Notice of Exemption
To: Placer County Clerk From: City of Roseville

Project Title: Phillip Road – Westpark Drive Bikeway Project Project Location(s): Phillip Road between Westpark Drive, through the Placer Valley Soccer Complex to Westbrook Boulevard.

Project Description: The Public Works Department is proposing the approval and construction of a new bicycle route between Westpark High School and the Placer Valley Soccer Complex. Two segments of the bike path, through Pistachio Park and within the existing right-of-way of Westpark Drive, have already been analyzed and approved by the City Council. This action proposes a new segment to the approved bike path that would connect Westpark Drive to Westbrook Boulevard at its intersection with Brookstone Drive via Phillip Road and through the Placer Valley Soccer Complex.

This newly proposed segment would add shared lane markings on Phillip Road and the existing access road located within the Placer Valley Soccer Complex. A portion of the bike path would use the existing paths within the soccer complex. The shared lane markings would end at the intersection of Phillip Road and Westpark Drive, where two new crosswalks and bike refuge zones would be added. The bike refuge zones would provide an entrance to the approved bike path along Westpark Drive.

Retaining structures would be constructed at the northwest, southwest, and southeast corners of the Phillip Road and Westpark Drive intersection to support the crosswalks and bike refuge zones.

Public Agency Approving Project: Roseville City Council Agency/Individual Carrying Out Project: City of Roseville Public Works Department Reason why this Project is Exempt: The project qualifies for Class 1 and Class 4 Categorical Exemptions as described in Sections 15301 and 15304 of the California Environmental Quality Act (CEQA) guidelines which state:
“Class 1 consists of the…minor alteration of existing public…facilities…or topographical features, involving negligible or no expansion of existing or former use… Examples include but are not limited to:
(c) Existing highways and streets, sidewalks, gutter, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety), and other alterations such as the addition of bicycle facilities, including but not limited to bicycle parking, bicycle-share facilities and bicycle lanes, transit improvements such as bus lanes, pedestrian crossings, street trees, and other similar alterations that do not create additional automobile lanes.” And

Page 1981 of 3513 ends

“Class 4 consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees… Examples include, but are not limited to:
(a) Grading on land with a slope of less than 10 percent…” The project consists of the addition of a new bicycle facility and bicycle/pedestrian crossings that use existing rights-of-way and do not create additional automobile lanes, consistent with the Class 1 Categorical Exemption. The project would also add three retaining structures at corners of the intersection of Philip Road and Westpark Drive, which would not result in the removal of healthy or mature trees, consistent with the Class 4 Categorical Exemption. The project would not result in expansion of automobile capacity or use or removal of trees. Therefore, the Class 1 and Class 4 Categorical Exemptions apply.

Title: Underground Storage Supplement – Professional Services Agreement Contact: Janice Gainey 916-774-5535 [email protected]

SUMMARY
Staff recommends approval and award of a professional services agreement to GEI Consultants, Inc. in the amount of $284,277 for Development of an Underground Storage Supplement to Support Long-Term Banking of Middle Fork Project Water Supplies. Funding for this project is from the Water Operations Fund.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution to approve a Professional Services Agreement with GEI Consultants, Inc., and authorize the City Manager to execute it on behalf of the City of Roseville.

BACKGROUND
The City of Roseville provides water service to a growing and diverse community and maintains a diversified water supply portfolio that includes:
• Central Valley Project (CVP) surface water via a water supply contract with the Bureau of Reclamation.
• Middle Fork Project (MFP) surface water obtained through a water supply contract with Placer County Water Agency (PCWA).
• A well-established Aquifer Storage and Recovery (ASR) Program.

PCWA holds the underlying water rights for the Middle Fork Project. Any effort to store, bank, account for, or recover MFP water through an Underground Storage Supplement will require ongoing coordination and collaboration with PCWA, including alignment on regulatory pathways, accounting approaches, and operational concepts.

To further strengthen long-term water resilience, particularly in light of climate change and hydrologic variability, the City seeks to develop an Underground Storage Supplement (USS) that allows for:
• Long-term banking of MFP water supplies
• Expanded use of existing and planned ASR infrastructure • Enhanced multi-year storage and recovery capabilities • Improved drought protection and operational flexibility

Page 1983 of 3513 ends

The USS is envisioned as a complementary strategy to the City’s ASR program and broader conjunctive use operations, potentially involving new regulatory pathways, accounting frameworks, institutional arrangements, and operational strategies developed in coordination with PCWA.

On April 3, 2026, the City issued a Request for Proposals for Professional Services seeking a qualified consulting team to develop a regulatory-ready and implementation-focused USS. On April 16, 2026, three (3) firms proposed on the Project. The proposals were evaluated by a panel including Environmental Utilities Department staff and PCWA staff. The panel ranked each firm based on the criteria specified in the Request for Proposals (RFP) No. 08-182. The panel shortlisted two consultants and after interviews selected GEI Consultants, Inc. for the award.

FISCAL IMPACT
The total project budget needed for the Development of an Underground Storage Supplement (USS) to Support Long-Term Banking of Middle Fork Project (MFP) Water Supplies is $284,277 and will be funded through existing budget appropriations within the Water Operations Fund.

ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) only applies to projects which have the potential to cause a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. (CEQA Guidelines §15061(b)(3)).

Policies containing any SIR provision shall provide or be endorsed to provide that the SIR may be satisfied by either the named insured or CITY. CITY reserves the right to obtain a full certified copy of any insurance policy and endorsements. The failure to exercise this right shall not constitute a waiver of such right.
g. Waiver of Subrogation. CONSULTANT hereby agrees to waive subrogation which any insurer of CONSULTANT may acquire from CONSULTANT by virtue of the payment of any loss under a Workers Compensation, Commercial General Liability or Automobile Liability policy. GEI CONSULTANTS | 10
CITY OF ROSEVILLE | UNDERGROUND STORAGE SUPPLEMENT (RFP 08-182) Our approach is designed to move the USS from its initial concept into a framework ready for regulation and implementation, with ongoing coordination between the City and PCWA. Each step logically follows the previous one, ensuring that regulatory, technical, operational, and institutional aspects are aligned and support each other. The upper portion of Figure 2 illustrates the progress the City has made in developing the ASR Program since the early 2000s, highlighting how the City’s ASR program not only benefits local water supply but also supports the broader region. The groundwater and surface water projects identified in Figure 2 were completed by GEI team members and highlight our unique expertise and experience for advancing the City’s USS project. During Task 1 (Initiation and Data Review), GEI will assemble and review the available data and information our files to establish the foundational information needed for this project. We will then hold early meetings with PCWA and the City to identify any additional information needed for the USS process with the State Board, including operational frameworks of the ASR program.

