SECTION 5. The Development Fees (rates, fees, and charges) set forth in “Exhibit A” shall be effective 60 days after the adoption of this Resolution and shall be implemented commencing on that effective date. Any Non- Development Fees (rates, fees, and charges) set forth in “Exhibit A” shall be effective immediately.

SECTION 6. FLAT FEES - Where applicable, flat fees have been established for certain services where the average cost is subject to minimum fluctuation.

SECTION 7. HOURLY CHARGES - Where applicable, hourly charges shall be accumulated for development processing activities and the applicant shall pay all such costs prior to final action on the related project or as soon thereafter as such costs may be finally determined. The payment of such costs may be a condition of approval for any such application. If payment is not received within seven working days after the invoice due date, all development processing activities will be suspended until payment is received.

SECTION 8. DEPOSITS - In cases where an hourly rate is being charged, as opposed to a flat fee, each applicant shall place on deposit with the City the sum of one-half of the estimated total fees. Deposits have been estimated to represent the minimum amount required to process each case type. The costs of an individual case may be significantly more than the initial deposit amount. Costs will be charged against the deposit until the development case deposit balance is less than ten percent (10%) of the total estimated cost at which time the applicant will be required to post an additional deposit equal to the estimated remaining fees. The applicant shall submit the additional deposit within 10 days of notice. If payment is not received within 10 days after the notice, the City has the right to stop all development processing activities until payment is received. Any charges incurred in excess of the total deposits will be due prior to issuance of building permits. A late fee of ten percent (10%) shall be levied against delinquent development processing charges.

SECTION 9. REFUNDS - If the amount on deposit pursuant to Section 8 exceeds all accumulated costs at the time of the final action on subject application, the excess deposit shall be refunded to the applicant.

SECTION 10. GENERAL PLAN SURCHARGE – The General Plan Surcharge shall be five percent (5%) and shall be applied to all Fire Department fees, except those fees prohibited by state law.

Page 129 of 426 ends

SECTION 11. PERMIT STREAMLINING SURCHARGE – The Permit Streamlining Surcharge shall be three percent (3%) and shall be applied to all Fire Department fees, except those fees prohibited by state law.

SECTION 12. TECHNOLOGY SURCHARGE – The Technology Surcharge shall be four percent (4%) and shall be applied to all Fire Department fees, except those fees prohibited by state law.

SECTION 13. Specific Fire Department fees adopted under this Resolution supersede all prior like and applicable fees from any and all previous resolutions and ordinances to the extent that they are inconsistent with the fees hereby adopted. Any and all fees and resolution provisions not inconsistent with the provisions of this Resolution shall continue in full force and effect.

SECTION 14. Commencing July 1, 2027, all fees in “Exhibit A”, unless otherwise noted, shall be administratively revised and increased annually by a factor equal to the net change in the Fire Department’s salary and benefit costs for that fiscal year. Such net change is measured by comparing the total budgeted salary and benefit costs for the fiscal year in which the change is to become effective to the total budgeted salary and benefit costs for the prior fiscal year. Notwithstanding the foregoing, in no event shall the annual administrative revision described in this Section apply to any fees and charges established by other agencies or as otherwise may be prohibited by applicable law.

SECTION 15. The City Manager shall have the authority to interpret the provisions of this Resolution for purposes of resolving ambiguities. The City Manager shall have the authority to authorize and require reasonable compensation for the temporary use of City property or receipt of City services not otherwise provided for in this Resolution or other applicable resolutions or ordinances. Such compensation shall be based upon the City’s fully burdened hourly rates or costs as described in the aforementioned Fee Study.

SECTION 16. The City Manager is authorized to waive, modify or amend fees on any matter in their reasonable discretion, provided that in no event may said fees be increased.

SECTION 17. The State of California requires cities to charge state-established fees, rates, and charges, which are paid to the State. The City Council hereby directs the City Manager to incorporate such State-imposed

fees, rates and charges into the Master Fee Schedule, and every year hereafter.

SECTION 18. Any restatement in “Exhibit A” of existing rates and amounts for previously imposed taxes, fees, and charges is for the purpose of administrative convenience and is not intended, and shall not be construed, as the imposition, extension, or increase of any such tax, fee, or charge.

SECTION 19. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.

SECTION 20. If any portion of this Resolution is declared invalid or unconstitutional then it is the intention of the City Council to have passed the entire Resolution and all its component parts, and all other sections of this Resolution shall remain in full force and effect.

SECTION 21. If there are any conflicts between the Fire Department fees adopted in this Resolution and Fire Department fees adopted by any prior resolution or fee schedule, the Fire Department fees adopted pursuant to this Resolution shall take precedence.

Executive Summary
Introduction
MGT is pleased to present the City of Vallejo (City) with this summary of findings for the recently completed City of Vallejo Fire, Building, Planning, and Water user fee study.

The City contracted with MGT to perform a Fire, Building, Planning, and Water user fee study using fiscal year 2024- 2025 budgeted expenditures, staffing costs, and operational information. The City’s current fees represent the fees being charged at the beginning of this study.

This report is the culmination of an extensive study conducted by MGT in collaboration with the City’s Fire, Planning and Development Services , and Water Departments , fiscal leads, management, and staff. MGT would like to take this opportunity to gratefully acknowledge each department and division leader and all administrative staff who participated in this project for their efforts and coordination.

Study Scope and Objectives
The study included a review of fees for service activities within the Fire Department, Building and Planning Divisions of the Planning and Development Services Department, and the Water Department. The study was performed under the direction of the City’s Chief Financial Officer with the participation of key staff members and leaders.

The primary goals of the study were to:
♦ Determine the City's full costs to provide specific fee-related services. ♦ Determine whether there are any opportunities to consolidate, remove, or implement new fees.
♦ Identify service areas where the Ci ty might adjust fees to better reflect the full cost of services or to subsidize fees with General Fund revenue to reflect other economic or policy considerations.
♦ Develop fiscal projections based on recommended changes to fees. ♦ Provide comparative data for what neighboring cities are charging for similar services.

The information summarized in this report addresses each of these issues and provides the City with the tools necessary to make informed decisions about any proposed fee adjustments as well as the resulting impact on both restricted and General Fund revenues.

