6. Lessee agrees that it shall insert the above five provisions in any lease/sublease agreement, by which said Lessee grants a right or privilege to any person, firm or corporation to render accommodations and/or services to the public on the premises herein leased.

7. Lessee will comply with pertinent statutes, Executive Orders and such rules as are promulgated to assure that no person shall, on the grounds of race, creed, color, national origin, sex, age, or handicap be excluded from participating in any activity conducted with or benefiting from Federal assistance. If the Lessee transfers its obligation to another, the transferee is obligated in the same manner as the Lessee. This provision obligates the Lessee for the period during which the property is owned, used, or possessed by the Lessee and the airport remains obligated to the Federal Aviation Administration. This provision is in addition to that required by Title VI of the Civil Rights Act of 1964.

8. Nothing in the above Provisions 6 or 7 shall be construed as granting permission or consent for the Lessee to sublease or transfer the premises leased herein.

9. The Lessee assures that it will undertake an affirmative action program as required by 14 CFR Part 152, Subpart E, to insure that no person shall on the grounds of race, creed, color, national origin, or sex be excluded from participating in any employment activities covered in 14 CFR, Part 152, Subpart E. The Lessee assures that no person shall be excluded on these grounds from participating in or receiving the services or benefits of any program or activity covered by this subpart. The Lessee assures that it will require that its covered sub-organizations provide assurance to the Authority, that they similarly will undertake affirmative action programs and that they will require assurances from their sub-organizations, as required by 14 CFR Part 152, Subpart E, to the same effect.

10. The Authority reserves the right to further develop or improve the landing area of the airport as it sees fit, regardless of the desires or view of the Lessee and without interference or hindrance.
11 The Authority reserves the right, but shall not be obligated to the Lessee to maintain and keep in repair the landing area of the airport and all publicly owned facilities of the airport, together with the right to direct and control all activities of the Lessee in this regard.

12. This Lease shall be subordinate to the provisions and requirements of any existing or future agreement between the Authority and the United States, relative to the development, operation and maintenance of the airport.

13. There is hereby reserved to the Authority, its successors and assigns, for the use and benefit of the public, a right of flight for the passage of aircraft in the airspace above the surface of the premises herein leased. This public right of flight shall include the right to cause in said airspace any noise inherent in the operation of any aircraft used for navigation or flight through the said airspace or landing at, taking off from or operation on this airport.

Page 2 of 4 ends

14. Lessee agrees to comply with the notification and review requirements covered in Part 77 of the Federal Aviation Regulations in the event future construction of building is planned for the Leased Premises, or in the event of any planned modification or alteration of any present or future building or structure situated on the Leased Premises.

15. Lessee, by accepting this Lease expressly agrees for itself, its successors and assigns that it will not erect nor permit the erection of any structure or object nor permit the growth of any tree on the land leased hereunder which would violate the obstruction height limitations as set forth in Federal Air Regulation (FAR), Part 77. In the event the aforesaid covenants are breached, the Authority reserves the right to enter upon the land leased hereunder and to remove the offending obstruction, all of which shall be at the expense of the Lessee.

16. The Lessee, by accepting this Lease, agrees for itself, its successors and assigns that it will not make use of the Leased Premises, in any manner which might interfere with the landing and taking off of aircraft from this airport or otherwise constitute a hazard. In the event the aforesaid covenant is breached, the Authority reserves the right to enter upon the premises hereby leased and causes the abatement of such interference at the expense of the Lessee.

17. It is understood that nothing herein contained shall be construed to grant or authorize the granting of an exclusive right within the meaning of Section 308a of the Federal Aviation Act of 1958, as amended.

18. This Lease and all the provision hereof shall be subject to whatever right the United States Government now has or in the future may have or acquire, affecting the control, operation, regulation and taking over of said airport or the exclusive or non-exclusive use of the airport by the United States during time of war or national emergency.

James Murawski, Airport Director

Subject:

Grant of Easement on the Southern California Logistics Airport Recommendation:

That the Southern California Logistics Airport Authority (“SCLAA”) Board of Directors:
(1) Grant a utility easement on Southern California Logistics Airport Authority property to Southern California Edison across the parcel designated as APN 0459-192-58; and
(2) Authorize the Airport Director to execute said instrument.

Fiscal Impact:

There is no fiscal impact associated with this item.

Strategic Plan Goal:

This item aligns with “Goal E Invest in Infrastructure" in the City of Victorville Strategic Plan 2023-2026; by approving this easement, Prologis will be able to complete the undergrounding of the electric power poles along their Nevada Street frontage.

Background:

Governed by the Southern California Logistics Airport Authority (“SCLAA”), the Southern California Logistics Airport (“SCLA”) is located on the former George Air Force Base (“GAFB”), operating to redevelop the GAFB for reuse by the community so as to minimize the financial impact on the community caused by the base closure. Many new and expanding businesses have been established over the years since the SCLAA began the redevelopment process, some utilizing existing buildings and infrastructure and others constructing new. When buildings are constructed or modified, the utility infrastructure supporting and/or surrounding new construction periodically needs to be upgraded or modified. As a result, utility companies need to obtain the right to use and access specific areas on the property owned by the SCLAA for the purpose of installing, modifying, and maintaining their respective infrastructure. This right to use and access a specific area is 4 1
0 6
referred to as a utility easement.

Southern California Edison (“SCE”) currently provides and distributes electrical service to certain customers connected to its 4kV electrical distribution system located at SCLA.

SCE also delivers electrical power to the Victorville Municipal Utility Service (“VMUS”) system through a 33kV interconnect with the Victor Substation. With the continued development efforts occurring off-airport, modifications to existing infrastructure are needed. This easement will be executed to allow SCE to construct and maintain its equipment that is located on SCLAA property. This construction will aid in future development efforts and ensure VMUS and SCLA area customers are provided safe and reliable power.