GEI will then expand the project concept during Tasks 2, 3, and 4 by providing technical support, developing a water accounting strategy, and documenting this in a Draft USS Project Description. This draft will include a permitting strategy and supporting graphics, first reviewed by the City and then by PCWA. After receiving comments, a second meeting with the City and PCWA will address any final changes before finalizing the USS Project Description. Once the City and PCWA agree on the draft, it will be used to effectively communicate the project's objectives to regional regulators and stakeholders, including SWRCB, RWA, USBR, NASb GSAs, and the Water Forum.

GEI will assist the City in arranging meetings with these and other potential agencies and stakeholders to both educate and gather feedback. Input from regulators and interested parties may lead to changes in the USS Project Description and GEI will work with the City to determine if any changes could benefit the City’s long-term interests. It is anticipated that minor improvements will be made as the USS Project Description is finalized. Once complete, GEI will support the City in accomplishing Task 5, which outlines a clear path for water rights compliance with the SWRCB and any necessary actions, agreements, or contract amendments. The goal is to ensure the City can fully utilize their ASR infrastructure with maximum flexibility and in accordance with all applicable regional, State, and Federal requirements and agreements.

Tasks and subtask descriptions are organized by overall task objective, discussion of approach methodology and rationale, listing of subtasks required for completion of task, description of task deliverable(s) and a list of GEI assumptions for cost estimating.

Task 1 – Project Initiation and Data Review
OBJECTIVE: Establish a clear project foundation, confirm goals and assumptions, and align roles, decision criteria, and coordination protocols with the City and PCWA.

DISCUSSION: GEI will support the City in achieving the task objective by compiling and reviewing information, organizing and leading a project kick off meeting with PCWA midway into our review of existing information and in close coordination with City staff. This early coordination with PCWA will be used to confirm expectations related to water rights administration, accounting considerations, and regulatory pathways. During this early coordination period, GEI will also help establish the number and purpose of meetings with PCWA throughout the completion of this project. GEI will document all meetings by providing agendas at least one week before each meeting followed by summaries of key outcomes and action items within 24 hours following each meeting. GEI will provide both a project management plan and data review memorandum as deliverables for this task. It should be noted that GEI already has much of the information that we believe is needed to complete this project because we completed a comprehensive data compilation and review process in 2018-2020 for the GwSP. In fact, our Technical Memorandum No. 1 was a data review memorandum summarizing all information reviewed and how we intended to use each data source in the GwSP. This TM summarizes the many planning documents, contracts, agreements, and hydrogeologic and groundwater information already organized and available to GEI for use in completing this new project.

SUBTASKS:

Subtask 1.1 Project Kick Off Meetings: Conduct an initial project kickoff meeting with City staff for the purpose of introducing and orienting all project staff, to review objectives and approach to completing the work and to plan for a second kickoff meeting with PCWA. The purpose of the meeting with PCWA is to confirm objectives, scope, and expectations, TAB D: PROPOSED APPROACH

GEI CONSULTANTS | 11
CITY OF ROSEVILLE | UNDERGROUND STORAGE SUPPLEMENT (RFP 08-182) identify key decision points, and agree on number and frequency of project coordination meetings during completion of this project.

Subtask 1.2 Data Compilation and Review: Review relevant background materials, including ASR permits and operational history, MFP and CVP contracts, and applicable PCWA planning or policy documents. GEI will provide the City with a request for information above and beyond what GEI has already compiled for the GwSP which will include the following as a minimum:
• Regional Water Authority’s most current COSANA Model files used for groundwater modeling in the North American Subbasin for the GSP and 2027 update.
• All relevant communication with PCWA regarding water rights actions required for the City to inject and store MFP water in the underlying aquifer.
• Summaries of any communication with City staff have had with SWRCB staff regarding USS and water rights permitting vehicles for the City’s injection and storage of MFP water. • Most recent water demand estimates above and beyond those provided in most recent planning documents, which GEI has in-house but we need to verify this is the best demand information available.

Subtask 1.3 Project Management Plan (PMP): This document will include the final negotiated scope of work and project schedule but will also identify key assumptions, decision points, and information gaps that need to be filled early in the project. The PMP will provide a structured approach for coordination with PCWA that supports transparency, timely review, and alignment throughout the project. Furthermore, the PMP will present purpose and intended outcomes of each project meeting between GEI and the City, with PCWA, SWRCB and other agencies such as USBR, RWA and Water Forum. This document will be the roadmap for both GEI and City staff to follow toward successful completion of this project.

Subtask 1.4 Data Review Memorandum: This memorandum will list all the data and information resources compiled for use in completing the USS project. This memorandum will include a data table listing all information resources and how this information will be used to inform specific project tasks. The memorandum will be provided early for the project so that GEI and the City are both confident that we are using best information available for completion of this important project for the City.

DELIVERABLES:
• Draft and Final Project Management Plan
• Draft and Final Data Review Memorandum, including proposed PCWA coordination approach ASSUMPTIONS:
• One 90-minute kick-off meeting with City staff at the City’s office including GEI’s Project Manager and Principal-in-Charge, and key discipline leads.
• One 90-minute kick-off meeting with PCWA and City staff at PCWA’s office also including GEI’s Project Manager, Principalin-Charge, and key discipline leads. • Requests for information by GEI will be provided by City staff within 2 weeks. • GEI will be provided with a single set of review comments by the City on each draft deliverable within 2 weeks of GEI submitting review drafts to the City.

Task 2 – Regulatory and Institutional Framework Assessment OBJECTIVE: Identify and evaluate feasible regulatory, legal, and institutional pathways for establishing a USS associated with MFP supplies.

DISCUSSION: GEI will develop a Regulatory and Institutional Framework for the City’s ASR program that results in compliance with all applicable local, State and Federal regulations, agreements, and policies. This activity will involve a combination of applying GEI’s knowledge of recharge and the regional setting with research evaluating applicable California Water Code, State Board and SGMA requirements including verification of understanding and approaches with local, regional and state agency representatives. Since the objective is to create a Framework, frequent meetings with regulatory agencies are not expected. However, it may be necessary to reach out to agency representatives to confirm requirements and strategies for permitting and compliance. Regulatory concepts and institutional frameworks will be discussed with City staff and PCWA to confirm feasibility and alignment before contacting others if needed.

GEI CONSULTANTS | 12
CITY OF ROSEVILLE | UNDERGROUND STORAGE SUPPLEMENT (RFP 08-182) SUBTASKS:

Subtask 2.1 Regulatory Evaluation: GEI will identify applicable State and Federal regulatory requirements, including considerations under the California Water Code (such as pending AB2026), SWRCB processes, and SGMA requirements. For the completion of this subtask, GEI will review Water Code Divisions addressing water rights, storage, and groundwater authority, including:
• Division 2 – Water (Sections 1000–5951)
• Division 6 – Conservation, Development, and Utilization of State Water Resources (Sections 10000–12999)
• Division 14 – California Water Storage District Law (Sections 39000–48401)
• Water Code §1242 and §1242.1, which authorize flood-flow diversions for recharge under newly expanded authority.