PAGE 2
Summary of Findings
User Fee Financial Overview
The study's primary objective was to provide City decision-makers with the analysis needed to make informed user fee pricing decisions. This report details the full cost of each service for which a user fee is charged.

The fee analysis adheres to Proposition 26 (Prop 26), which mandates that user fees be based on the "estimated reasonable cost of providing a service." Recommendations are based on careful consideration of the results of the cost analysis, and historical cost recovery levels.

Some fees are increasing, some are remaining as -is (e.g., pass-through fees), while other fees will decrease to comply with California user fee law (Prop 26) , which prohibits government agencies from recovering more than 100% of their reasonable cost.

Peer Comparison Survey
MGT collaborated with the City to identify a list of fees that are commonly charged by three City departments – Fire, Planning and Development Services, and Water – and collected information about those fees from six peer cities in California:
♦ Concord
♦ Fairfield
♦ Richmond
♦ San Pablo
♦ Santa Rosa
♦ Vacaville
The results of the comparative survey are presented in Appendix B.

Implementation Schedule
At the request of the City, MGT prepared a phased implementation schedule for all fees included in the Planning and Building Divisions’ fee studies. The schedule assumes that fee increases will be implemented over three years, with equal adjustments in each year.

The implementation schedules are presented in Appendix C.

PAGE 3
Methodology
Following is a summary of the methodology employed to conduct this study.

User Fee Introduction
User fees are charged in a variety of ways including:
♦ Flat (or fixed) fees – T he fee is always the same, regardless of size or complexity of the service provided in each instance.
♦ Per square foot or linear foot – The fee is calculated based on the size of the project under review.
♦ Hourly (or time‐and‐materials) – City staff track time and materials expense, and fees are calculated to recover actual costs. Hourly rates for different fees may vary depending upon the hourly rates of the staff completing tasks associated with that fee. ♦ Actual cost – The fee is charged to recover consultant costs as billed to the City , or time and materials of staff.
♦ Percentage of permit fee – The fee is calculated as a percentage of the original permit fee.
♦ Other increments – F ees are calculated based on increments such as the number of sheets or the number of set ups / take downs.

User Fee Study Methodology
There are several steps involved in estimating the full cost of an activity attached to a user fee:

1. Data collection

2. Computing hourly rates

3. Obtaining estimates of time spent on fee-related activities

4. Estimating user fees at full cost recovery and projecting changes in revenue There are also legal, economic, and policy factors that must be considered when making cost recovery recommendations.

Data Collection
MGT coordinated with City departments to obtain information necessary to complete this study, including the following:
♦ Schedules of current user fees, including dollar amounts and annual volumes for each fee. ♦ Fiscal Year 2025 budget information for each department. ♦ Data about currently occupied positions, salaries, benefits, and FTEs. ♦ Department organizational charts.
♦ Cost allocation plans.

MGT then met with each department to learn about the following:
♦ Desired changes to existing fee schedules, including new fees to be added or existing fees to combine or delete.
♦ Any positions that are vacant and are planned to be filled. ♦ The time spent by staff in each department providing each service.

Page 144 of 426 ends

PAGE 4
Hourly Rates
A cost-of-service study is comprised of two basic elements:
♦ Hourly rates of staff providing a given service.
♦ Time spent providing the service.

The hourly rate methodology used in this study builds indirect costs into City staff hourly salary and benefit rates to arrive at “fully burdened hourly rates.” Fully burdened hourly rates are a mechanism used to calculate the total cost of providing services. Total cost is generally recognized as the sum of direct costs together wi th a proportionate share of allowable indirect costs. The proper identification of all costs as “direct” or “indirect” is crucial to the determination of the total cost of providing services.

Direct costs are typically defined as those that can be identified specifically to a particular function or activity. These include the labor of people working directly on the specific service for which the fee is charged, and any materials or supplies those people use for the task.

Indirect costs are those that support more than one program area and are not easily identifiable to specific activities. Examples of indirect costs are:
♦ Departmental administrative and support staff.
♦ Training and education time.
♦ Public counter and telephone time.
♦ Some service and supply costs.
♦ Citywide overhead costs from outside of the department, as identified in a cost allocation plan.

MGT’s hourly rate calculation methodology includes the following:
♦ Personnel Services Analysis – Each staff classification within City departments is analyzed in the study. First, compensated absences such as vacation / holidays / sick leave days allocated to staff are deducted from total possible working hours for a year.

The model assumes a standard eight -hour workday and five -day work week. Staff positions are then categorized as either direct (operational) or indirect (administrative or supervisory) labor. In some cases, a classification will have both direct and indirect duties.

The total indirect portion of staff cost is incorporated into hourly overhead rates. ♦ Indirect Cost Rate – This equals the ratio of indirect costs to direct labor (salaries plus benefits) is established. There are three elements of indirect costs:
o Indirect Labor – This includes compensated absences as well as administrative and supervisory staff costs.
o Other Operating Expenses – Other operating expenses are either directly associated with a fee for service activity or are included as an indirect or overhead cost. Some examples of operating expenses that are directly allocated to a particular fee for service are professional servic es expenses or supplies that are used specifically for that fee for service. Most other operating expenses are classified as indirect costs and are allocated across all fees for service as overhead. o External Indirect Allocations – This represents the prorated portion of overhead from the City’s cost allocation plan that is distributed across all fees. ♦ Fully Burdened Hourly Rates – This incorporates all the elements that comprise the hourly rates used in this cost analysis.
o Each direct or operational position is listed, together with the average annual salary and benefits or actual salary and benefits.

Page 145 of 426 ends

PAGE 5
o The hourly salary and benefit rate is calculated by adding the annual salary and benefits for an employee and dividing by available hours. The model assumes a standard work year of 2,080 available hours, although this might not apply to all employees, depending on paid time off accrual rates.
o The overhead rate combines the internal and external indirect cost rates, which are computed by dividing internal (department) indirect costs and external indirect costs by total direct salaries and benefits. Internal and external indirect cost rates are t hen multiplied by salaries and benefits for each position to obtain the dollar value of that support. This is combined with hourly salary and benefit rates to obtain fully burdened hourly rates.
o The overhead rate is derived by multiplying the internal and external indirect cost rates by the salary and benefit hourly rates.