Discussion:

In March 2020, entitlement for the Mars Petcare facility, which included several Conditions of Approval (COA) for the development. Among these items was the requirement to underground SCE’s then existing overhead transmission lines that run across the project frontage to the east side of Nevada Avenue. This will entail relocating SCE’s electrical infrastructure to the eastside of Nevada Avenue and installing the electrical lines below ground. As SCE has existing easements for maintaining and operating their equipment at SCLA, this underground construction will necessitate a new easement for this portion of their infrastructure. Prologis completed construction of the facility and the Certificate of Occupancy was issued on September 21, 2022. The only outstanding public improvement was the utility undergrounding project which Prologis bonded for. Once the new easement is recorded, SCE will complete the utility undergrounding.

Staff recommends that Your Honorable Southern California Logistics Airport Authority Board of Directors approve the attached Grant of Easement in support of the expansion and improvement of business activities located at the SCLA.

Staff remains available for any questions or comments you may have.

Subject:

Community Swim Park Update
Recommendation:

Any action is at the discretion of the Honorable City Council.

Fiscal Impact:

There is no fiscal impact associated with this item.

Strategic Plan Goal:

A Swim Park aligns with Strategic Goal E, Invest in Infrastructure, and Strategic Goal F, Communication and Outreach. Exploring the feasibility to offer more aquatic amenities could result in additional infrastructure, activities, and opportunities for positive interaction within the community.

Background:

At the City Council meeting of June 4, 2024, it was moved by Mayor Pro Tem Harriman and unanimously approved to visit the feasibility of adding a community swimming pool on the south side of the City.

On July 16, 2024, staff presented a Preliminary Feasibility Assessment for a Community Swimming Pool for the south side of the City. Staff reported that two (2) to four (4) acres is needed for a community pool and that only two parks, Eagle Ranch and Sunset Ridge, have minimal infill opportunity for a pool; however, it is important to note this infill opportunity may not support the space needed for the related amenities and parking.

Furthermore, the Development Impact Fee and Capacity Fee Capital Improvement Plan adopted by the City Council on December 17, 2024, identifies a splash pad at Sunset Ridge, which would remove Sunset Ridge from consideration as a park with infill opportunity. The splash pad is identified as a mid-term project with an estimated completion time of four to seven years. Additionally, at the meeting of July 16, 2024, the 4 0
8 9
City Council approved placing an item on a future agenda for discussion for the possibility of purchasing property for the City of Victorville to build a swim park.

Discussion:

In June 2024, staff began discussions with the Victor Valley Union High School District (VVUHSD) to explore the option of using the pool at Silverado High School, located in the south side of the City. Unfortunately, staff from the Community Services Department have recently been informed that the pool at Silverado High School will not be available this year. The VVUHSD will be undertaking capital improvements to the pool, which means it will be under construction during the summer. Staff will communicate with the VVUHSD in early 2026 to discuss the possibility of revisiting the joint use opportunity for the following summer.

The Parks & Recreation section of the City’s approved Development Impact Fee and Capacity Fee Capital Improvement Plan (Attachment A) lists the current priorities from the Parks & Recreation Master Plan. Those priorities include the addition of a splash pad at Sunset Ridge, a sports complex (currently identified as the Old Jr. High property), and a pool complex and dog park on the west side of the city.

To accomplish a swim park on the south side of the city, the City would need to acquire land in the designated area. Since land acquisition is not currently included in the budget, an amendment to the budget for Fiscal Year 2024-25 would be required to appropriate necessary funds. Additionally, the Capital Improvement Plan would require review and possible amendment.

Staff remains available for any questions or comments.

I. PURPOSE
The intent of the Policy is to require Council Members, should they be scheduled for an event that costs the City money and fail to attend, to reimburse the City for those expenses.

II. BACKGROUND
The City Council has previously adopted City of Victorville Council Policy No. CP-24- 07 establishing an Expense Reimbursement Policy. This Policy supplements Council Policy CP-24-07 to address situations where Council Members may not be able to attend a scheduled event and to require reimbursement to the City of the cost of such event by the Council Member should the inability to attend the event be unexcused.

III. POLICY
If the City has prepaid a City Council Member’s expenses for an event and the City Council Member is unable to attend a planned trip or event, it is the City Council Member’s responsibility to:

1. Arrange for an alternate City Council Member or City Manager approved staff member to attend in the City Council Member’s absence; or

2. Ensure any prepaid and/or credit card fees are refunded within thirty (30) days of the unattended event to the City.

For any fees not fully refunded, the City Council Member shall provide the Mayor (or the Mayor Pro Tem in the event the Mayor is the official who was unable to attend the planned trip or event) with a written explanation within thirty (30) days https://victorvilleca.sharepoint.com/sites/CityClerk/Shared Documents/CityClerk/City Council/Council Policies/Council Policy Folder/Individual Policies/CP-24-08 Council Member Reimbursement Policy - Draft.docx

The Mayor or Mayor Pro Tem, as applicable, will determine whether the reason(s) given for the failure to attend complies with this policy. Such a determination may be appealed to the full membership of the City Council. A copy of the written explanation as well as the decision maker’s determination shall be filed with the City Clerk.

IV. PROCEDURES
If it is determined that the reason(s) given do not comply with this policy, the City Council Member shall promptly refund the City any un-refunded amounts. Failure of the City Council Member to provide a written explanation addressing the reason(s) he or she was unable to attend the event and/or to refund the City for any prepaid and/or credit cards fees, may , to the extent permitted by law, result in the fees being deducted from the City Council Member’s compensation, salary, or stipend, or loss of reimbursement privileges, civil penalties for misuse of public resources or restitution to the City.