GEI will also research and document SWRCB’s water rights and recharge permitting process which typically includes either a Temporary or Long-Term permit for underground storage. In the case of the City, we will verify that completion and filing of the USS is the only action required for a permit by SWRCB.

GEI will also outline the requirements of SGMA in basin in the vicinity of and including the City. GEI developed the GSP for the NASb so we are well aware of these requirements but because SGA and the GSAs are currently in the process of evaluating the adequacy of the GSP as part of the 5-year update process, we will verify that our understanding is correct. Then as part of this we will document how the City’s ASR program integrates with the GSP showing how recharge supports the sustainability indicators (e.g., water levels, subsidence, water quality).

Subtask 2.2 Evaluation of Linkages with Existing Permits: GEI will evaluate how a USS will complement or expand upon the City’s existing ASR permits. GEI will evaluate the need to update or modify any existing permits including their permit with the Central Valley Regional Water Board through the ASR General Order as well as their permit to serve drinking water through the Division of Drinking Water through the SWRCB.

Subtask 2.3 Governance and Institutional Evaluation: Assess institutional and governance considerations, including the role of PCWA as the MFP water rights holder, accounting and ownership frameworks, and inter-agency coordination requirements. Identify potential agreements, amendments, or coordination mechanisms needed to support USS implementation.

Subtask 2.4 Regulatory and Institutional Framework Memorandum: GEI will deliver a concise framework document that provides step by step actions for achieving regulatory compliance, an example of which may include:
• Map all applicable Water Code provisions, especially those related to water rights and flood-flow recharge authority. • Determine the appropriate SWRCB permitting pathway, USS versus temporary or long-term permits. • Coordinate early with the Division of Water Rights, the local GSA and RWA to ensure consistency with the GSP and Sacramento Regional Water Bank.
• Prepare technical documentation, including:
o Water availability analysis.
o Demonstration of no-injury to other water users.
o Monitoring and accounting plans consistent with SGMA BMPs. o Likely not needed since the City completed an Environmental Impact Report for your ASR program, but it needed complete CEQA review to ensure alignment with statewide recharge guidance.

DELIVERABLE:
• Draft Regulatory and Institutional Framework Memorandum. Comments received on the draft will be incorporated in the Implementation Roadmap developed in Task 5.

GEI staff have been supporting the City with ASR General Order Compliance since 2021.

GEI CONSULTANTS | 13
CITY OF ROSEVILLE | UNDERGROUND STORAGE SUPPLEMENT (RFP 08-182) ASSUMPTIONS:
• This task is a desk top study and will not involve meetings with regulatory agencies per se however, GEI may contact agencies representatives to verify our understanding of specific regulatory or institutional requirements.

Task 3 – Technical and Hydrogeologic Evaluation
OBJECTIVE: Evaluate the technical feasibility of supporting USS objectives of local storage of MFP water using existing and planned ASR infrastructure.

DISCUSSION: Much of the supporting information can be drawn from the GwSP itself or supporting information compiled for that strategic planning effort completed in May of 2020. Relevant GwSP information includes:
• Water Supply and Demand Evaluation.
• Recharge Evaluation including calculation of aquifer storage potential. • Groundwater Infrastructure Evaluation including well assessment, identification of interties, water quality. evaluations, regional and local pumping impacts on groundwater levels, and design recommendations for future ASR wells and cost estimates.

GEI is also supporting the City with reporting required in compliance with the City’s ASR General Order adopted by the Central Valley Regional Water Quality Control Board in 2012. The information contained in the Annual Reports and supporting Data Management System will be utilized by GEI in completion of this task. GEI will provide the supporting technical information required by the State Board for the USS.

GEI’s approach to completing this task begins with reaching a common understanding with PCWA on timing and volume of available MFP water for aquifer storage in the City, a water availability analysis. We will then verify that groundwater storage capacity exists for storage of both MFP water and CVP water currently utilized by the City for their ASR program. Then we will evaluate the number, location, injection, and extraction capacity of existing and planned ASR wells to be sure they are adequate for operating in a pattern consistent with both available water and the USS and other potential State Board requirements. Next, we will evaluate aquifer impacts resulting from the operation pattern developed above including groundwater level, groundwater quality and changes in groundwater flow patterns and rates of groundwater flow. GEI will identify any potential constraints through a range of likely operational scenarios to be sure permit and regulatory standards are not violated. This analysis will also reveal the range of storage capacity in the basin which will be useful in water planning to ensure both local supply reliability with potential for participating in future transfers and exchanges to generate revenue to offset the City’s cost to operate the maintain the ASR program. In addition to maximizing use of empirical groundwater data and analytical approaches to characterizing current and future aquifer and well impacts, GEI has included an optional task to perform numerical groundwater modeling which may reduce the uncertainty in our future forecasts. Technical assumptions and findings will be reviewed with City staff to ensure consistency with existing ASR operations and groundwater management practices.

SUBTASKS:

Subtask 3.1 Surface Water Availability Analysis: The GEI Team will support the quantification of timing and availability of MFP water for use in the City’s ASR program. This analysis would include the integration of both CVP and MFP water in the ASR program along with existing demands being served by the same infrastructure. PCWA serves its retail customers and contractors with surface water from its MFP supply and Bureau of Reclamation CVP contract supply. As part of the support provided to PCWA for its ongoing water rights extension, Western Hydrologics adapted its model called the American River Integrated Operations model (ARIOps) to incorporate Amendment 1 to the Contract between PCWA and the City relating to water supplies and exchanges. ARIOps is run on a daily timestep for water years 1922 through 2021 and can use both the historic hydrology and the CalSim3 2023 Central tendency hydrology. This time period covers a wide range of hydrologic conditions. Assuming PCWA will allow the City access to this work, the model assumptions will be reviewed, and any adjustments will be made to the model, if necessary. The model will then be executed and water supply deliveries to the City can be extracted from the output. Model results will provide information to the City about the long-term water supply reliability.

Our experience with the
City’s ASR program will
allow us to identify any
potential constraints.

GEI CONSULTANTS | 14
CITY OF ROSEVILLE | UNDERGROUND STORAGE SUPPLEMENT (RFP 08-182) Subtask 3.2 Infrastructure Assessment: GEI will assess the suitability of current and planned ASR facilities for long-term storage and recovery associated with the USS. GEI will use results of the water supply availability analysis completed in Task 3.1 to inform the volume and timing water availability for injection into aquifer storage. GEI will work with the City to develop the optimal storage volume and duration of storage given agreed upon criteria such as hydrologic year type, current and future water demand in the City. Once the optimal range of ASR operations is agreed to with the City, GEI will evaluate the adequacy of the City’s current and planned number and location of ASR wells and the feasibility of this infrastructure in meeting the City’s ASR objectives for both water resiliency and banking to meet local needs and potentially as a revenue generation source through transfers and exchanges.