The total fully burdened hourly rate combines the hourly salary and benefit rate with internal and external indirect cost rates. MGT prepared indirect overhead rates and corresponding hourly rate calculations using fiscal year 2025 budgeted expenditures.

Time Spent
The next step in the process required identifying staff time spent directly on each user fee activity.

Each staff person involved in user fee services estimated the time necessary to complete tasks associated with those services. Annual volume statistics were also gathered to develop total annual workload information. This information is provided in detailed user fee workbooks which were provided to the City upon completion of the study.

Fee Calculations and Revenue Projections
Given this information, MGT calculated the cost of providing each service, both on a per-unit and annual basis (per-unit cost multiplied by annual volume equals total annual cost). As mentioned above, costs were calculated by multiplying per -unit time estimates by the hourly labor rates; additional operating expenses directly associated with certain services were also included.

If other departments or divisions provided support for certain user fee activities, this time was accounted for and added into the analysis as a crossover support activity. Full costs are then compared to current revenues collected, and subsidies (or over-recoveries) identified.

User fee summaries by department can be seen in the next section of this report.

Legal, Economic, and Policy Considerations
Calculating the true cost of providing services is a critical step in the process of establishing user fees and corresponding cost recovery levels. Although true cost is an important factor, other factors must also be given consideration. City decision makers must also consider the effects that establishing fees for services will have on the individuals purchasing those services, as well as the community.

The following legal, economic, and policy issues help illustrate these considerations. ♦ Legal Restrictions – In California, user fees are limited to the "estimated reasonable cost of providing a service" by Government Code section 66014(a) and other supplementary legislation. California voters approved Proposition 26 in November of 2010, which defined “taxes” as “any levy, charge, or exaction of any kind imposed by a local government”

Page 146 of 426 ends

PAGE 6
subject to seven exceptions. Most of the exceptions require that the City charge a fee which does not exceed the reasonable cost to the City to provide the service for which the fee is charged. Thus, if the fee exceeds the reasonable cost of service, it may be considered a “tax” which must be approved by the voters. MGT has calculated each fee to recover no more than the reasonable cost of each service so that none of the fee adjustments recommended herein will be considered taxes under Proposition 26.

Additionally, it should be noted that some fees might be capped by state law and might not change, regardless of any cost analysis carried out. ♦ Community benefit – The City might wish to subsidize some user fees to reflect policy considerations that supersede cost recovery. For example, many community services fees have very moderate cost recovery levels. Some programs are provided free of charge or for a minimal fee regardless of cost. Youth and senior programs tend to have the lowest cost recovery levels. Miscellaneous classes tend to have a moderate cost recovery level, while adult sports programs typically have a higher cost recovery level. ♦ Private benefit – If a user fee primarily benefits the fee payer, MGT recommends the fee be set at, or close to, 100% full cost recovery.
♦ Service driver – In conjunction with the first point above, the issue of who is the service recipient versus the service driver should also be considered. ♦ Understanding demand – There are other considerations that might inform recommendations for fees not subject to cost recovery limitations. For example, elasticity of demand is a factor in pricing certain municipal services; increasing the price of some services could result in a reduction in the quantity demanded for other services, and vice versa.
♦ Competition – Certain services might be provided by neighboring communities or the private sector. Demand for these services can be highly dependent on what else might be available at lower prices. Furthermore, if the City's fees are too low, demand for services produced by private-sector competitors could decrease.
♦ Incentives – Fees can be set low to encourage participation in a service.

Analysis Highlights
User Fee Studies
Below is a brief discussion of the findings for each department’s user fee study. Please see the user fee summary sheets in Appendix A of this report for the details on the cost analysis for each fee.

The services provided by all departments included in the user fee study create benefit for individuals and the community and are therefore eligible for cost recovery. Because these services primarily benefit the fee payer, the fees are recommended to be set at 100% cost recovery unless otherwise noted.

The results of this fee study show that some fees are over -recovering costs while others are under-recovering costs. Adjusting fees to achieve 100% cost recovery will keep fees aligned with the level of effort needed to provide the associated services.

Fire Department – Fire Prevention Division
The mission of the Vallejo Fire Department is to ensure a safe community through exceptional professional fire service. Its vision is to be a progressive organization that provides leadership and high-quality safety to the community we serve.

The Fire Prevention Section is responsible for:
♦ Fire Inspection Services
♦ Fire and Life Safety Inspections
♦ Plan Check and Permitting
♦ Fire Reports and Investigations
♦ Public Education/Community Outreach
Currently, Fire Prevention Division fees recover approximately 70% of the division’s total costs.

If staff recommendations are adopted, cost recovery would increase to 100%, adding approximately $457,000 in revenue once the fee changes are fully implemented.

Prevention (Business and Mercantile) fees have among the largest percentage increases at over 200%, while other treatments have increases of as little as 8 %. If demand stays the same, the recommended fee changes will generate about $457,000 in additional annual revenue.

Planning and Development Services Department
The Planning and Development Services Department's purpose is to create an environment that fosters sustainable investment while preserving the public's welfare and the environment.

Building Division
Within this department, the Building Division ensures public safety by applying state and local building codes to every construction project. Staff review plans, issue permits and conduct inspections for new construction, additions, renovations and remodel s. They also investigate complaints about potentially dangerous or nuisance buildings. This work supports the City’s goal of encouraging development while maintaining a safe built environment.

Current Recovery
Currently, the Building Division’s fee schedule recovers approximately 59% of the division’s total costs. If staff recommendations are adopted, cost recovery would increase to 80%, adding approximately $760,000 in revenue once the fee changes are fully implemented.

Fee Structure and Calculations
The Building Division fee schedule is organized into five primary fee types; each aligned with how services are delivered. This structure improves transparency for applicants, supports accurate cost recovery, and provides staff with a consistent framework for applying fees. The table below outlines each type, its purpose, and the method used to calculate charges.

Fee Structure Description Calculation
Hourly Fees Time-based fee. Minimum base fee applies Base Fee + Additional Hourly Fee* Valuation-Based Fees Core permits tied to project value, aligned to typical staff time on project by size

Updates Made to Fee Structure
The following updates reflect a combination of structural adjustments and clarifications to the existing fee schedule. These changes were made to improve transparency, align fees more closely with service delivery, and ensure consistency with cost-of-service principles.

