Land Conservation Act of 1965.

Finding 3 - The site is physically suitable for the type of development and the proposed land use of the development.

The proposed density of the Project is consistent with the General plan and zoning of the subject site with approval of the modifications to the PDO. The majority of the site is relatively flat with exception of the natural hillside in the northeast corner that is to be preserved in its natural state.

The Project will provide the necessary drainage, sewer and roadway infrastructure to the project site and to the greater area. There is an existing middle school to the west of the site and single family residential on larger lots in all directions. Single-family residential with similar density to the proposed Project can be found to the northeast and northwest of the site. Therefore, given the relatively flat topography of the overall subject site, preservation of the natural hillside in the northeast corner of the site and the nature of the development that surrounds the Project, the site is physically suitable for this type of development and the proposed density of the development.

Furthermore, the Project has been reviewed by various Departments to ensure compliance with applicable regulations, including, but not limited to City of Menifee Building and Safety Division, Engineering Department, and Office of the Fire Marshal. These Departments have provided Conditions of Approval as appropriate to ensure compliance with applicable regulations.

Finding 4 - The design of the subdivision and the proposed improvements, with conditions of approval, are either:

1.Not likely to cause significant environmental damage or substantially and avoidable injure fish or wildlife or their habitat; or

2.Subject to an EIR under which a finding has been made pursuant to Public Resources Code Section 21081(a)(3) that specific economic, social, or other considerations make infeasible mitigation measures or project alternatives identified in the EIR.

Pursuant to CEQA, an EIR for the approved Project was certified by the County on April 10, 2007. The Certified EIR addressed potential impacts to the physical environment that would or may occur from implementation of the approved Project. In the EIR, it was found that with implementation of mitigation measures, the proposed project would not result in any Item Title: 11.1

significant impacts related to biological resources such as plant and animal species or their habitat. A Mitigation Monitoring and Reporting Plan (MMRP) was prepared and identifies all mitigation measures that will be required for the project.

The City, as the lead agency under CEQA, has prepared an Addendum to the Certified EIR to consider environmental impacts associated with proposed Major Modification and Change of Zone, which would entail changes to Phase 4 of approved TTM No. 31194 and changes to the approved zoning code.

Biological reports were conducted to determine sensitive plant and animal species onsite and applicable mitigation measures included in the EIR were included for their protection. The EIR also includes additional reports to determine consistency with the Western Riverside County Multiple Species Habitat Conservation Plan (WR-MSHCP) such as riparian/riverine areas, vernal pools, narrow endemic plant species, burrowing owl, and fairy shrimp. Review and mitigation coordination occurred with the applicable state and federal wildlife agencies.

The WR-MSHCP does not identify any covered or special-status fish species as potentially occurring on the Project site. Further, no fish or hydrogeomorphic features (e.g., perennial creeks, ponds, lakes, reservoirs) that would provide suitable habitat for fish were observed on or within the vicinity of the Project site. Therefore, no fish are expected to occur and are presumed absent from the Project site. In addition, the EIR discusses amphibians, reptiles, birds, mammals, and invertebrates. Any significant impacts associated with biological resources has been mitigated to less than significant. In addition, standard conditions of approval pertaining to burrowing owl, nesting birds, Stephen’s kangaroo rat and cultural resources still apply in this case and shall be addressed as part of standard monitoring in the conditions of approval. As such, the subdivision will not cause environmental damage or injure fish, wildlife, or their habitat. Furthermore, jurisdictional permits were obtained by the project applicant from the appropriate wildlife agencies.

Furthermore, the EIR includes a finding made pursuant to California Public Resources Code Section 21081 (a)(3) that specific economic, social, or other considerations make infeasible mitigation measures or Project alternatives identified in the EIR.

Finding 5 - The design of the subdivision and the type of improvements are not likely to cause serious public health problems.

The Project will not result in conditions detrimental to the public health, safety, or general welfare as designed and conditioned. The Project site is surrounded by single-family residences to the north, east, and west.