Subtask 3.3 Aquifer Impact Analysis: GEI will evaluate groundwater impacts and sustainability considerations in coordination with applicable groundwater management frameworks. GEI will evaluate how operation of the ASR program changes groundwater levels in the representative monitoring wells established in the NASb GSA. GEI will compare projected water level changes in the proposed operation of the ASR program against minimum thresholds established in these wells located in and near Roseville. To remain in compliance with SGMA, the ASR program will need to be operated to ensure that groundwater levels in and near the ASR well field always remain safely above the representative monitoring wells in and near Roseville. GEI will work with the City to develop ASR operation plan that achieves this goal.

In addition, GEI will utilize information obtained from the 6-month injection cycle currently in progress with 3,200 acre feet stored through mid-April and planned to continue until June 2026. This empirical data set is an excellent source of information on the impact of long-term injection and storage of surface water in groundwater levels and water quality within the Mehrten Formation beneath Roseville and the surrounding area. GEI will quantify the mounding of groundwater that occurred during this injection cycle and calculate aquifer hydraulic properties including transmissivity and storativity utilizing groundwater changes in response to the recovery of groundwater levels in and near the injection wells following the end of the 6-month injection cycle. GEI will then calculate changes in groundwater flow rates that occur as the local groundwater mound grows in response to extended injection periods. This information will be used to calculate changes in groundwater flux rates (losses) outside the city boundaries. Using this information, GEI will work with the City in agreeing on the optimal operation range of water levels during ASR operation to maximize storage and minimize losses.

Subtask 3.4 Water Quality Evaluation: GEI will review water quality considerations related to long-term storage and recovery.

GEI has a large data set of historic groundwater quality information built up over the many years that GEI has been assisting the City in complying with the ASR General Order. The quarterly and annual reports demonstrating compliance with the Monitoring and Reporting Plan have been developed by GEI and the City for delivery to the CVRQCB for verification of water quality compliance. GEI has developed and maintains chemographs showing water quality changes for general chemistry constituents over time. GEI will add to this baseline of historic water quality data, the new water quality data obtained during the ongoing 6-month injection cycle ending in June 2026. GEI will highlight changes in water quality that have occurred and identify both water quality improvements as well as degradation that may have occurred during the 6-month ASR cycle. This empirical information will be used by GEI to predict water quality changes that will likely occur based on optimal ASR operation program established in the tasks above.

Subtask 3.5 Opportunity, Constraint and Risk Analysis: Identification of technical constraints, risks, and opportunities is an important step is developing a sustainable ASR operation framework that complies with local, regional, State, and Federal regulations, policies, and guidance. This information will be used to develop the operational and accounting framework described in Task 4. Table 2 in project understanding is an initial listing of GEI’s understanding of potential project challenges, GEI’s mitigation approach to maximize beneficial outcomes and create opportunities for the City’s success. GEI will work with the City to build this table out through completion of this task.

Subtask 3.6 Complete the Draft USS: GEI will complete the USS form with the technical information required. Table 1 in project understanding outlines the USS required information and the likely sources of information to be used by GEI in completing the form.

GEI staff have significant handson experience supporting the City with well design, construction,
and testing services.

Page 2004 of 3513 ends

GEI CONSULTANTS | 15
CITY OF ROSEVILLE | UNDERGROUND STORAGE SUPPLEMENT (RFP 08-182) GEI will compile and review this information from the sources proposed in Table 3 and other sources to be identified by GEI and the City during completion of this task.

Optional Subtask 3.7 Groundwater Modeling: GEI believes that the existing groundwater modeling results, developed using the CoSANA Model for the GSP completed by GEI in 2020, can effectively support the analysis required for this proposal.

Additionally, significant groundwater modeling has been conducted under RWA’s contracts to meet SGMA requirements for the NASb and to assess losses related to the Sacramento Regional Water Bank. GEI considers this previous modeling to be adequate for the work described in this proposal.

This optional groundwater modeling task is included for two main reasons:

1. The City or PCWA may prefer to have technical information provided to the State Board through the USS process further supported by additional modeling of future ASR operations, utilizing either the SRM or COSANA models.

2. The City may wish to conduct its own groundwater modeling to optimize ASR operations both currently and in response to potential future changes in conditions.

If the City chooses to proceed with this option, GEI will provide comprehensive groundwater modeling services as needed. • Model step up and adjustment of aquifer parameters to match those to be measured during the recovery portion of the ongoing 6-month 2026 injection cycle schedule to end in June 2026. • Development of up to three modeling scenarios as agreed upon by the City with potential input from PCWA and RWA • Review and document model application and results
DELIVERABLE:
• Draft Technical Feasibility Memorandum including the completed draft USS form. Comments received on the draft will be incorporated in the Implementation Roadmap developed in Task 5.

ASSUMPTIONS:
• Review and assessment of aquifer impacts resulting from 6-month 2026 injection cycle will inform this task. • Bullet 1 above and review of existing model applications in Roseville and the region will inform in sufficient detail of future predictions of aquifer impact resulting for ASR operations under the USS. • Water quality evaluations in the task will primarily be informed from the following three information sources: 1) Previous ASR pilot testing and injections episodes, 2) Quarterly and Annual Reports for ASR Permit compliance with RWQCB, and 3) Results of 6-month 2026 Injection cycle involving all wells.

Task 4 – Operational and Accounting Framework Development OBJECTIVE: Develop practical operational and accounting concepts that support long-term water banking while remaining consistent with PCWA requirements.

DISCUSSION: Building on prior tasks, Task 4 involves the development of detailed operational protocols and accounting methodologies that will underpin USS water banking, storage, and extraction activities. GEI will define triggers and metrics for water recovery during droughts, emergencies, or multi-year operations. Methodologies for banking, tracking, and allocating stored water will be developed using scenario planning, quantitative modeling, and benchmarking against regional best practices. Models for integration with CVP, ASR, and other conjunctive use operations will be refined in joint technical sessions with City and PCWA teams to confirm technical and institutional viability.

Special attention will be given to aligning these operational and accounting frameworks with PCWA’s water rights administration and reporting practices. Draft concepts will be socialized for review and collaborative refinement through structured meetings and workshops with PCWA and City staff. Deliverables will include the USS Operations and Accounting

Title: Substation Transformer Civil Construction - Construction Agreement Contact: David Angel Jimenez 916-774-5698 [email protected]

SUMMARY
Staff recommends approval of a construction agreement with Arrow Driller Inc. dba Arrow Construction in the amount of $379,100 to provide civil construction services at Fiddyment and Sierra Vista Substations for the installation of substation transformers. Staff additionally requests authorization for the City Manager or designee to approve and pay for contract change orders that could increase the contract amount by no more than 10%, or $37,910, for a total not to exceed $417,010. Funding is included in the Electric Department's FY2025-26 budget in the Electric Fund.