1. Penalty and Expired Permits
Clarified as percentage- based charges tied to the original permit value (e.g., 25%–50%), rather than flat fees. This ensures proportionality based on project size and reinforces compliance expectations.

2. Base-Plus-Hourly Format
For plan reviews and certain inspections, clarified the use of a base fee that includes a set number of hours, with additional time billed hourly. This structure was already in use in some areas and has now been formalized and consistently applied.

3. Valuation-Based Fees
Updated sliding scale approach that better reflects project size and complexity with updated assumptions of time efforts, review counts, and project size valuations with more scalable fee tiers.

4. Percentage-Based Plan Review
Retained existing percentage- based calculations for elements like Title 24, Disabled Access, and CALGreen reviews. These were clarified in the fee schedule to ensure consistency and transparency.

5. State-Regulated Fees (e.g., Solar)
Adjusted to match state-mandated maximums and formulas. Language was also refined for clarity, including updates to thresholds (e.g., “>50 kW”) and itemized $/kW rates.

6. Fee Schedule Language Improvements
Strengthened the clarity of fee descriptions by specifying what the base includes, when hourly charges apply, and which items are subject to state or policy-driven limitations.

7. Phased Cost Recovery Application
Most cost-based fees are aligned to a target recovery level (e.g., 80%) and increases are phased in over a three-year period with an adjustment for the Consumer Price Index (CPI) yearly to ease implementation and reduce abrupt jumps.

PAGE 11
Planning Division
The Planning Division facilitates new development consistent with the City’s General Plan, specific plans, Zoning Ordinance, Sign Ordinance, Subdivision Ordinance, the California Environmental Quality Act (CEQA) and other State, Federal and local regulations pertaining to new development activity. The Planning Division supports the Planning Commission, the Architectural Landmarks and Heritage Commission, and the Design Review Board.

Within the Planning Division, current fees recover approximately 44%. If staff recommendations are adopted, cost recovery would increase to 62%, adding approximately $139,000 in revenue once the fee changes are fully implemented.

Fee Updates
The Planning Division is keeping the original structure of their fee schedule; therefore, MGT is not recommending any fee structure updates. There are new fees being added for the following five activities listed below, along with the full cost of each activity:

1. Design Review – Minor: $4,243

2. SB-9 – Lot Split: $3,881

3. SB-9 – Two Unit Development: $3,881

4. SB-9 Lot Split and Two Unit Development: $5,897

5. Street Vender – Permit: $347
Department management recommends a variety of cost recovery levels across the fee structure.

This results in price increases for many fees and price decreases for others . Planned Development fees have the largest percentage increase at approximately 450%, while other fees are expected to decrease by as much as 100%, in the case of Sign Permits : Over the Counter. If demand stays the same, the proposed fee changes are expected to generate approximately $139,000 in additional annual revenue.

Water Department
The Vallejo Water Department provides administrative, engineering, water treatment, and maintenance support for the City's potable (drinking) water treatment and distribution. Our stringent criteria and regulations ensure we meet or exceed all regulations set forth by the California Department of Public Health and the U.S. Environmental Protection Agency. The Vallejo Water Department also works closely with the community and local schools to provide conservation education and share information about current rebate programs.

The Water Department was unable to provide annualized volume data for their fees due to recent changes in technology; however, the department was able to provide reasonable level of effort estimates for each fee to enable MGT to calculate the Water Department’s fee on a per transaction basis.

Fee Updates
The Water Department is keeping the majority of its original fee structure. The only change in fee structure relates to moving four of the five “Reduced Pressure Installation” fees from a flat rate to an actual cost fee. Currently the “3- inch or larger reduced pressure” fee is already set as an actual cost fee. The department has also recommended a few slight changes to its current deposit and penalty fees. The “residential sfd” and “multifamily/commercial” water service security deposits have been recommended to update from $148 and $300 (minimum) respectively, to $150 and $400 (minimum), respectively. Also, the department recommended increasing the penalties associated with water meter lock tampering from $75 and $117 for first and second offenses, respectively, to $150 and $200, respectively. The department believes the

Page 152 of 426 ends

PAGE 12
increase in deposits reflects the increase in monthly water bills, while the increase in penalties will provide more deterrence from unwanted behavior.

In addition to the minor changes in fee structure and updates to deposits and penalties, the Water Department is adding 20 new fees to its fee schedules. These new fees are as follows, along with the full cost of each activity:

1. Meter Upsizing to ¾ inch – Actual Cost

2. Development Agreement – $599

3. General Plan Update – $599

4. Minor Use Permit – $492

5. Accessory Dwelling Unit – $492

6. Planned Development – $1,337

7. Planned Development – Amendment – $546

8. Preliminary Review (Inside City) – $1,688

9. Preliminary Review (Outside City) – $2,284

10. Preliminary Review (School/Hospital) – $2,284

11. Development Review – Major (Staff Level) (Large Multi-Family, Demolition) – $7,084

12. Development Review – Major (PC Public Hearing) – $733

13. Development Review – SB 35 and/or Density Bonus – $6,189

14. Development Review – Minor (Single/Multi Family, Tenant Improvements) – $3,095

15. Lot Line Adjustment – $492

16. Parcel Map – $1,230

17. Parcel Map Amendment – $492

18. Tentative Map – 5-20 lots - $4,303

19. Tentative Map – 20+ lots - $10,278

20. Tentative Map Amendment – $4,391
The new fees are designed to capture revenue related to services already provided by the department but that are not yet being charged.

Department management recommends 100% cost recovery for all fees. Most fees are increased because of this level of cost recovery; however, there are a select number of fees that will decrease. See Appendix A for a summary of the results.

Peer Comparison Survey
Peer comparisons provide insights into fee practices and structures . By examining the fee structures of neighboring jurisdictions, agencies can ensure their fees are competitive and fair.

Moreover, peer comparisons can help to identify the best industry practices and innovative approaches that can improve efficiency and service delivery. This could affect how City implements their fee structures and levels.

