WHEREAS, the State approved Assembly Bill No. 602 (AB 602), which modified the Mitigation Fee Act and stipulated that a jurisdiction must calculate residential fees proportionately to the square footage of the dwelling units; and

WHEREAS, the purpose of this Ordinance (this “Ordinance”) is to amend Chapter 16.82 of Rancho Cordova Municipal Code for the establishment of development impact fees to finance the cost of public facilities within the SunCreek Specific Plan area, to comply with AB 602 by revising the calculation of impact fees from per dwelling unit to square footage of the dwelling unit. The City Council enacts this Ordinance pursuant to the authority granted to cities by Article XI, Section 7 of the California Constitution.

SECTION 2. CEQA Findings. The City Council hereby finds:

CEQA Compliance. CEQA requires analysis of agency approvals of discretionary “projects.” A “project,” under CEQA, is defined as “the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.” (CEQA Guidelines, § 15378.) As reflected at State CEQA Guideline 15061 (b) (3), an activity is not subject to CEQA, “where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the
environment…” The proposed Title 16 code amendments is not a “project” within the meaning of

Page 614 of 664 ends

ITEM 10.1. ATTACHMENT 5 Ordinance No. XX-2026 Page 2 of 2
CEQA because text amendments revising the fees calculation methodology would not cause the expansion of uses or activities. No possibility exists that the ordinance will result in a significant effect on the environment. Thus, the proposed ordinance is not subject to the requirements of CEQA.

SECTION 3. Amendments to Section of Code. Chapter 16.82 “SunCreek Specific Plan Development Impact Fees”, attached hereto as Exhibit A, is hereby amended in the Rancho Cordova Municipal Code.

SECTION 5. Severability. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, the remainder of the Ordinance, including the application of such part or provision to other persons or circumstances shall not be affected thereby and shall continue in full force and effect. To this end, provisions of this Ordinance are severable. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase hereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be held unconstitutional, invalid, or unenforceable.

SECTION 6. Effective Date. Within fifteen (15) days after adoption, a Summary of this Ordinance shall be published once in the Grapevine Independent, or the Sacramento Bee, a newspaper of general circulation printed and published in Sacramento County and circulated in the City of Rancho Cordova, in accordance with Government Code Section 36933. This Ordinance shall take effect 30 days after its adoption and, pursuant to Government Code Section 66017(a), the fees established hereby shall be effective 60 days after the adoption of this Ordinance.

16.82.200 Annual program fee adjustment.

Beginning January 1, 2023, and thereafter each year no later than January 15th, the program fee per development unit type or per development unit type and square foot range for each type of development in each fee category shall be adjusted as follows:

A. A “mean” index will be computed by averaging the index for 20 U.S. cities with the index for San Francisco by resort to the October issue of the Engineering News Record magazine Construction Cost Index of the year in which the calculation is being made.

B. An adjustment factor shall be computed by dividing the “mean” index as calculated in subsection (A) of this section by the “mean” index for the previous October; however, if a new program fee has been adopted after January of the previous year, the adjustment factor shall use the “mean” index from the month that the fee was adopted.

C. The new program fee per development unit type or per development unit type and square foot range shall be calculated by multiplying the adjustment factor, as calculated in subsection (B) of this section, by the program fee per development unit type or program fee per unit type and square foot range in place prior to the annual adjustment.

D. The estimated cost of the facilities used in SunCreek specific plan capital improvement plan and for calculating credits and reimbursements pursuant to RCMC 16.82.180, 16.82.190 and 16.82.195 shall be adjusted annually using the same adjustment factor pursuant to subsections (A), (B) and (C) of this section.

MEMORANDUM

City Council Staff Report - Page 1 of 2

ITEM 12.1.

DATE: August 3, 2026

TO: Honorable Mayor and Council Members

FROM: Albert Stricker, Public Works Director
Drew Hart, Principal Transportation Planner

SUBJECT: UPDATES FROM 50 CORRIDOR TRANSPORTATION MANAGEMENT ASSOCIATION (50 CORRIDOR TMA)

RECOMMENDATION

Receive staff presentation and provide input.

RESULT OF RECOMMENDED ACTION

Staff will incorporate feedback into future work with the 50 Corridor TMA.

BACKGROUND

The City of Rancho Cordova has created a partnership with the 50 Corridor Transportation Management Association (50 Corridor TMA) to provide programs and innovative solutions that encourage the use of sustainable modes of transportation such as active modes, carpooling, and transit. 50 Corridor TMA provides services for communities in Rancho Cordova, Folsom, and unincorporated Sacramento County, along with private employers along the U.S. 50 corridor.

The history of the partnership with the 50 Corridor TMA aligns with the history of the transit tax program which was established before the city's incorporation. The primary funding source for sustainable transportation education, encouragement, and services comes from a levy within annexed Transit Zones, geographical boundaries that collect property assessments to provide sustainable transportation services to the residents of Rancho Cordova. Transit Zones were established as early as 2003 by the county as Sacramento County Services Areas. After incorporation, the city assumed the service responsibility and funding for the existing Transit Zones. Ongoing developments are added to Transit Zones to likewise offer transportation services. The purpose of the Transit Zones is to provide an ongoing financial mechanism to fund a broad range of transportation services intended to benefit property within the zones by reducing congestion and pollution. Funding these activities maintains compliance with Federal and State Clean Air Acts and California Environmental Quality Act requirements. The services include, but are not limited to, the following: transit shuttles, guaranteed ride home program, transit subsidies, transportation planning for employers and/or residents, education programs, infrastructure support like bike racks and bus stops, and bicycle and alternative fuel incentives.