RECOMMENDATION
Staff recommends that the City Council adopt a resolution to approve a Construction Agreement with Arrow Driller Inc. dba Arrow Construction for the Substation Transformer Civil Construction project and authorize the City Manager to execute it on behalf of the City of Roseville.

In addition, staff recommends that the City Council authorize the City Manager, or designee, to approve change orders for the project, consistent with the contract terms, provided that the net cost of all change orders shall not exceed ten percent (10%) of the contract price.

BACKGROUND
The construction works at Fiddyment Substation and Sierra Vista Substation are required to site new substation transformers. A new concrete foundation at Fiddyment Substation will be constructed to site a new spare substation transformer. It will be used in the event of failure elsewhere in the system or to allow Roseville Electric to be more responsive to new development when a new substation is required to be constructed, as current transformer lead times are in excess of three years. At Sierra Vista Substation, expansion of the containment pit is necessary to meet substation transformer oil spill containment requirements. The oil containment currently in place was designed for a different transformer design; the transformer purchased for this installation has approximately 2,000 gallons more oil than the containment was designed to accommodate. When Sierra Vista Substation was initially constructed, the second transformer was not required, but all necessary appurtenances were installed to facilitate this installation.

The City Council approved the plans and specifications and authorized the call for bids at the March 4, 2026, meeting. Subsequently, Roseville Electric solicited bids through Request for Quotations 07-126 Substation Transformer Civil Construction, seeking a contractor to provide the necessary construction services. Staff received four bids, which were opened on April 22, 2026. After staff review of the bids, Arrow Construction was determined to be the lowest responsive bidder.

FISCAL IMPACT
The fiscal impact of the agreement with Arrow Driller Inc. dba Arrow Construction is $379,100 with a 10%,

Page 2014 of 3513 ends

or $37,910, contingency not to exceed $417,010. Funds are available in the Electric Department's FY2025-26 budget in the Electric Fund.

ENVIRONMENTAL REVIEW
The proposed project involves the minor alteration of an existing facility. This activity is categorically exempt from CEQA as a Class 1 Exemption (State CEQA Guidelines Section 15301). The Exemption has been prepared and no further CEQA action is required.

Project Title: Spare Substation Transformer Project
Project Location(s): Sierra Vista Substation, 1550 Westbrook Boulevard (APN 499-010-063-000) and Fiddyment Substation, 6821 Fiddyment Road (APN 478-440-004-000), Roseville, CA 95747.

Project Description: Roseville Electric is proposing to make improvements to the Sierra Vista Substation and Fiddyment Substation to support enhanced reliability of the existing power supply.

The project would expand the substation transformer containment pit at Sierra Vista Substation to meet transformer oil containment requirements. At the Fiddyment Substation, the project would also add a new concrete pad to site a new spare transformer used only to support reliability of the existing power supply and would not result in an expansion of use or capacity. All proposed improvements would be sited entirely within the substation parcels.

Public Agency Approving Project: Roseville City Council Agency/Individual Carrying Out Project: Roseville Electric Utility Reason why this Project is Exempt: The project qualifies for a Class 1 Categorical Exemption as described in Section 15301 of the California Environmental Quality Act (CEQA) guidelines which states:
“Class 1 consists of the…minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use… Examples include, but are not limited to: (a) Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances; [and] (b) Existing facilities of both investor and publicly owned utilities used to provide electrical power, natural gas, sewerage, or other public utility services…” The project consists of expanding the containment pit at the Sierra Vista Substation to meet oil containment requirements and the addition of a new concrete pad and spare transformer, to the Fiddyment Substation. The project would not result in expansion of use or capacity. Consequently, the Class 1 Categorical Exemption applies.

Title: Confined Space Rescue Services - Contract Purchase Agreements Contact: Drew Yarbrough 916-746-1656 [email protected]

SUMMARY
Staff recommends approval of two, five-year contract purchase agreements for on-call confined space rescue services: one with Pro Safety & Rescue, Inc. (PSR) with a not-to-exceed amount of $500,000, and one with Hazardous Materials Institute LLC, doing business as California Safety Training (CST) with a notto-exceed amount of $250,000. These two contracts will provide Roseville Electric Utility with support for confined space rescue services during maintenance activities at Roseville's power plants. Funding for the first year of the agreements in the amount of $100,000 for PSR and $50,000 for CST is included in the Electric Department's proposed FY2026-27 budget in the Electric Fund. Future funding is subject to the City Council's approval of the respective budgets.

RECOMMENDATION
Staff recommends that the City Council adopt two resolutions authorizing the City Manager to execute Contract Purchase Agreement (3005283) with Pro Safety & Rescue, Inc. and Contract Purchase Agreement (3005298) with Hazardous Materials Institute LLC, doing business as California Safety Training for on-call confined space rescue services.

BACKGROUND
The City owns and operates three power plants. The facilities require maintenance to heat recovery steam generators, tanks, pressure vessels and other equipment that necessitates confined space entry.

California OSHA requires all confined space entries have rescue services onsite to perform life-saving rescue and extrication in case emergency conditions develop in the space.

Roseville Electric Utility solicited proposals through Request for Proposal No. 07-117 Generation Confined Space Rescue Services for the three power plants. Two vendor proposals were received and evaluated based on qualifications of firm and team, experience, references, project understanding and plan, and required documents. The evaluation team reviewed and scored the vendor proposals, selecting both Pro Safety & Rescue, Inc (PSR) and Hazardous Materials Institute LLC, doing business as California Safety Training (CST) as the firms to provide the requested scope of services as they both scored high across these criteria. Two firms were selected due to the critical nature of the services to help ensure availability of support during power plant maintenance activities.

FISCAL IMPACT
The cost of the agreement with PSR will not exceed $500,000. The cost of the agreement with CST will not

Page 2062 of 3513 ends

exceed $250,000 for a total not-to-exceed amount of $750,000 over a five-year period. Funding for the first year of the agreements in the amount of $100,000 for PSR and $50,000 for CST is included in the Electric Department's proposed FY2026-27 budget in the Electric Fund. Future funding is subject to the City Council's approval of the respective budgets.

ENVIRONMENTAL REVIEW
The California Environmental Quality Act (CEQA) only applies to projects which have the potential to cause a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA (CEQA Guidelines §15061(b)(3)). The approval of the two contract purchase agreements for confined space rescue services meets that criteria. No additional CEQA review is required.

7. All equipment, supplies and services sold to the City of Roseville shall conform to the general safety orders of the State of California.

8. Unless notified to the contrary, in writing, the City assumes that the Contractor has accepted the work in accordance with the plans and specifications (if any) and agrees to do the work in compliance with this Agreement.