As with any survey across jurisdictions , it is often challenging to make an “apples -to-apples” comparison. This is because organizational structures, fee schedules and practices, and legal requirements vary across jurisdictions. Also, peer communities might not have completed a cost recovery analysis or updated their fee policy for many years.

The City requested that MGT conduct a comparison survey of various fees charged by peer fire departments. These peers included the following, which were suggested by City:
♦ Concord
♦ Fairfield
♦ Richmond
♦ San Pablo
♦ Santa Rosa
♦ Vacaville
The survey included numerous examples of fees charged or proposed by the following departments and divisions:
♦ Fire Department
♦ Planning and Development Services Department
o Building Division
o Planning Division
♦ Water Department
A complete list of fees included in the survey can be found in Appendix B.

PAGE 14
Recommendations
MGT’s recommendations are grounded in the results of our thorough analysis and are designed to be practical and achievable. The primary objective is to enhance the City’s fee structure and fee levels to improve cost recovery and better match the people who benefit from the service with those who pay for it.
♦ The City should build on its investment in this cost -of-service analysis by continuing to analyze its fees and charges, whether this is done by staff or outside consultants. Once the commitment is made to understand the full cost of providing services, it is important to review and update the analysis to keep pace wit h changes in service delivery, staffing changes, and demand levels.
♦ The City should perform this detailed analysis at least every three but not more than five years, with minor adjustments in the non‐study years . This will help keep pace with changes in costs and other economic factors.
♦ The City should also apply an annual inflation adjustment to fees levels to keep pace with inflation. The Consumer Price Index (CPI) is a commonly used macroeconomic statistic that is employed to adjust fee levels over time, although there are other options. The best practice in industry is to apply an inflation adjustment once per year as part of the City’s annual budget process. This is particularly helpful once an agency has chosen to adopt a cost recovery policy – whether 100% of the cost or something less – to keep fees at the desired level.

ACTION ITEM 9.B.

DATE: July 14, 2026
TO: Mayor and Members of the City Council
FROM: Kristin Pollot, AICP, Director of Planning & Development Services Beth Schoenberger, Water Director
SUBJECT: HOLD A PUBLIC HEARING TO CONSIDER ADOPTION OF A RESOLUTION AMENDING

THE MASTER FEE SCHEDULE TO ESTABLISH NEW FEES AND REVISE EXISTING

FEES FOR SERVICES PROVIDED BY THE BUILDING AND PLANNING DIVISIONS OF

THE PLANNING AND DEVELOPMENT SERVICES DEPARTMENT AND THE WATER

DEPARTMENT

RECOMMENDATION
Hold a public hearing to consider adoption of a resolution amending the Master Fee Schedule to establish new fees and revise existing fees for services provided by the Building and Planning Divisions of the Planning and Development Services Department and the Water Department.

REASONS FOR RECOMMENDATION
The City of Vallejo has not conducted a comprehensive review of service fees for Building, Planning or Water since 2019. Establishing new fees and revising existing fees as recommended would help to increase cost recovery for existing services being provided by these Departments.

BACKGROUND AND DISCUSSION
The California Constitution grants cities authority to set fees to cover the costs of providing services. In late 2024, the City engaged MGT of America Consulting (MGT) to conduct a comprehensive analysis of fees for Building, Planning, Water, and Fire services. MGT collected data and interviewed City personnel as part of that analysis and completed the Fee Study Final Report dated August 2025 (“Fee Study”). MGT has calculated each fee to recover no more than the reasonable estimated cost for providing the services for which the fees are charged. Recommendations related to Fire service fees are presented in a separate staff report.

On September 9, 2025, the City Council held a public hearing and staff presented initial findings and recommendations from the Fee Study. During the meeting, the City Council voted 7-0 to direct staff to research and provide additional information related to the following topics raised during the hearing (see below for specific topics, with staff responses provided below each topic).

1. Consider impacts on economic development to ensure the city maintains a competitive advantage.

Staff Response: Concerns about development review fees impacting development activity, and the city’s overall competitive advantage, were raised by Council members and are valid concerns. Cost recovery percentages for Building and Planning services are currently set at 59% and 44% (respectively), and the proposed new fee amounts would increase those cost recovery percentages to 62% and 55%, respectively. A comparison of the proposed fees against similar fees in neighboring/nearby jurisdictions indicates that Vallejo’s current development review fees are the lowest in the area, so the modest increases proposed should not have a negative impact on the city’s overall competitive advantage. Further, strategies to encourage economic development should follow the guidance outlined in the adopted Vallejo Economic

Development Strategic Plan, separate from the Service Fee Update process. Should the City Council decide to pursue reduced fees or waivers for certain development types, those incentives should be tied to specific targeted development activities that the City wants to encourage, and they should be considered as a separate, stand-alone targeted program(s), that can be modified/adjusted in response to market conditions, targeted economic development strategies, and can be tracked/adjusted separate from the baseline city-wide master fee schedule. For Water fees specifically, there is State of California legislation (resulting from CA voter approval of Proposition 218 in 1996, (“Right To Vote On Taxes Act”) that requires that services that benefit only certain customers or other City services cannot be subsidized by revenue generated from general water rates and can only be subsidized by non-rate revenue sources such as the General Fund, grants, and other non-rate revenue.

2. Consider an equity lens, to ensure the City is supporting low-income households and not discouraging compliance with fees that are too high.

Staff Response: In response to this concern raised by City Council, staff met with the consultant to discuss/review options for addressing equity in development review service fees. Based on the research (summarized in the attached supplemental memo from MGT), it was found that while some public agencies do offer limited fee waivers or reductions (usually targeted to development projects providing community benefits such as affordable housing), true equity-based fee programs aimed at individual residents are very uncommon. The research also highlighted several implementation challenges, including the need for clear eligibility criteria, robust and privacy-conscious data collection, and careful consideration of revenue impacts on the City’s General Fund. In recognition of these constraints, paired with the fact that proposed cost recovery rates would still be relatively low, staff does not recommend any adjustments to the fee schedule as presented. However, there are a few options that the City Council could consider to further address equity concerns:

