AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUDAHY ADDING CHAPTER X (NAME OF

TRANSPARENCY AND POLICY EXPECTATIONS REGARDING CONSTITUTIONAL COMPLIANCE IN
CITY-FUNDED LAW ENFORCEMENT SERVICES
WHEREAS,
The City of __________ does not employ sworn law enforcement officers and instead receives municipal law enforcement services from the Los Angeles County Sheriff’s Department pursuant to the Municipal Law Enforcement Services Agreement by and between the City and the County of Los Angeles (“County”), entered into as of June 11, 2024 for a five (5) year term (the “Municipal Law Enforcement Services Agreement”); and
WHEREAS,
Pursuant to the terms of the Municipal Law Enforcement Services Agreement, the County retains control of the rendition of services performed by officers of the Los Angeles County Sheriff’s Department, standards of performance, discipline of officers, and other matters incident to the performance of service and control of personnel, but the County shall ensure that all services are delivered in a manner consistent with the priorities, annual performance objectives, and goals established by the City;
WHEREAS,
The City Council has a fiduciary and governance responsibility to ensure that public funds used to purchase law enforcement services are expended in a manner consistent with constitutional protections, state law, and community trust; and
WHEREAS,
Law enforcement agencies are already legally obligated to uphold the United States Constitution and the California Constitution; however, cities retain authority to define policy expectations, transparency practices, and reporting frameworks related to services they fund; and
WHEREAS,
Transparency regarding federal law enforcement activity, requests for assistance, and community complaints promotes informed governance, strengthens public trust, and supports responsible contract management; and
Attachment CPage 1688 of 1692
WHEREAS,
It is hereby declared to be the policy of the City that:
A. Constitutional compliance and protection of civil rights are essential components of public safety; B. The City expects law enforcement services funded by the City to be delivered in a manner consistent with constitutional requirements and applicable law; C. Transparency and communication regarding law enforcement activities that affect community trust are necessary for responsible governance.
The City further recognizes the importance of:
A. Adherence to Fourth Amendment standards governing detention and arrest; B. Non-discrimination consistent with Equal Protection principles; C. Respect for First Amendment rights, including the lawful recording of law enforcement activity in public spaces;
D. Provision of medical care consistent with established departmental policies where force is used or injury is observed;
E. Activation and use of body-worn cameras consistent with existing Los Angeles County Sheriff’s Department policy during law enforcement encounters;
F. Documentation of use-of-force incidents consistent with existing reporting requirements.
This section is declaratory of City policy and does not create independent enforcement authority.
WHEREAS,
The City seeks to establish clear policy expectations and structured transparency mechanisms without directing law enforcement operations, disciplining individual officers, adjudicating constitutional violations, or amending the Municipal Law Enforcement Services Agreement; and
WHEREAS,
Nothing in this Ordinance is intended to amend the Municipal Law Enforcement Services Agreement nor interfere with federal or state law enforcement authority, but rather to clarify City policy expectations and enhance transparency within the scope of services funded by the City; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF __________ DOES ORDAIN AS FOLLOWS:
SECTION 1. FINDINGS
The above recitals are true and correct and are incorporated as though fully set forth herein.
SECTION 2.
The following is hereby added to Title X as Chapter X:
Section ____. This Ordinance shall be known as the Law Enforcement Services Transparency and Constitutional Compliance Ordinance.
Section ____. Purpose. The purpose of this Ordinance is to establish City priorities, objectives, and goals regarding law enforcement services in the City, City policy regarding constitutional compliance of law enforcement, and to promote transparency through the request for the inclusion of data in existing annual law enforcement service presentations to the City Council.
Section ____. Applicability and Limitations.
This Ordinance applies to law enforcement services funded by the City.
This Ordinance does not:
1. Amend the City’s existing Municipal Law Enforcement Services Agreement;
2. Impose new operational, training, supervisory, or disciplinary requirements on the Los Angeles County Sheriff’s Department;
3. Require adjudication of constitutional violations or factual determinations of misconduct; The City shall strive to incorporate in future contracts pertaining to law enforcement services in its bounds, including but not limited to future renewals and amendments of the Municipal Law Enforcement Services Agreement, constitutional and transparency obligations consistent with its values expressed in this Ordinance, such as terms requiring the collection and reporting of certain data to the City.
Section ____. Annual Law Enforcement Services Presentation – Transparency Framework.
As part of the Los Angeles County Sheriff’s Department’s existing practice of providing annual presentation of law enforcement services to the City Council, the City may request inclusion in such presentations of summary-level, aggregate information, to the extent permitted by law, regarding the preceding twelve (12) month period, including but not limited to:
A. Federal immigration enforcement activity occurring within City limits that is known to or observed by Los Angeles County Sheriff’s Department deputies assigned to the City; B. Requests for assistance from federal immigration authorities and the Los Angeles County Sheriff’s Department’s response to such requests;
C. Whether such federal immigration enforcement activities involved judicial warrants, administrative warrants, or no warrant, reported in aggregate form; D. Complaints, reports, or observations received regarding alleged excessive force or constitutional concerns related to federal immigration enforcement activity within City limits; E. Referrals made to appropriate oversight, investigative, or judicial bodies, if any.
Information provided pursuant to this Ordinance may be used by the City Council and City staff to:
A. Inform policy discussions;
B. Evaluate community safety trends;
C. Guide future law enforcement contract negotiations, renewals, amendments, funding levels, or scope of services;
D. Communicate transparently with the public regarding law enforcement services funded by the City.
Section ____. Limitations On Disclosure.
Nothing in this Ordinance shall be construed to:
A. Require disclosure of information protected by law, privilege, or confidentiality requirements; B. Compel disclosure beyond that which the Sheriff’s Department is legally authorized to share; C. Require identification of individual officers, residents, or specific cases; D. Interfere with federal or state law enforcement authority; E. Alter or supersede any provision of state or federal law.
SECTION 3. SEVERABILITY
If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance, or any part thereof is for any reason held invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause, or phrase would be subsequently declared invalid or unconstitutional.