9. All fair employment practices must be adhered to. In addition, if the project referenced on this service agreement is a Public Works project, all prevailing wage laws must be complied with. For prevailing wage contracts over $25,000, copies of certified payroll must be submitted with invoices. Prevailing wage rates may be obtained from the State Department of Industrial Relations and/or the following website address: http://www.dir. ca.gov/dlsr/DPreWageDetermination.htm. coverage.
b. Form. Contractor shall submit a certificate evidencing such coverage for the period covered by this Agreement in a form satisfactory to Risk Management and the City Attorney, prior to undertaking any work hereunder. Any insurance written on a claims made basis is subject to the approval of Risk Management and the City Attorney.
c. Additional Insureds. Contractor shall also provide a separate endorsement or section of the policy showing City, its officers, agents, employees, and volunteers as additional insureds for each type of coverage, except for Workers' Compensation. Such insurance shall specifically cover the contractual liability of Contractor. The additional insured coverage under the Contractor's policy shall be primary and noncontributory, as evidenced by a separate endorsement or section of the policy, and shall not seek contribution from City's insurance or self-insurance. In addition, the additional insured coverage shall be at least as broad as the Insurance Services Office (ISO) CG 20 01 Endorsement. Any available insurance proceeds in excess of the specified minimum insurance coverage requirements and limits shall be available to the additional insureds.

Furthermore, the requirements for coverage and limits shall be:
(1) the minimum coverage and limits specified in this Agreement; or (2) the full coverage and maximum limits of any insurance proceeds available to the named insureds, whichever is greater.
d. Cancellation/Modification. Contractor shall provide thirty (30) days written notice to City prior to cancellation or modification of any insurance required by this Agreement.
e. Umbrella/Excess Insurance. The limits of insurance required in this Agreement may be satisfied by a combination of primary and excess insurance. Any excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on a primary and noncontributory basis for the benefit of City (if agreed to in a written contract) before City's own insurance shall be called upon to protect it as a named insured.
f. Subcontractors. Contractor agrees to include in its contracts with all subcontractors the same requirements and provisions of this Agreement, including the indemnity and insurance requirements, to the extent they apply to the scope of the subcontractor's work. Furthermore, Contractor shall require its subcontractors to agree to be bound to Contractor and City in the same manner and to the same extent as Contractor is bound to City under this Agreement.

Additionally, Contractor shall obligate its subcontractors to comply with these same provisions with respect to any tertiary subcontractor, regardless of tier. A copy of City's indemnity and insurance provisions will be furnished to the subcontractor or tertiary subcontractor upon request.
g. Self-Insured Retentions. All self-insured retentions (SIR) must be disclosed to Risk Management for approval and shall not reduce the limits of liability.

Policies containing any SIR provision shall provide or be endorsed to provide that the SIR may be satisfied by either the named insured or City. City reserves the right to obtain a full certified copy of any insurance policy and endorsements. The failure to exercise this right shall not constitute a waiver of such right.
h. Waiver of Subrogation. Contractor hereby agrees to waive subrogation which any insurer of Contractor may acquire from Contractor by virtue of the payment of any loss under a Workers Compensation, Commercial General Liability or 4 Docusign Envelope ID: AE7D277C-C2D8-4E4A-8A6D-7F62BA926925

Automobile Liability policy. All Workers Compensation, Commercial General Liability and Automobile Liability policies shall be endorsed with a waiver of subrogation in favor of City, its officers, agents, employees and volunteers for all work performed by Contractor, its employees, agents and subcontractors. i. Liability/Remedies. Insurance coverage in the minimum amounts set forth herein shall not be construed to relieve Contractor of liability in excess of such coverage, nor shall it preclude City from taking such other actions as are available to it under any other provisions of this Agreement or law.

11. Contractor shall comply with all federal, state, and local laws and ordinances, including but not limited to the City's storm water regulations, as may be applicable to the performance of services under this Agreement. In the event that any signature is delivered by facsimile transmission or by email delivery of a ".pdf" format data file, such signature shall create a valid and binding obligation of the party executing (or on whose behalf such signature is executed) with the same force and effect as if such facsimile or ".pdf" signature page were an original hereof.

14. If either party commences any legal action against the other party arising out of this Agreement or the performance thereof, the prevailing party in such action shall be entitled to recover its reasonable litigation expenses, including but not limited to, court costs, expert witness fees, discovery expenses, and attorneys' fees. Any action arising out of this Agreement shall be brought in Placer County, California, regardless of where else venue may lie. 15. This Agreement shall be binding upon the heirs, successors, executors, administrators and assigns of the respective parties hereto.

Contractor is hereby notified that this project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

19. Contractor/consultant's duties and services under this agreement shall not include preparing or assisting the public entity with any portion of the public entity's preparation of a request for proposals, request for qualifications, or any other solicitation regarding a subsequent or additional contract with the public entity. The public entity entering this agreement shall at all times retain responsibility for public contracting, including with 5 Docusign Envelope ID: AE7D277C-C2D8-4E4A-8A6D-7F62BA926925

respect to any subsequent phase of this project. Contractor/consultant's participation in the planning, discussions, or drawing of project plans or specifications, if any, shall be limited to conceptual, preliminary, or initial plans or specifications. 23. This Agreement may be amended via change order, but only if such change order is made in writing, approved by the City, and signed by both parties.

24. CONTRACTOR agrees to defend and indemnify CITY if, despite the parties intent and practice, any venue, agency, or court with competent jurisdiction determines that CONTRACTOR and/or any of its agents, officers, employees, volunteers, independent contractors, or subcontractors, are characterized as employee(s) of CITY.

Insurance Submission Process
The City of Roseville Human Resources/Risk Management Department uses a service called EBIX to manage our insurance certificate tracking.

How It Works
● The vendor's contact information is entered into EBIX. EBIX will contact the vendor to request proof of insurance.
● The Vendor can forward the request to their Insurance Agent(s) if necessary. ● Vendor/Insurance Agent submits insurance to EBIX by email to [email protected] or by fax to (770) 325-5727. After faxing or emailing the certificate, please DO NOT send the certificate by mail to EBIX. Please do not mail, email or fax any certificates to the City of Roseville. ● Once submitted, EBIX reviews the insurance documentation. If there are deficiencies, EBIX will send a follow up letter or email requesting additional information.

April, 2022
RE: Contractor and Grantee Compliance with Economic Sanctions Imposed in Response to Russia’s Actions in Ukraine
Dear Vendor:

On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (EO) regarding sanctions in response to Russian aggression in Ukraine. The EO is located at https://www.gov.ca.gov/wp-content/uploads/2022/03/3.4.22-Russia-Ukraine-ExecutiveOrder.pdf.

The EO directs all agencies and departments that are subject to the Governor’s authority to take certain immediate steps, including notifying all contractors and grantees of their obligations to comply with existing economic sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law.