Option 1: Adopt the fee schedule as recommended but continue to pursue other external funding opportunities that may help support or offset costs for low-income and EJ-impacted households for energy efficiency and electrification improvements, including the Bay Area Air Quality Management District’s Local Community Investments / People’s Air Grant Program (application submitted in May 2026, and currently pending award decisions), which supports community-based air quality and electrification-related public health projects in impacted communities. In addition, some other programs that provide homeowner-level support include:
• California Energy Commission – Equitable Building Decarbonization (EBD) program. This is currently active through phased solicitations. The program focuses on electrification and efficiency upgrades for income-qualified households, typically implemented through regional partners rather than direct homeowner applications.
• BayREN Home+ Program. This is an ongoing program, with rolling rebates for energy efficiency and electrification upgrades (HVAC, insulation, heat pumps, etc.), with enhanced incentives for income- qualified households.
• PG&E Energy Savings Assistance (ESA) Program / CARE eligibility supports. This is an ongoing utility program providing no-cost weatherization and appliance upgrades for income-qualified customers. • California Weatherization Assistance Program (WAP). Federal program administered locally, providing energy efficiency and health/safety home improvements for low-income households.

Option 2: Create an in-house fee reduction program based on individual homeowner income levels, which could provide fee reductions (to current fee levels) for those fee/permit types that are most commonly utilized by homeowners, including residential window/door replacements, minor electrical permits, and plumbing permits such as water heater installs/replacements. It should be noted that water-related fee reductions would have to be offset by non-rate revenue, to comply with Proposition 218 approved by the voters in 1996 (Right to Vote on Taxes Act). Those funding sources, such as the General Fund, would need to be identified. It should also be noted that for both departments, this fee-reduction program would be difficult to implement given the current staff vacancy and retention rates in both departments, as well as the reasons listed above and in the attached memo provided by MGT. However, if the City Council would like to proceed with this option, then staff could come back within approximately 90-days to present details for a proposed fee reduction program, which would be subject to final review and approval by the City Council.

3. Consider support for renewable energy projects and projects with lower energy consumption.

Staff Response: Similar to staff’s response under Topic #1 above, staff recommends that incentives for renewable or low energy consumption projects should be considered as a separate, stand-alone targeted program(s), that can be modified/adjusted in response to targeted City policies, and can be adjusted separately from the baseline Citywide Master Fee schedule.

4. Consider adding an expedited permitting process fee.

Staff Response: After consultation with the consultant, staff has concluded that incorporation of an expedited permit review fee is not practical because: 1) the City cannot charge fees for services that exceed the cost to actually do the work, and 2) the City does not have staff resources available to actually provide an expedited permit process in-house that moves faster than the standard review time. However, it should be noted that there is always an option available for applicants to request outside consultants review of projects/permits to try to achieve faster response times. These outside consultant reviews can be facilitated through a project- specific reimbursement agreement, so no specific “expedited permit processing fee” needs to be added to the fee schedule for this type of review.

In addition, the Building Division is actively working on creating additional “instant permitting” processes using the existing permit tracking software system in order to help speed up review times for various straightforward permit requests (including residential re-roofs, water heater installs/replacements, and residential HVAC installs/replacements). This work was originally scheduled for completion this summer 2026; however, the implementation process has been delayed due to the recent staffing losses. Our new implementation timeline is targeting completion by the end of the 2026 calendar year.

Fee Study Update Process:

The original fee study scope of work included analyzing existing processing fees, including: 1) reviewing the full costs (with staff time estimates) to provide services; 2) identifying opportunities to consolidate, remove or add new fees; 3) identifying service areas where additional adjustments might be appropriate; and 4) developing fiscal projections based on recommended fee changes, all while comparing fees (and fee structures) against neighboring jurisdictions. The study also included interview findings from existing Building Division and Planning Division staff regarding their tasks and processes, which were folded into the final recommendations. Following completion of this analysis, the study includes recommendations to revise fee amounts, increase overall cost recovery percentages for existing services, and add 17 new fees to be more consistent with current processes, and to ensure appropriate fee collection for all aspects of service

delivery. The study included interviews with Water staff as well, covering fee-related tasks, procedures and processes, as well as regulatory requirements and these reflected in-depth analysis on the part of staff to accurately capture time and materials associated with fee-related activities.

Below is a summary of the findings and recommendations for each division, but for more details, please refer to the attached “User Fee Study, Final Report, dated August 2025,” for the full analysis and recommendations.

Building Division:

The current structure of the Building Division fees is generally in good shape as it accurately reflects services being delivered. However, twelve new fees are proposed to be added in order to better clarify the rate structure, certain fee descriptions, state-imposed fee regulations, and correct application of penalty fees.

New Building Division fees proposed to be added to the schedule include: 1) Expired Permits Less Than One Year, 2) Expired Permits Over One Year Up to Five Years, 3) Expired Permits Over Five Years, 4) Yearly Review of Qualification to be Included In Special Inspection Program, 5) Residential Solar Remove and Reinstall Existing Panels Same Location to Allow for Re-roof Under Separate Permit, 6) Commercial Solar Remove and Reinstall Existing Panels Same Location to Allow for Re-roof Under Separate Permit, 7) Residential re-roof permit (max 3 inspections) with existing solar panel removal and reinstallation same location, 8) Residential Multifamily Re-roof Permit (max 3 inspections) with Existing Solar Panel Removal and Reinstallation Same Location, 9) Electrical when Added to a Set Fee Permit, 10) Water Heater Replacement Same Location, Convert to Heat Pump (includes adding 1 Electrical Circuit), 11) Plumbing when added to a Set Fee Permit, and 12) Whole Home Fan.

Currently, the Building Division’s fee schedule only recovers approximately 59% of the division’s total costs.

Considering the work done in this division is supportive of new development within the City, staff does not believe a 100% cost recovery would be appropriate at this time as it could discourage new development proposals.

Planning Division:

Similar to the Building Division, the Planning Division's current fee structure is also generally in good shape.

However, there are five new fees that need to be added to reflect current service delivery.

New Planning fees proposed to be added to the schedule include: 1) Design Review – Minor, 2) SB-9 – Lot Split, 3) SB-9 – Two Unit Development, 4) SB-9 Lot Split and Two Unit Development, and 5) Street Vendor – Permit.

The current cost recovery rate in Planning is the lowest of the four departments included in the study, as the fee schedule currently recovers only about 44% of service being provided. This lower cost recovery rate is not unusual for Planning departments, as compared to other agencies, because a majority of planning work is conducted in support economic development activity and new development proposals, which can be heavily influenced by the local market/economy and often warrant (as a City policy) lower recovery percentages as a means to help encourage new development.

After reviewing the existing fees, staff made strategic recommendations for smaller fee increases related to small project types, mostly driven by existing homeowners or small businesses, and larger fee increases for bigger scale projects and those that have a tendency to be more sensitive or controversial, in order to recoup

more of the staff time spent on those efforts.

Water Department:

As outlined in the User Fee Study, several new fees are recommended for the Water Department to support cost recovery for development-related review activities by the Water Engineering Division. Historically, while the City has established development review fees within the Planning Division, no equivalent fees have been established for the Water Department. With the increased prioritization of development within the City, Water staff increasingly spend time reviewing and commenting on the complex water-related aspects of development proposals and development planning. Based on internal time studies, Water Engineering Division staff dedicate approximately 184 hours per month supporting development-related services. The total amount of hours reflects the equivalent of more than one full-time Water employee.

As such, the Water Department is recommending the adoption of 20 new development-related engineering fees. The adoption of these new water fees is intended to recoup the actual cost of service and ensure that development is not being subsidized by the ratepayers.

The new fees proposed to be added to the schedule include: 1) Meter Upsizing to .75 inch, 2) Development Agreement, 3) General Plan Update, 4) Minor Use Permit, 5) Accessory Dwelling Unit, 6) Planned Development, 7) Planned Development – Amendment, 8) Preliminary Review (Inside City), 9) Preliminary Review (Outside City), 10) Preliminary Review (School/Hospital), 11) Development Review – Major (Staff Level) (Large Multi-Family, Demolition), 12) Development Review – Major (PC Public Hearing), 13) Development Review – SB 35 and/or Density Bonus, 14) Development Review – Minor (Single/Multi-Family, Tenant Improvements), 15) Lot Line Adjustment, 16) Parcel Map, 17) Parcel Map Amendment, 18) Tentative Map – 5-20 lots, 19) Tentative Map – 20+ lots, and 20) Tentative Map Amendment.

These are regulatory fees that cities are allowed to charge to recover the costs of reviewing development projects. New fees are recommended to be adopted at 100% of full cost recovery due to Proposition 218 requirements. If approved, the new development fee revenue would cover the existing Water Enterprise Fund expenditure demands for water-related development work.

In addition to the new fees proposed, staff is also recommending the following Water Department fee changes to better reflect the costs of current service delivery. Ten fees are being reduced to reflect process efficiencies that reduce staff time required to deliver the fee-based service. The details on each existing fee and percent increase to the proposed new fee are in the attached report, Appendix A. Fees proposed to be updated: 1) the “Up to 1-inch Meter Set” be adjusted to $1,045; 2) “3 in Double Check Value” be adjusted to $16, 3) “6in Double Check Value” be adjusted to $32; 4) “8” Double Check Value” be adjusted to $36; 5) “10in Double Check Value” be adjusted to $41, 6) “6in Reduced Pressure” be adjusted to $33, 7) “8in Reduced Pressure” be adjusted to $39, 8) “10in Reduced Pressure” be adjusted to $42, 9) “6in Double Detector” be adjusted to $32, 10) “8in Double Detector” be adjusted to $36, and 11) “10in Double Detector” be adjusted to $41. All of these adjustments are proposed to match the full cost of delivering the services each of these fees covers.

FISCAL IMPACT
Upon City Council approval, the new fees would go into effect after 60 days.

Planning and Development Services Department: If adopted as presented, additional revenues for the Planning and Building Divisions are projected to be approximately $500,000. Overall, the Building Division's

existing fees currently recover approximately 59% of total costs associated with delivering the work provided for those fees, and the Planning Division currently recovers 44% of its costs. If this Resolution is adopted, cost recovery would increase to 62% and 55%, respectively.

Water Department: Additional revenue to the Water Enterprise Fund is projected to be $45,000. Overall, the Water Department existing fees currently recover approximately 73% of total costs associated with delivering the work provided for those fees. If staff recommendations are adopted, cost recovery would increase to 100%, estimated by MGT to add approximately $45,000 in revenue to the Water Enterprise Fund once the fee changes are fully implemented. Projected revenues for the new fees were not included by MGT, but will be tracked and baseline established for further projections going forward.

ENVIRONMENTAL REVIEW
The approval of new service fees to meet the City's operating expenses is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Sections 15273(a)(1) of the CEQA Guidelines. This action is further exempt pursuant to Section 15378(B)(4) of the CEQA Guidelines because it creates a funding mechanism that does not involve any commitment to a specific project which might result in a potentially significant environmental impact.

1 RESOLUTION NO. 26-_____ N.C.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VALLEJO AMENDING

THE MASTER FEE SCHEDULE TO ESTABLISH NEW FEES AND REVISE EXISTING

FEES FOR SERVICES PROVIDED BY THE BUILDING AND PLANNING DIVISIONS

OF THE PLANNING AND DEVELOPMENT SERVICES DEPARTMENT AND THE

WATER DEPARTMENT

WHEREAS, the City of Vallejo (“City”) is empowered to impose reasonable fees, rates, and charges for municipal services. California Government Code Section 66000 et seq. authorizes the City to adopt fees for municipal services, provided such fees do not exceed the cost to the City for providing the services. The City periodically amends and updates its Master Fee Schedule to account for the various cost increases relating to municipal programs, services and activities; and

WHEREAS, the Council of the City of Vallejo has determined that in order to continue providing effective services for the public welfare, the City must establish and revise fees for certain municipal services which accurately reflect the City’s true cost in providing such services; and

WHEREAS, the Council desires to enact some new fees and increase, decrease, remove, or leave unchanged existing fees for certain services provided by the Building and Planning Divisions of the Planning and Development Services Department and the Water Department and to include the new and revised fees in the Master Fee Schedule; and