This correspondence serves as a notice under the EO that as a contractor or grantee, compliance with the economic sanctions imposed in response to Russia’s actions in Ukraine is required, including with respect to, but not limited to, the federal executive orders identified in the EO and the sanctions identified on the U.S. Department of the Treasury website (https://home.treasury.gov/policy-issues/financial-sanctions/sanctionsprograms-and-country-information/ukraine-russia-related-sanctions). Failure to comply may result in the termination of contracts or grants, as applicable.

Please note that for any agreements or grants valued at $5 million or more you must report to the City of Roseville your compliance with economic sanctions including steps you have taken in response to Russia's actions in Ukraine, including, but not limited to, desisting from making new investments in, or engaging in financial transactions with, Russian entities, not transferring technology to Russia or Russian entities, and directly providing support to the government and people of Ukraine.

Sincerely,
4/25/2022

The parties intend that this provision shall be broadly construed. Contractor's responsibility for such defense and indemnity obligations shall survive the termination or completion of this Agreement for the full period of time allowed by law. The defense and indemnity obligations of this Agreement are undertaken in addition to, and shall not in any way be limited by, the insurance obligations contained in this Agreement.

2. Contractor is an independent contractor, and shall not be considered an officer, agent or employee of the City.

3. Without the written consent of the City, this Agreement is not assignable by Contractor either in whole or in part.

4. Time is of the essence of this Agreement.

5. At any time during the term of this Agreement, the City has the right to terminate this Agreement, provided Contractor is given thirty (30) days written notice. City's termination shall be without further liability to City; however, Contractor shall be entitled to all costs reasonably incurred prior to the date of termination. Contractor acknowledges that City may terminate this Agreement should funds not be appropriated by its governing body to continue services under this Agreement.

6. This Agreement may only be amended or modified in writing. It is integrated and contains the complete understanding of the parties.

For prevailing wage contracts over $25,000, copies of certified payroll must be submitted with invoices. coverage.

Contractor hereby agrees to waive subrogation which any insurer of Contractor may acquire from Contractor by virtue of the payment of any loss under a Workers Compensation, Commercial General Liability or 4 Docusign Envelope ID: 29F2683F-4C96-4401-B642-F11956BBE9E0

A master averaged score sheet shall be created based on the evaluation panel’s initial evaluation.

Proposals shall be scored according to the criteria stated in the RFP.

9.2 Proposals submitted will be reviewed by a selection committee. Consultants that have submitted the best and most complete proposals may be invited to an interview. The number of Consultants invited to an interview may vary depending upon the number of proposals submitted.

9.3 Should the City elect to conduct interviews with any proposers, the following criteria shall be considered and each proposer ranked by the evaluation panel during the interview process: a) Quality of presentation, b) Ability to meet the City’s business goals, c) Communication style.

Page 15 of 26 ends

9.5 A contract will be negotiated with the Consultant considered best meeting the City’s need for this project. In the event a mutually satisfactory contract cannot be negotiated with the City’s first choice, negotiations may be terminated and commenced with the Consultant considered next best in meeting the City’s needs for this particular project.

In the case of differences between written words and figures in a proposal, the amount stated in written words shall govern. In the case of a difference in unit price versus the extended figure, the unit price shall govern.

9.9 The City reserves the right to seek clarification on any or all proposal submittals to ensure the RFP specifications are met. Proposals may be rejected from any proposer who does not comply with the City’s request for clarification.

9.10 Once a decision has been made to award the contract, then a formal notice of the intent to award to the recommended proposer(s) shall be made by the Department.

Therefore, the Consultant shall assume all legal and financial responsibility for taxes, FICA, employee fringe benefits, workers’ compensation, employee insurance, minimum wage requirements, overtime, etc., and agrees to indemnify, save, and hold the City, its officers, agents, and employees, harmless from and against, any and all loss, cost (including attorneys’ fees), and damage of any kind related to such matters.

Page 16 of 26 ends

10.4 Conflict of Interest
The Consultant shall warrant that no official or employee of the City has an interest, has been employed or retained to solicit or aid in the procuring of the resulting contract, nor that any such person will be employed in the performance of such contract without immediate divulgence of such fact to the City. Consultants submitting a proposal in response to this RFP must disclose any actual, apparent, direct, indirect, or potential conflicts of interest that may exist with respect to the Consultant or the Consultant’s management or employees relative to the services to be provided to the City. Conflict of interest issues may require consultation with legal counsel. If a Consultant has no conflicts of interest, a statement to that effect must be included in the proposal.

Violation of this section shall be a material breach of the contract entitling the City to any and all remedies by law or in equity.

10.5 Undue Influence
The Consultant shall warrant via an executed Proposer’s Certification (Attachment A) that no undue influence or pressure is used against or in concert with any officer or employee of the City in connection with the award or terms of the contract that will be executed as a result of this RFP, including any method of coercion, confidential financial arrangement or financial inducement. No officer or employee of the City shall receive compensation, directly or indirectly, from the Consultant, or from any officer, employee or agent of the Consultant, in connection with the award of the contract or any work to be conducted as a result of this RFP.

Violation of this section shall be a material breach of the contract entitling the City to any and all remedies by law or in equity.

10.6 Non-Collusion
Consultant submitting proposals shall warrant via an executed Proposer’s Certification (Attachment A) that their offer is made without any previous understanding, agreement or connection with any person, firm or corporation submitting a separate proposal for the same project and is in all respects fair, without outside control, collusion, fraud or otherwise illegal action. This condition shall not apply to proposals which are submitted by firms who have partnered with others to submit a cooperative proposal that clearly identifies a primary consultant and the associated sub-consultants or sub-contractors. Proposers shall also submit a properly completed and executed “Non-collusion Declaration” which is attached as Attachment D.

Additionally, the Contractor shall provide a completed Levine Act Disclosure Statement Form (Attachment B). A party to a proceeding before an agency involving a license, permit, or other entitlement for use, including contracts not competitively bid and awarded to the lowest responsible bidder with a responsive bid shall disclose on the record of the proceeding any contribution in an amount of more than two hundred fifty dollars ($250) made within the preceding 12 months by the party or the party's agent to a City official/campaign. All costs of complying with the insurance requirements shall be as included in your pricing. The selected Consultant shall provide complete and valid insurance certificates within ten (10) days of the City’s written request. Failure to provide the documents within the time stated may result in rejection of the Consultant’s proposal. If a proposer takes exception to the indemnification and insurance requirements, then the nature and scope of the proposed exceptions may negatively affect the evaluation of that proposer’s

Page 2105 of 3513 ends
Page 17 of 26 ends

submittal and the City’s determination of whether it is possible to successfully negotiate a contract with that firm. Submitting exceptions are at the proposer’s own risk.