WHEREAS, the City has conducted an extensive analysis of its services, the costs reasonably borne by the City in providing its services, the beneficiaries of such services, and the revenues produced by those paying fees and charges for such services. The City retained an independent consultant, MGT of America Consulting (“MGT”), to conduct the analysis of the departments’ services and related costs. MGT collected data and interviewed City personnel as part of that analysis and completed the Fee Study Final Report dated August 2025 (“Fee Study”). MGT has calculated each fee to recover no more than the reasonable estimated cost for providing the services for which the fees are charged; and

WHEREAS, pursuant to Government Code Sections 66014 and 66018, the specific fees to be charged for certain services must be adopted by resolution, following notice and public hearing; and

WHEREAS, on August 26, 2025, the Fee Study was posted on the City’s website, and a copy was made available for inspection during normal business hours in the Second- Floor lobby of City Hall located at 555 Santa Clara Street, in Vallejo; and

2 WHEREAS, on September 9, 2025, at the hour of 7:00 p.m. at the City Council Chambers located at 555 Santa Clara Street, Vallejo, California, the City Council of the City of Vallejo held a public hearing to consider the adoption of new and revised fees for services provided by the Building and Planning Division of the Planning and Development Services Department and the Water Department, notice of which hearing was given as required by law. During this meeting, the Council voted 7-0 to direct staff to research and provide additional information related to equity, economic development (competitive advantage), renewable energy projects, and permit expediting options; and

WHEREAS, following Council direction, staff worked with MGT and conducted additional research related to each topic, finding that a wide variety of tools and resources are available separately from the Master Fee Schedule to address concerns raised, and as such, no changes have been recommended to the Fee Study; and

WHEREAS, on July 14, 2026, at the hour of 7:00 p.m. at the City Council Chambers located at 555 Santa Clara Street, in Vallejo, California, the City Council of the City of Vallejo held a public hearing to consider the establishment of new fees and the revision of existing fees for services provided by the Building and Planning Divisions of the Planning and Development Services Department and the Water Department, notice of which hearing was given as required by law; and

WHEREAS, all persons interested and desiring to be heard at the hearing held on July 14, 2026, were given an opportunity to be heard, and all matters and things pertaining to the establishment of new fees and the revision of existing fees were fully heard and considered by the City Council.

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF

VALLEJO, CALIFORNIA, DOES HEREBY DECLARE, FIND, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. Notice of the public meeting and public hearing at which this Resolution was considered was properly given pursuant to California Government Code Sections 66016 and 66018, and all oral and written presentations made to and heard by the City Council were properly considered.

SECTION 2. The cost estimates produced by City staff and considered by the City Council in establishing fees under this Resolution are reasonable cost estimates for the provision of the Building and Planning Divisions of the Planning and Development Services Department and the Water Department services to which the fees pertain and were made available to the public under Government Code Section 66016.

SECTION 3. This City Council hereby finds and determines that based upon the data, information, analysis, oral and written documentation

Page 191 of 426 ends

3 presented to this City Council, including the Fee Study, that the rates, fees, surcharges, and charges set forth in “Exhibit A,” attached hereto and by this reference incorporated herein, do not exceed the estimated reasonable cost of providing the services for which they are levied.

SECTION 4. The rates, fees, surcharges, and charges set forth in “Exhibit A” are hereby adopted and approved as the rates, fees, surcharges, and charges for the services identified for each such rate, fee, surcharge, and/or charge.

SECTION 5. The rates, fees, and charges set forth in “Exhibit A” shall be effective 60 days after the adoption of this Resolution and shall be implemented commencing on that effective date.

SECTION 6. FLAT FEES - Where applicable, flat fees have been established for certain services where the average cost is subject to minimum fluctuation.

SECTION 7. HOURLY CHARGES - Where applicable, hourly charges shall be accumulated for development processing activities, and the applicant shall pay all such costs prior to final action on the related project or as soon thereafter as such costs may be finally determined. The payment of such costs may be a condition of approval for any such application. If payment is not received within ten days after the invoice due date, all development processing activities will be suspended until payment is received.

The applicant shall submit the additional deposit within ten days of the date of notice. If payment is not received within ten days after the notice, the City has the right to stop all development processing activities until payment is received. Any charges incurred in excess of the total deposits will be due prior to issuance of building permits. A late fee of ten percent (10%) shall be levied against delinquent development processing charges.

Page 192 of 426 ends

4 SECTION 9. REFUNDS - If the amount on deposit pursuant to Section 8 exceeds all accumulated costs at the time of the final action on subject application, the excess deposit shall be refunded to the applicant.

SECTION 10. GENERAL PLAN SURCHARGE – The General Plan Surcharge shall be five percent (5%) and shall be applied to all Building and Planning Division fees, except those fees prohibited by state law.

SECTION 11. PERMIT STREAMLINING SURCHARGE – The Permit Streamlining Surcharge shall be three percent (3%) and shall be applied to all Building and Planning Division fees, except those fees prohibited by state law.

SECTION 12. TECHNOLOGY SURCHARGE – The Technology Surcharge shall be four percent (4%) and shall be applied to all Building and Planning Division fees, except those fees prohibited by state law.

SECTION 13. Specific Building Division, Planning Division, and Water Department fees adopted under this Resolution supersede all prior like and applicable fees from any and all previous resolutions and ordinances to the extent that they are inconsistent with the fees hereby adopted. Any and all fees and resolution provisions not inconsistent with the provisions of this Resolution shall continue in full force and effect.

SECTION 14. Commencing July 1, 2027, all fees set forth “Exhibit A”, unless otherwise noted, shall be administratively revised and increased annually by a factor equal to the net change in the Building and Planning Divisions of the Planning and Development Services Department’s and Water Department’s salary and benefit costs for that fiscal year.

Such compensation

Page 193 of 426 ends

5 shall be based upon the City’s fully burdened hourly rates or costs as described in the aforementioned Fee Study.

SECTION 16. The City Manager is authorized to waive, modify or amend fees on any matter in their reasonable discretion, provided that in no event may said fees be increased.

SECTION 17. The State of California requires cities to charge state-established fees, rates, and charges, which are paid to the State. The City Council hereby directs the City Manager to incorporate such State- imposed fees, rates and charges into the Master Fee Schedule, and every year hereafter.

SECTION 21. If there are any conflicts between the fees adopted in this Resolution and the fees adopted by any prior resolution or fee schedule, the fees adopted pursuant to this Resolution shall take precedence.