10.9 Proposals Property of the City
All documents or materials submitted with or in conjunction with any proposal, including but not limited to electronic files, shall become the property of the City after the proposal submission deadline. No submission documents will be returned. During negotiations, the scope of services may be amended by the City and negotiated based upon ideas provided by other proposers or any other source.

10.10 Proposals are Public Records
All proposals submitted are subject to the public disclosure requirements under the laws of the State of California, unless the City identifies and exercises a right or obligation to exempt any record from public disclosure. However, proposals will not be disclosed until negotiations are complete and a recommendation for selection and award is made.

10.11 Protests
(a) Protest Requirements
(1) Any proposer who is aggrieved in connection with the solicitation or award of a contract may file a protest with the City Clerk’s office. The protest must be received in writing by the City Clerk’s office within seven (7) calendar days after such aggrieved proposer 1) knows or should have known of the facts giving rise thereto or 2) the date of the notice of intent to award, whichever is sooner. In no event shall a protest be allowed after an award has been made by City Council. If the seventh calendar day falls on a weekend or City holiday, the protesting party may submit the protest prior to close of business on the first business day following such weekend or holiday. Failure to submit a timely protest shall bar consideration of a protest. (b) Grounds for Protest

(2) The protest shall state all grounds claimed for the protest and include supporting documentation. Failure to clearly state the grounds for the protest and provide supporting documentation shall be deemed a waiver of all protest rights. (c) Administrative Review
Upon receipt of the protest and after determining the protest was properly filed, the Department Director shall provide a copy of the protest to other proposers who might become aggrieved as a result of the protest and issue a written decision within fourteen (14) calendar days after receipt of the protest. The protesting proposer shall promptly provide any information requested by City staff as part of such investigation.

Page 2106 of 3513 ends
Page 18 of 26 ends

The decision shall either deny or uphold the protest and include reasons for the decision. The written decision shall be final.
(d) Stay of Action During a Protest
In the event a protest is filed under Section 10.11, the City shall not proceed further with the award of the contract until the protest is resolved, unless:
(1) The City Manager or designee makes a determination that the award of the contract without delay is necessary to protect a substantial interest of the City, or (2) The City decides to reject all proposals and issue a new RFP.

10.12 Rejection of RFP
The City reserves the right to reject any or all proposals, to waive defects or irregularities in any proposal or in the RFP process, and to offer to negotiate or contract with any Consultant in response to any RFP. This RFP does not constitute any form of offer to contract.

10.21 Prohibited Transmittals
No telephone or facsimile proposals will be accepted. If a photocopy is submitted, the proposal must be signed in ink.

10.22 Proposal Postponement and Amendment
The City reserves the right to revise or amend the RFP or specifications up to the time set for opening of the proposals. Such revisions and amendments, if any, shall be announced by amendments to this RFP through the City’s web site. Copies of such amendments shall be furnished to all prospective proposers. Prospective proposers are defined as those proposers who have registered and are on the City’s RFP list for this service. If revisions and amendments require changes in quantities, prices or scope of services, the date set for opening of the proposals may be postponed by such number of days as in the opinion of the City shall enable proposers to revise their proposals. Proposals which fail to acknowledge a substantive addendum to the RFP, as determined by the City Attorney’s Office, on the City supplied addendum form will be rejected as non-responsive. Any revisions or amendments to the RFP will become incorporated into any contract awarded pursuant to the RFP.

10.23 Proprietary Information
Proposers submitting a proposal in response to this RFP must provide a statement that nothing contained in the submitted proposal will be proprietary. However, if a proposer desires to claim a privilege against public disclosure for a trade secret or other proprietary information, such information must be submitted with the proposal in a separate envelope marked “confidential.” The City Attorney’s Office will determine if the information is in fact proprietary, based on state and federal law. Note that under California law, a price proposal to a public agency is not a trade secret. The Consultant shall defend, indemnify and hold harmless the City regarding any claim by any third party for the public disclosure of the “confidential” portion of the proposal.

10.24 Right to Request Additional Information
During the evaluation process, the City reserves the right, where it may serve the best interests of the City, to request additional information and clarifications from proposers. Such information will be requested in writing to the specific proposer. This information will become a part of the original proposal submitted by the specific proposer and will be used by the City in evaluating the proposal and will not be shared with other proposers during the evaluation and negotiation process.

10.25 Modification of Proposals
Modification of a proposal already received will be considered only if the modification is received prior to the deadline date for receiving proposals. All modifications shall be made in writing, executed, and submitted in the same form and manner as the original proposal.

10.26 Examination of Contract Documents
Each proposer shall thoroughly examine and be familiar with the terms of this RFP, the sample contract attached as Attachment C, legal and procedural documents, general conditions, specifications, and addenda (if any), which will constitute the contract documents. Page 2108 of 3513 ends
Page 20 of 26 ends

Failure or neglect of a proposer to receive or examine any of the contract documents shall in no way relieve the proposer of any obligation with respect to their proposal or to the contract. No claim for additional compensation will be allowed which is based upon lack of knowledge of any contract document.

10.27 Non-Discrimination

Among these is an anti-discrimination policy, which requires that the City’s contractors not discriminate in hiring on the basis of gender, race, religion, sexual orientation, medical condition, and all other categories protected by law. • Customized Rescue Plan Development: At HMI, we understand that each confined space presents unique challenges. Leveraging our extensive experience in emergency response, we will develop a Confined Space Rescue Plan that is not just compliant with safety regulations but also tailored to the specific characteristics and risks of each site. This plan will include detailed procedures for various rescue scenarios, ensuring that our team is prepared for any eventuality. • Comprehensive Hazard Assessment and Strategy Formulation: Before any confined space entry, our team will conduct comprehensive hazard assessments. These assessments will draw upon the practical insights we gained in the field, ensuring a meticulous evaluation of potential risks. Based on these assessments, we will formulate strategies that are not only effective in ensuring safety but also efficient in execution, ensuring that rescue operations are both swift and secure. • Full Compliance with Equipment Standards: The safety of our equipment is as crucial as the skill of our personnel. We will supply, maintain, and regularly inspect all required rescue equipment, such as harnesses, winches, and gas detectors. Our commitment to meeting and exceeding industry standards is a promise to ensure that every piece of equipment functions reliably in critical moments. • Effective Communication and Drill Protocols: Effective communication and regular drills are essential for a successful rescue operation. Drawing from our experience in coordinating complex rescue efforts, we will establish clear communication channels and protocols. Additionally, conducting regular practice drills will ensure that our team's response is not just theoretically sound but also practically proficient.
• Detailed Reporting and Documentation: Transparency and accountability are cornerstones of our service. HMI will maintain detailed documentation of all activities related to confined space rescue. This includes pre-entry assessments, equipment inspections, and incident reports. Regular and timely reporting to our clients will not just keep them informed but also involved in the continuous improvement of safety protocols.
